CALL TO ORDER A special meeting of the City Council was called to order by Mayor Howard at 8 : 05 pm . Z . INVOCATION Invocation was given by Rev . Larry Houseman of the Aldersgate Methodist Church , 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Rose - Mary Griak James Heltzer Theodore Rudy Leonard Thiel Frank Howard Councilman Graves arrived at 8 : 07 p . m . Also present were the City Manager , Assistant City Manager , City Attorney, Planning Director , Director of Public Works , Supervisor of Building and Zoning , and Secretary. 4 . COUNCIL BUSINESS - 1971 (a ) MTNU '�' � S On motion of Councilman Rudy, seconded by Councilman Thiel , the minutes of the regular meetir_ *7 held January 3 , 1972 , were approved by a seven yea vote . (b ) CLAIMS , APPROPRIATIONS AND CONTRACT PAYMENTS 1 . Verified Claims On motion of Councilman Thiel , seconded by Councilman Rudy , the lists of verified claims prepared by the Director of Finance and presented to the Council dated January 10 , 1972 in the total and - or amounts of $ 6 , ? 71 04 for payroll , fvendors were approved , and the City Manager , City Clerk , and City Treasurer were authorized to issue checks covering same by a seven yea vote . 5 Council Minutes , January 10 , 1972 4 . Amount , $ 3 , 862 . 55 . r On motion of Councilman Thiel , seconded by Councilman Griak , the above payments on contract work presented by the City Engineer were approved , and the City Manager , City Clerk, and City Treasurer were authorized to issue checks for their respective amounts by a seven yea vote . (c ) INSTALLATION AND OATH OF OFFICE -- MAYOR AND COUNCILMEN The following elected officials were sworn in by the City Clerk: Mayor Frank Pucci , Councilman Second Ward Lyle Hanks Councilman Fourth Ward Rose - Mary Grica! k Councilman - At - Large Richard Graves The Mayor declared a recess . 5 . COUNCIL BUSINESS - 1972 ( a ) CALL TO RECONVENE The meeting was called to reconvene at 8 : 25 pm . by Mayor Pucci. PETITIONS , REQUESTS , AND COMMUNICATIONS (a ) REQUEST OF CARROLL HURD RELATIVE TO TRAFFIC MEDIAN 6 Council Minutes , January 10 , 1972 6 . (a ) ON WOODDALE AVENUE AND EXCELSIOR BOULEVARD Mr . Hurd , Director of First Federal Savings and Loan on Excelsior Boulevard , explained to Council the great inconvenience to First Federal and the Miracle Mile Shopping Center that is caused by the median on W ooddale Avenue . The MZyor explained that this . Zatter is being studied by the Streets and Highways 5ubcominittee of the Planning Commission and that the matter would be before the Council in the near future . (b ) APPLICATION FOR RENEWAL OF NON - INTOXICATING OFF SALE LIQUOR LICENSE - EXCELSIOR BOULEVARD KWIK SHOP , 6006 EXCELSIOR BOULEVARD It was moved by Councilman Heltzer , seconded by Councilman Graves , to approve the license renewal for 1972 . The motion carried 7 - 0 � (c ) APPLICATION FOR ON SALE NON - INT OXICA TING LIQUOR LICENSE - TEXA TONKA LANES It was moverl by Councilman Graves , seconded by Councilman Hanks , to set date for hearing February 7 , 1972 . The motion carried 7 - 0 . 7 . RESOLUTIONS AND ORDINANCES (a ) SECOND READING OF PROPOSED ORDINANCE AMENDING CHAPTER 5 OF THE ST . LOUIS PARK ORDINANCE CODE BY ADDING SECTION 5 : 2305 RELATIVE TO CERTIFICATE OF OCCUPANCY ORDINANCE REQUIREMENTS "'" Councilman Griak spoke in fav -_jr of the proposed ordinance and felt there should be citizen involvement in developing the guide �`- lines . At her request slides were shown depicting some of the violations that had been discovered in the City by the inspectors . Councilman Thiel moved that the staffand commissi ons recommend guide lines and implementatihn of same by February 7 to be made available to those interested and that the matter come back to Council March 6 with input from citizens . The motion was seconded by Councilman Hanks who reminded those present that there is now in effect an ordinance for door - to - door inspection. Councilman Heltzer said that whatever kind of inspection the City has it must be fair , honest and equitable . Council agreed that citizen involvement is of utmost importance since broad support will be needed fdr_ a successful program . 7 G; Council Minutes , January 10 , 1972 7 a Mr . Ron Schally , 3301 Sumter Avenue , agreed there should be S • ( ) more citizen input and felt there should be a referendum on this matte r . Mr . Wayne Brittan , 3121 Jersey Avenue , felt the ordinance should be fair and honest and should be applied equally whether a home is being sold or not . Mr . Ben Norgren , 1312 Melrose Avenue , felt that violations displayed in the slides should not be permitted occur and that all homes should be inspected every five years . Mr . Harvey Ratner , 2301 Parklands Road , felt that inspections should be at the voluntary request of the buyer . Vote on the motion carried 7 - 0 . (b ) RESOLUTION PROVIDING FOR THE EMPLOYMENT OF GEORGE M . HANSEN COMPANY TO AUDIT THE ACCOUNTS AND RECORDS OF THE CITY FOR THE 1971 FISCAL YEAR (M & C NO . 72 - 02 ) RESOLUTION NO. 4425 It was moved by Councilman Fleetham , seconded by Councilman Graves , to waive reading and adopt Resolution No . 4425 entitled , " Resolution Providing for the Employment of George M. Hansen Company to Audit the Accounts and Records of the City for the 1971 ' Fiscal Year . 11The motion carried 7 - 0 . ( c ) RESOLUTION AUTHORIZING PLACEMENT AND REMOVAL OF TRAFFIC CONTROL SIGNS IN AREAS OF AQUILA LANE AND CAVELL AND TEXA TONKA NEIGHBORHOOD (AUTHORIZED BY COUNCIL DECEMBER 20 , 1971 ) RESOLUTION NO. 4426 i It was moved by Councilman Fleetham , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 4426 entitled , ' " Resolution Authorizing Placement of Stop Signs for Traffic Control at Intersections of Aquila Lane and 31st Street , Aquila and 34th Street , T - Intersection of Virginia and Virginia and Intersection of j Texas and 28th Street and Repealing Resolution No . 2828 Adopted June 21 , 1965 and Resolution No . 3661 Adopted January 20 , 1969 . " The motion carried 7 - 0 . 8 l Council Minutes , January 10 , 1972 8 . REPORTS OF OFFICERS , BOARDS , AND COMMITTEES (a ) REPORT OF PLANNING COMMISSION RECOIVIMENDING FAVORABLY WITH CONDITIONS UPON THE REQUEST FOR SPECIAL PERMIT UNDER PROVISIONS OF SECTION 6 : 122 . 11 ( CASE NO. 71 - 44 - S . P . ) TO REDEVELOP A DRIVE IN RESTAURANT AT 6320 WEST LAKE STREET BY MCDONALD ' S CORPORATION 1 RESOLUTION NO, 4427 It was moved by Councilman Graves , seconded by Councilman Griak, to waive reading and adopt Resolution No . 4427 entitled , " Resolution Granting Permit Under Section 6 : 122 . 11 of the St . Louis Park Zoning Ordinance for Redeveloping a Drive In Restaurant. " The motion carried 7 - 0 . (b ) REPORT OF PLANNING COMIvi1SSION ( CASE NO. 71 - 43 - RE ) RECOMMENDING NO PUBLIC NEED FOR LOT 20 BLOCK 5 , WOODDALE AND RECOMMENDING RETENTION OF STREET FOR PEDESTRIAN WAY RESOLUTION NO, 4428 It was moved by Councilman Fleetham , seconded by Councilman Thiel , to waive reading and adopt Resolution No . 4428 entitled , "Authorizing Reconveyance of Tax - Forfeited Lands , " retaining street for pedestrian way. The motion carried 7 - 0 . Councilman Griak moved to reconsider this matter . The motion was seconded by Councilman Thiel but after consideration Councilman Griak withdrew her motion. (c ) REPORT OF BOARD OF ZONING APPEALS ( CASE NO. 71 - 81 - VAR . ) UPON THE REQUEST OF ALTON M . JOHNSON FOR A VARIANCE FROM SECTION 6 : 144 . 6 OF THE ST . LOUIS PARK ZONING ORDINANCE TO PERMIT A REAR YARD OF 0 FEET INSTEAD OF THE REQUIRED 10 FEET FOR PROPERTY LOCATED IN THE I - 1 DISTRICT ON THE NORTH TWO - THIRDS OF LOT 8 , BLOCK 1 , FERN HILL ADDITION ( 3119 LYNN AVENUE ) It was moved by Councilman Hanks , seconded by Councilman Fleetham , to set date for hearing February 7 , 1972 . The motion carried 7 - 0 . (d ) REPORT RELATIVE TO REQUEST TO CONSTRUCT FENCE ACROSS EASEMENT AT 3402 HUNTINGTON AVENUE It was moved by Councilman Fleetham , seconded by Councilman Heltzer , to approve subject to agreement. ( i ) REPORT OF BOARD OF ZONING APPEALS RECOMMENDING FAVORABLY UPON THE REQUEST OF MARCE LLA I . HOLT ( CASE NO. 71 - 80 - VAR . ) FOR A VARIANCE FROM SECTION 6 : 042 . 4 AND 6 : 172 . 4 , SUBDIVISION 24 , TO PERMIT CONSTRUCTION OF A RESTAURANT WITH 32 PARKING SPACES INSTEAD OF THE REQUIR ED 76 SPACES FOR PROPERTY LOCATED AT 4530 - 32 1 EXCELSIOR BOULEVARD It was moved by Councilman Graves , seconded by Councilman Heltzer , to set date for hearing January 31 , 1972 . The motion carried 7 - 0 . 9 . UNFINISHED BUSINESS (a ) APPOINTMENTS TO BOARDS / COMMISSIONS ( DEFERRED FROM JANUARY 3 , 1972 ) It was moved by Councilman Thiel , seconded by Councilman Graves , to defer one week. The motion carried 7 - 0 . Councilman Griak moved that there be 50 % attendance for all commissions with the exception of Board of Zoning Appeals and Planning Commission which should be set at 60 % and that the 10 Council Minutes , January 10 , 1972 -*4 9 . (a ) participants would be notified of our expectation of dropping them pending an appeal or notification of the chairman. Councilman Graves seconded and the motion carried 7 - 0 . ( b ) COMMUNICATION FROM CITIZENS ADVISORY COMMITTEE REQUESTING RESOLUTION BE ADOPTED RELATIVE TO I - 394 CORRIDOR ( DEFEATED BY 3 - 3 VOTE DECEMBER 20 , 1971 - REQUESTED BY COUNCILMA 4 GRAVES TO BE PLACED ON AGENDA ) RESOLUTION NO. 4429 It was moved by Councilman Graves to waive reading and adopt Resolution No . 4429 entitled , " Resolution Requested by Citizens Advisory Committee Suggesting that a Conference be Held Relative to Interstate 394 . " Councilman Heltzer seconded and amended by deleting the words , " and other governmental officials both local and national . " After discussing the effectiveness and implementation of this resolution the motion carried 6 - 1 , Councilman Fleetham voting nay. - qrt, , .. / 31 - 1-� AA ( c ) CONTRACT FOR TURBINE PUMP AND MOTOR REPLACEMENT ( DEFERRED FROM/ DECEMBER 209 1971 ) Councilman Hanks moved to designate Northland Supply Co . as the lowest responsible bidder in amount of $ 9 , 300 and authorize execution of the contract . Councilman Graves seconded and the motion carried 7 - 0 . 10 . NEW BUSINESS ( a ) APPROVAL OF SURETY BONDS FOR CITY MANAGER , CITY CLERK AND CITY TREASURER Councilman Graves moved to accept and authorize filing with Secretary to Council in accordance with provisions of Section 11 . 4 of the City Charter . Councilman Thiel seconded and the motion carried 7 - 0 . (b ) TABULATION OF BIDS - SEWER RODDING MACHINE ! It was moved by Councilman Fleetham , seconded by Councilman Thiel , to designate Flexible Pipe Tool Company as the lowest responsible bidder in the amount of $ 5 , 774 . 70 . The motion carried 7 - 0 . The City Attorney ruled that this award was proper . 11 I i Council Minutes , January 10 , 1972 0 10 c TABULATION OF BIDS - CITY OWNED VEHICLES It was moved by Councilman Thiel , seconded by Councilman Graves , to acce t bid of $ 267 for sale of Unit # 342 and reject the remaing ' bids , holding the vehicles for auction iin n May 1972 . The motion carried 7 - 0 . (d ) CITY I:ALL SOUND SYSTEM Councilman Fleetham moved to authorize City Manager to draw specifications and advertise for bids for upgrading the sound system in City Hall . Councilman Griak seconded and the motion carried 7 - 0 . Councilman Thiel indicated he felt the specifications should be brought back to Council . (e ) REQUEST FROM ANIMAL HUMANE SOCIETY FOR CAMPFIRE GIRLS TO BE GRANTED PERMISSION TO SOLICIT FUNDS FOR THE SOCIETY Councilman Graves asked that th6 City Attorney give a report relative to this request and that he communicate with the Society. (f ) CLASSIFICATION PLAN RESOLUTION NO, 443.0 1 It was moved by Councilman Fleetham , seconded by Councilman Thiel , to waive reading and adopt Resolution No . 4430 entitled , " Resolution Adopting Position Classification Assignment Table Effective December 27 , 19719 " including Tables I and II of report . The motion carried 7 - 0 . ( g ) ORDINANCE AUTHORIZING TRANSFERS OF FUNDS AND PROVIDING APPROPRIATIONS FOR SALARY ADJUSTMENTS AND INSURANCE CONTRIBUTIONS FOR YEAR ENDING DECEMBER 31 , 1972 It was moved by Councilman Fleetham , seconded by Councilman Graves , to waive first reading and set second reading January 17 , 1972 . The motion carried 7 - 0 . ( h ) POSITION OF FIRE TECHNICIAN x RESOLUTION NO. 4431 It was moved by Councilman Fleetham , seconded by Councilman Graves , to waive reading and adopt Resolution' " ResHlution Declaring Position of Fire Technician tobe Intermediate 4 Officer of City. The motion carried 7 - 0 . (b ) JOINT MEETING WITH HRA It was decided that there would be joint meeting with HRA , at 7 : 00 p . m . .. January 24 , 1972 . (c ) RECERTIFICATION OF 1971 TAX LEVIES RESOLUTION NO, 4432 It was moved by Councilman Thiel , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 4432 entitled , " Resolution Recertifying 1971 Tax Levy , Collectible in 1972 for the Housing and Redevelopment Authority of St . Louis Park . " The motion carried 7 - 0 . RESOLUTION NO, 4433 It was moved by Councilman Thiel , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 4433 entitled , " Resolution Recertifying 1971 Tax Levies Collectible in 1972 .
