LOUIS PARK , MINNESOTA September 13 , 1971 1 , CALL TO ORDER City Council was called to order by Mayor A regular meeting of the Howard at 8 : 08 P . M * 2 . INVOCATION Since there was no clergyman present from the Ministerial Association, there was no invocation . ' 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Richard Graves James Heltzer Leonard Thiel Frank Howard Also present were the City Manager , Assistant City Manager , City Attorney , Planning Director , City Assessor , City Engineer , Supervisor of Water and Sewer Department , and Secretary . Councilman Galinson arrived at 8 ; 13 p . m . 4 . MINUTES On motion of Councilman Thiel , seconded by Councilman Graves , the minutes of the regular meeting held aeptember 7 , 1971 , were approved by a five yea vote . ( Councilman Galinson was not present ) . 5 . PUBLIC HEARINGS (a ) PROPOSED ASSESSMENT , IMPROVEMENT NO, 66 - 08D , SIDEWALK ( HEARING CONTINUED FROM AUGUST 16 AND AUGUST 30 , 1971 ) Mr . John Crouch , attorney representing Mrs . Peterson , the property owner , was present objecting to the proposed assessment . The City Attorney explained that since the last hearing the attorneys office had gone back to the original court records on he condemnation it appeared that the cost should be adjusted from $ 3 , 523 . 26 to $ 1 , '131 . 44 . 268 Council Minutes , September 13 , 1971 (a ) Mr . Crouch did not agree to this adjusted assessment as 5 ' he felt the entire special assessment shoula be abated . There being no one else present wishing to speak , the Mayor the hearing closed . y declared RESOLUTI ')N NO , 4338 It was moved by Councilman Fleetham , seconded by Councilman Thiel , to waive reading and adopt Resolution No . 4338 entitled , " Resolution Adopting Assessment Improvement No . 66 - 08D, " with the amount of the as s e s sm ent to be $ 1 , 431 . 44 . The motion carried 6 - 0 . 6, PETITIONS , REQ UES TS , AND COMMUNICATIONS ( a ) REQUEST TO ADDRESS COUNCIL - BEN NORGREN , 1312 MELROSE AVENUE Mr . Norgren stated that he had little or no water pressure at times in his system . Mr . Maynard Kays , Supervisor of Water and Sewer , explained that the department tries to maintain 50 lb . pressure and said he would place a gage on this line to measure the pressure at this particular location . 7 . RESOLUTIONS AND ORDINANCES ( a ) RESOLUTION DECLARING COST AND ORDERING PREPARATION OF PROPOSED ASSESSMENT IMPROVEMENT NO. 70 - 20 RESOLUTION NO. 4339 It was moved by Councilman Calinson , seconded by Councilman Thiel , to waive reading and adopt Resolution Noe 4339 entitled , " Resolution Declaring Cost to be Assessed and Ordering Preparation Of Proposed Assessment Improvement Noe 70 - 20 . " The motion carried 6 - 0 (b ) RESOLUTION CALLING PUBLIC HEARING , PROPOSED ASSESSMENT , IMPROVEMENT NO, 70 - 20 RESOLUTION N O. 4340 It was moved by Councilman Graves , seconded by Councilman Galinsons to waive reading and adopt Resolution No . 4340 entitled , " Resolution Calling Public Hearing on Proposed Special Assessment 1111Provennent No . 70 - 20 . Mrs . Pauline Langsdorf , chairman of environmental commission of ission has been working °uisi Crystal , indicated their commPark * problem and she was pleased with the progress of St . Lo Vote on the motion carried 4 - 2 , Councilmen Thiel and Fleetham voting nay . It was moved by Councilman Heltzer , seconded by Councilman Galinson , to review the ordinance July 17 , 1972 . The motion carried 6 - 0 . Councilman Heltzer moved to authorize staff to take proper action to establish a separate environ_nental committee . Councilman Graves seconded and the motion carried 6 - 0 . 8 . REPORTS OF OFFICERS , BOARDS , AND COMMITTEES ( a ) ENGINEERING REPORT RELATIVE TO BASS LAKs. DEVELOPMENT It was moved by Councilman Fleetham , seconded by Councilman Heltzer , to approve the report and authorize a contract . The motion carried 6 - 0 . ( Contract with Eugene A . Hickok & Associates , not to exceed $ 8 , 000 ) . (b ) REPORT RELATIVE TO PURCHASE OF PROPERTY - WEST 38TH STREET AND PRINCETON AVENUE (M & C NO. 71 - 30 ) It was moved by Councilman Fleetham , seconded by Councilman 270 6ouncil Nunutes , September 13 , 1911 $ ( b ) Graves , to authorize staff to neguj is e purchase , The motion carried 6 - 0 . on (c ) MINUTES OF HUMAN RIGHTS C 01VITAISSION MEETING HE L AUGUST 18 , 1971 D It was suggested by Councilma ,. Thiel that for the Housing Institute both those with good and bad experiences be asked toart p icipate . Councilman Heltzer asked that chairmen of the Commissions be asked to participate in the budget session if they desire . 9 , UNFINISHED BUSINESS ( a ) PROPOSED PRELIMINARY PLAT - AMCR ADDITION ( DEFERRED FROM AUGUST 30 , 1971 ) It was moved by Councilman Graves , seconded by Councilman Fleetham , to set date for public hearing October 4 , 1971 . The motion carried 6 - 0 . (b ) LEASE AGREEMENT FOR PARK - CEDAR TRAILS ADDITION Councilman Thiel moved to authorize execution of the lease . Councilman Galinson seconded and the motion carried 6 - 0 . (c ) RESIGNATION OF SECOND WARD COUNCILMAN AND FILLING OF VACANCY This matter was acted upon early in the meeting but the newly appointed councilinan abstained from voting on all matters because he was not familiar with the items under discussion . Councilman Graves moved to appoint Mr . Theodore Rudy as second ward councilman . Councilman Galinson seconded but the Mayor declared the motion out of order and it was withdrawn . RESOLUTION NO. 4341 It was moved by Councilman Galinson , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 4341 entitled , " Resolution Declaring Council Vacancy in Office of Second Ward Councilman . " The motion carried 6 - 0 . RESOLUTION NO. 4342 Cal*Was moved by Councilman Graves , seconded by Councilman to waive reading and adopt Resolution No . 4342 entitled , 271 Council Minutes , September 13 , 1971 Rudy to Office of Second Ward q . The motion carried 6 - 0 . (b ) APPOINTMENTS 07 YOUTH TO ADVISORY COMMISSIONS It was moved by Councilman Galinson , seconded by Councilman Heltzer , to appoint Art Gurewit "" to the Parks and Recreation Advisory Commission , The motioutcarried 6 - ' 0 . It was moved by Councilman ("Jalinson , seconded by Councilman Thiel , to appoint Corey Gordon to the Human Rights Commission. The motion carried 6 - 0 . It was moved by Councilman Graves , seconded by Councilman Fleetham , to appoint Joshua Schneck to the Planning Commission. The motion carried 6 - 0 . It was moved by Councilman Heltzer , seconded by Councilman Graves , to appoint William Goldstein to the Citizens Advisory Commission . The motion carried 6 - 0 . (c ) AUTHORIZATION FOR ADVERTISEMENT FOR BIDS , IMPROVEMENT NO, 71 - 1q , .-) TREET LIGHTING , 36TH STREET AND AQUILA AVZNUE RAS OLUTION NO, 4343 It was moved by Councilman Fleetharn , seconded by Councilman Thiel , to waive reading and adopt Resolution No . 4343 entitled , " Resolution Approving Plans and Specifications and Ordering Advertisement for Bids , Lrn-, rovement No . 71 - 19 . " The motion carried 6 - 0 . (d ) STUDENT WORK PROGRAM Councilman Thiel moved to employ Erick Simonson for a handicapped student .vo , i, program in the Police Department .
