CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Howard at 8 : 07 p . m . i 2 . INVOCATION Invocation was given by Rev . Larry Houseman of the Aldersgate Methodist Church , 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Rose - Mary Griak James Heltzer Theodore Rudy Leonard Thiel Frank Howard Councilman Graves arrived at 8 : 25 p . m . Also present were the City Manager , Assistant City Manager , City Attorney , Supervisor of Building and Zoning , Planning Director , Director of Public Works , and Secretary . 4 . MINUTES On motion of Councilman Thiel , seconded by Councilman Fleetham , the minutes of the regular meeting held December 20 , 1971 , were approved by a six yea vote . 5 . PUBLIC HEARINGS (a ) PROPOSED REZONING OF PROPERTY ON AND SOUTH OF EAST OXFORD STREET , THE NEW THOROUGHFARE AT THE NORTH END OF BASS LAKE FROM R - 3 TO I - 1 , REQUESTED BY THE CHICAGO , MILWAUKEE , ST . PAUL AND PACIFIC RAILROAD ( CASE NO. 67 - 22 - Z ) Mayor Howard opened the hearing . To comply with the request of the applicant , it was moved by Councilman Thiel , seconded by Councilman Rudy , to continue the I 1 Council Minutes , January 3 , 1912 5 a hearing to February 7 , 1972 . The motion carried 6 - 0 . ( Councilman Graves was not present . 6 . PETITIONS , REQUESTS , AND COMMUNICATIONS ( a ) APPLICATIONS FOR RENEWAL OF LICENSES TO SELL FOOR INTOXICATING MALT LIQUOrR ON SALE AND OFA' SALE 1972 On motion of Councilman Heltzer , seconded by Councilman Rudy , the following license renewals were approved by a 5 - 0 vote . ( Councilman Graves and Thiel were not present ) : Off - sale - Don' s Park Market , 6312 Minnetonka Boulevard ; Kenny ' s Superette , 7115 Cedar Lake Road , Lincoln Baking Go . , Inc . , 4100 Minnetonka Boulevard ; P D Q Market , 4611 Excelsior Boulevard ,and Tom Thumb Dairy Store , 8140 Minnetonka Boulevard ; Off and On .vales .- Pizza House , 4530 Excelsior Boulevard ; On Sale - Pizza Hut , 5804 Excelsior Boulevard . 7 . RESOLUTIONS AND ORDINANCES (a ) SECOND READING OF PROPOSED ORDINANCE AMENDING THE i ST . LOUIS PARK ZONING ORDINANCE CHANGING BOUNDARIES OF ZONING DISTRICTS ( CASE NO. 71 - 68 - Z ) {� ORDINANCE NO. 1174 It was moved by Councilman Heltzer , seconded by Councilman Graves , to waive second reading and adopt Ordinance No . 1174 entitled , " An Ordinance Amending the St . Louis Park Zoning Ordinance Changing Boundaries of Zoning Districts . " The motion carried 6 - 0 . ( Council - man Thiel was not present ) . 8 . REPORTS OF OFFICERS , BOARDS , AND COMMITTEES ( a ) FINANCIAL REPORT :r. NOVEMBER 1971 T.hdte being no discussion, the report was ordered by the Mayor to be rec ^ ived for filing . 9 . UNFINISHED BUSINESS ( a ) REPORT, RELATIVE TO CERTIFICATE OF OCCUPANCY ORDINANCE ( DEFERRED 'TO , THIS DATE FOR DISCUSSION AND INFORMATIONAL MEETING - SECOND ..RJ ADING TO BE CONSIDERED JANUARY 10 , 1972 ) The City Manager , Supervisor of Building and Zoning , and the Planning Director gave a history of the proposed ordinance , outlined the nine 2 Council Minutes , January 3 , 1972 9 . (a ) points in the housing inspection program , and explained the ordinance as it relates to the Workable Program , requirements for federal funding and housing for low income and elderly . Mr . Roger Israel of the Housing and Redevelopment Authority spoke in favor of the ordinance . He explained that the HRA feels strongly that the ordinance is necessar • • primarily to avoid some of the serious problems being witnesssed in the core city today . He felt 31t was the best alternative available and better both economically and socially t than relocation of fam:dies which can be caused by deterioriation of the quality of housing , Mr . R . D . Rice , 2637 Toledo Avenue ; and Mr ,, Collins , 2704 Blackstone Avenue , had queptions concerning the proposed ordinance which were answered by the Mayor and staff. They were i generally in opposition to the ordinance as presentede Objections were expressed to the fee , invasion of privacy , hardship to the seller as well as the . buyer , cost of repairs and the opinion that it would tend to increase „the assessed valuation of properties Since no .one . else wished to speak , the Mayor explained that the matter would be on the agenda Januar -%r 10 , 1972 to vote on the proposed ordinance , . t (b ) APPOINTMENT TO BOAR DS ' %'dONIMISSIOivS ( DEFERRED FROM ' DECEMBER 20 , 1971 ) It was moved by Councilman Heltzer , seconded b%r Councilman Griak , to defer this matter to January 10 , 1072 . The motion. carried 7 - 0 . w The resignation of Mr . Middleton from the Parks and Recreation Advisory Co= iission was announced , 10 . NEW ,$ USINESS (a ) AUTHORIZATION OF AD l�, OR BIDS - SANITARY SEWER , LIFT STATIONS AND APPURTENANT WORK , MODIFIED IMPROVEMENT NOS , 71 - 07 AND 71 - 08 3 Council Minutes , January 31 1972 10 , ( a ) It was moved by Councilman Graves , seconded by Councilman Heltzer , to authorize advertisement for bids . The motion carried 7 - 0 . (b ) REQUEST FOR STOP SIGNS - 29TH STREET AND JERSEY AVENUE Councilman Heltzer requested a report as to the feasibility of t stop signs on 29th Street and JQrsey Avenue . ' (c ) MINNESOTA POLLUTION CONTROL AGENCY IMPLEMENTATION PLAN RESOLUTION NO* 4424 It was moved by Councilman Fleetham , seconded by Councilman Thiel , to waive reading and adopt Resolv.tion No , 4424 entitled , " Resolution in Relatio :-i to Minnesota Pollution Control Agency Implementation Plan. " The moeion carried 7 - O . 11 , MISCELLANEOUS None 12 , CLAIMS , APPROPRIATIONS , AND CONTRACT PAYMENTS ' None 13 , ADJOURNMENT On motion of Councilman Graves , seconded by Councilman Fleetham , the meeting was adjourned at 11 : 05 pome by a seven yea vote . gel " 9Z.
