CALL TO ORDER meeting of the City Council was called to order by Mayor A regular m g Pucci at 8 : 04 p . m . 2 . INVOCATION Invocation was given by Rev . Milton Lentz of the Aldersgate Methodist Church . 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Rose - Mary Griak Lyle Hanks James Heltzer Leonard Thiel Frank Pucci Also present were the . City Manager , City Attorney , Planning Director , Director of Public Works , ' and Secretary . 4. MINUTES On motion of Councilman Fleetham , seconded by Councilman ..Hanks , the minutes of the special meeting held January 10 , 1972 , were approved by a six yea vote with the following amendments : Page 7 , Item 7 ( a ) - Change to - " Councilman Griak spoke in favor of their being some type of active housing inspection . " - Pag ? 11 , Item 9 (b ) - . . ' Councilman Fleetham voting nay because he felt the resolution was redundant inasmuch as the Council had previously adopted a resolution opposing I - 394 and also a conference should be held for a positive purpose rather than a negative purpose . " - Page 12 , Item 10 (h ) - Change title of resolution to " Resolution Declaring Position of Fire Technician to be a Separate Intermediate Position of the City. to 5 . PUBLIC HEARINGS None 6 . PETITIONS , REQUESTS , AND COMMUNICATIONS (a ) REQUEST OF DR , CHARLES A HORWITZ AND DR , RALPH 14 Council Minutes , January 17 , 1972 6 . (a ) PAPERMASTER FOR BARRIER ACROSS END OF ALLEY, 2700 BLOCK BETWEEN HUNTINGTON AND GLENHURST AVENUES i After discussion , as to the: need for .barrier and _ types of barriers that might be placed , Councilman Fleetham moved to defer to January 31 , 1972 to give Council an opportunity to view the area . Councilman Griak seconded and the motion carried 5 - 0 . ( Councilman Heltze � was out of the chamber s ) . (b ) REQUEST OF ANCHOR INN TO PERMIT PARKING ON EXCELSIOR BOULEVARD After discussion of the parking and traffic in that area of Excelsior Boulevard , Councilman Fleetham moved to support the recommendation of the staff opposing any increased on - street parking in the area and urgin :; removal of the present fifteen minute parking . Councilman 7.1.: r'-31. seconded and the motion carried 4 - 1 , Mayor Pucci voting nay, ( ,Councilman Heltzer was not present ) . (c ) APPLICATION FOR RENEWAL OF NON - INTOXICATING LIQUOR LICENSE FOR 1972 - OFF SALE It was moved by Councilman Griak , seconded by Councilman Thiel , to renew the non - intoxicating off- sale liquor license of Bernies Park ; Delicatessen ,. , 4212 West Lake Street . The motion carried . 61 - 0 . (d ) REQUEST OF NEIL HAMILTON RELATIVE TO WIRING , PLUMBING PERMITS , ETC . -- PROPOSED DWELLING UNIT AT 422: 1 CEDAR STREET It was moved by Councilman Thiel , ; seconded by Councilman } Fleetham , , .to adopt the following procedure for the handling of license and permit requirements for the individual home owner : 1 . That he. sign an affidavit that he is the owner of the land , is and will be the owner, of the finished dwelling unit and will occupy said dwelling unit , 2 . That the electrical , plumbing and heating work that he proposes to do be done by him personally and that he obtain all permits , all inspections , comply with test procedures , and - meet: all minimum standards of all relative codes . 3 . That he is competent and capable of doing the work required by the code . 4 . That he obtain licensed contractors to install the building sewer , the water service , and the electrical service entrance . These items 15 . Council Iviinutes , January 17 , 1972 " 6 . (d ) are beyond the abilities of untrained persons . !' 5 . A 50 % supervision fee above standard fees is currently required in the electrical ordinance for owner occupied dwellings . It is suggested that this apply to all mechanical and plumbing work also to compensate for. above I ormal supervision and recall The mation carried 6 •• 0 .1 7 . RESOLUTIONS AND ORDINANCES (a ) SECOND READING OF PROPOSED ORDINANCE AUTHORIZING THE TRANSFEnS OF FUNDS ORDINANCE NOo 1175 It was moved by Councdvlman Fleetham , seconded by Councilman Heltzer , to waive second reading and adopt Ordinance No . 1175 entitled , " An Ordinance Authorizing the Transfers of Funds and Providing Appropriations for Salary Adjustments and Insurance Contributions for Year Ending December 31 , 1972 . " The motion carried 6 - 0 . (b ) FIRST READING OF PROPOSED ORDINANCE AMENDING THE FOLLOWING SECTIONS OF THE ST . LOUIS PARK ORDINANCE CODE RELATIVE TO TI-IE POSITION C LASSIFICA TION PLAN , COMPENSATION PLAN , BASIC PERSONNEL POLICY AND CONDITIONS OF CI 'T' Y EMPLOYMENT : SECTION 1 : 303 APPOINT - MENT PROCEDURES ; SECTION 1 : 304 PROMOTION AND DEMOTION ; SECTION 1 : 306 PROVISIONAL APPOINTMENTS ; SECTION 1 : 308 COMPENSATION PLAN ; SECTION 1 : 311 PART TIME , CASUAL OR SEASONAL WORK ; AND SECTION 1 : 325 SUSPENSION AND DISMIS - SAL It was moved by Councilman Yleethamr ,, seconded by Councilman Thiel , to waive fi =• st reading and set second reading January 31 , � 1972 . KIEFFER , OWNER, AND SUPPORTED BY DIRFr%]jTO.R OF PUBLIC WORKS ) RESOLUTION NOo 4434 It was moved by Councilman Thiel , seconded by Councilman Griak , to waive reading and adopt Resolution No . 4434 entitled , " Resolution - 16 Council Minutes , January 17 , 1972 7 . (c ) Authorizing Placement of Traffic Control Signs Regulating Parking . " The motion carried 6 - 0 . ( d ) RESOLUTION REQUESTING THE STATE HIGHWAY DEPARTMENT TO CONSTRUCT A PEDESTRIAN WALKWAY ON THE TARGET ROAD BRIDGE OVER MINNEHAAHA CREEK ( REQUESTED BY COUNCIL ) RESOLUTION NO, 4435 It was moved by Councilman Fleltzer , seconded by Councilman Hanks , to waive reading and adopt Resolution No . 4435 entitled , " Resolution Requesting the State Highway Department to Construct a Pedestrian Walkway on the Target Road Bridge Over Minnehala Creek . " The motion carried 6 - 0 , 8 . REPORTS OF OFFICERS , BOARDS , AND COMMITTEES ( a ) MINUTES OF BUILDIPJG CONSTRUCTION CODES ADVISORY COMMITTEE MEETING HELD DECEMBER 21 , 1971 Upon hearing no discussion , the minuto3s were ordered by the Mayor to be received for filing : (b ) MINUTES OF PLANNING COMMISSION MEETING HELD JANUARY 5 , 1972 Upon hearing no discussion , the minutes were ordered by the Mayor to be received for filing , (c ) REPORT OF SPECIAL MEETING OF THE BOARD OF DIRECTORS OF HENNEPIN COUNTY LEAGUE Councilman Thiel reported that the Board of Directors had met with the PCA and Hennepin County Board . The object of the meeting was to determine the authority regarding pollution control . It was suggested that seven counties get together with a joint powers arrangement but that each county have some control over their area . Councilman Thiel. expressed concern that St. Louis Park may be required to expend funds when this City has already adopted the ordinances and procedures for strict pollution control . 9 . UNFINISHED BUSINESS (a ) APPOINTMENTS TO BOARDS AND COMMISSIONS ( DEFERRED FROM JANUARY 10 , 1972 ) It was moved by Councilman Fleetham , seconded by Councilman Griak , to appoint the following Council representatives to Commissions : 32 Council Minutes , January 179 19 ? 2 Cc , 11 Commission - Councilmen Graves and FleetAdvisor 9 . The motion carried 6 - 0 . It was moved by Councilman Hanks , seconded by Councilman Fleetham , to appoint Charles Pfannenstein ( subject to approval of School Board ) to fill the unexpired term of C . R . Middleton and Glenn Sullivan to fill the unexpired term of Rose - Mary Griak . The motion carried 6 - 0 . ( Parks and Recreation Commission ) It was moved by Councilman Heltzer , seconded by Councilman Griak , to appoint Al Hyster to replace Frank Pucci and Gale Held to fill the unexpired term of Jerry Rotman on the Citizens Advisory Committee . The motion carried 6 - 0 . It was moved by Councilman Heltzer , seconded by Councilman Hanks , to appoint J . N . Hove to replace Diane Esler on the Human Rights Commission. The motion carried 6 - 0 . 10 . NEW BUSINESS ( a ) TABULATION OF BIDS - STREET WORK SUPPLIES It was moved by Councilman Fleetham , seconded by Councilman Thiel , to reject bids for RC - 800 Asphalt and MC - 30 and readvertise and designate lowest responsible bidders as follows : AC - 1 Bituminous Mixture , Hardrives , Inc . . SC - 250 Bituminous Mixture , Midwest Asphalt Corp . ; Class 5 Gravel , W . G . Pearson , Inc . ; FA - 4 Aggregate , Northwestern Gravel Co . ; A - 4 Aggregate , Bryon Dresser Traprock , Inc , ; Crushed Limestone , Bryon Dresser Traprock, Inc . ; FA - l Sand , Anderson Aggregate , Inc . and Buesing Bros . Trucking , Inc . ; SC - 3000 Bituminous Mixture , Midwest Asphalt Corp , The motion carried 6 - 0 . 11 . MISCELLANEOUS ( a ) DAMAGE CLAIMS 18 Council Minutes , January 17 , 1972 I 11 . (a ) 1 . Peter M. Pas s olt , 4045 Raleigh Avenue It was moved by Councilman Fleetham , seconded by Councilman Thiel , to file claim with City Clerk for proper action by the City Manager and City Attorney. The motion carried 6 - 0 . (b ) RAILROAD CONDEMNATION AWARD Councilman Thiel moved to authorize payment of $ 230 , 000 as the amount of award to Chicago , Milwaukee , St . Paul & Pacific Railroad Company . Councilman Heltzer seconded and the motion carried 6 - 0 . (c ) OPENING OF ALLEY - 40TH LANE The City Manager explained to Council that he had received a request from a resident at 4805 - 40th Lane asking that a dedicated alley be opened . Councilman Hanks moved to defer for further investigation of the facts . Councilman Thiel seconded and the motion carri ed 6 - 0 . (d ) EXCHANGE OF LAND REQUEST FROM BETH EL SYNAGOGUE The City Manager described the request for exchange of land and explained that the staff and Parks and Recreation Commission recommended its denial because fencing and landscaping had just been completed . Councilman Thiel moved to deny the request . } Councilman Griak seconded and the motion carried 6 0 . ( e ) NAMING OF PARKS i r The City Manager explained t . tat staff had a prepared list of t suggested . names that could be reviewed by Council in order to have parks moreproperly identified . Councilman Thiel moved to defer this matter to January 31 , 1972 , Councilman Hanks seconded and the motion carried 6 - 0 . (f ) CATV PLANNING CONFERENCE - DAYTON , OHIO Councilman Fleetham moved that a staff member be authorized to attend the CATV Conference in Dayton , Ohio . Councilman Thiel seconded and the motion carried 6 - 0 . 19 Council Minutes , January 173P 1972 lI . ( g ) CITIZEN INQUIRY Mr . Bob Hardy , 3000 Alabama Avenue , explained that he did not understand business being conducted by Council as it is listed on the printed agendas and inquired as to the procedure for having a matter be brought to Council for discussion . The Mayor indicated that he would attempt to have agendas more explanatory and that he would give Mr . Hardy the procedure in writing for having items placed on the agenda . 12 . CLAIMS , APPROPRIATIONS , AND CONTRACT PAYMENTS None 13 , ADJOURNMENT On motion of Councilman Thiel , seconded by Councilman Griak , the meeting was adjourned at 9 : 25 p . m . by a six yea vote .
