A regular meeting of theCity Council was called to order by Mayor at 8 : 13 Pam * � INVOCATION J Since no one from the Ministerial Association was present , there was no invocation. 3 . ROLL CALL The following Councilmen were present at roll call : Frank Flee therm Murray Galinson Richard Graves James Heltze r Robert Reynolds Leonard Thiel Frank Howard Also present were the City Managers Assistant City Manager , City Attorney , Planning Director , Director of Public Works , Sanitarian , City Assessor , and Secretary. 4• NUTES On motion of Councilman Thiel , seconded by Councilman Reynolds , the minutes of the regular meeting held August 2 , 1971 and joint meeting with Parks and Recreation Advisory Commission held August 9 , 1971 , were approved by a seven yea vote . � PUBLIC HEARINGS �a ) PROPOSED ASSESSMENT , IMPROVEMENT NO. 66 - 08D , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED JULY 29 , 1971 Mayor Howard opened the hearing * o r . John S . Crouch , 6241 Crescent , attorney for Francis Peterson, bJected to the special assessment on the grounds it was unreasonable i and arbitrary. He also questioned the basis for benefit in the as stated . He explained that Mrs . Peterson had received a letter from ® 231 Council Minutes , August 16 , 1971 ' entng t reresi he City in a condemnation proceeding 5 . ( a ) the attorney p advising her that she had been awarded $702 for on this property ' idewalk and retaining walls were to be damages to her property , that s built , and that she had contemplated this would be done at the expense of the petitioner • ; After discussion concerning t . * s matter , Councilman Fleetham moved t o continue the hearing to August 30 , 1971 , to give Ivir , an opportunity to meet with the City Manager and . ity CrouchPP Attorney with respect to the proposed _ assessment . Councilman Att y Heltzer seconded and the motion carried 7 - 0 . + (b ) PROPOSED ASSESSMENT , IMPROVENLENT NO. 66 - 08E , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED JULY 29 , 1971 Mayor Howard opened the hearingo Mr . John Bix, attorney representing the property owner , stated that he would have no objection to continuing the hearing if the City Attorney felt it necessary . The City Attorney explained that after researching the background of this matter it was his f eeling that the as s e s sment was not valid . There being no one else present wishing to speak , the Mayor declared the hearing closed . It was moved by Councilman Reynolds , seconded by Councilman Galinson , not to adopt the proposed assessment. The motion carried 7 - 0 . After discussion concerning the possible difficulties of staffing more centers , Councilman Heltzer withdrew his motion . RESOLUTION NO. 4301 . REPORTS OF OFFICERS , BOARDS , AND COMMITTEES ( a ) REPORT OF PLANNING COMMISSION ( CASE NO. 71 - 28 - S . Pe ) RECOMMENDING APPROVAL , WITH CONDITIONS , UPON THE REQUEST OF RICHARD NESLUND FOR SPECIAL PERMIT UNDER SECTION 6 : 176 . 4 OF THE ZONING ORDINANCE FOR A RESIDENTIAL DEVELOPMENT UNIT OF 280 APARTMENT UNITS UNDER A PLANNED DEVELOPMENT UNIT ON PROPERTY LOCATED NORTH OF CEDAR LAKE ROAD , EAST OF NATCHEZ , WEST OF THE JEWISH COMMUNITY CENTER Councilman Heltzer asked if any thought had been given to joining with the Village of Golden Valley to purchase the property for park purposes . It was his feeling that this would be the best possible use for this land . Councilman Fleetham said that he had made this motion last year and that at that time Golden Valley did not wish to have a park in this area . He explained that the present request was for 16 units per acre and the density permitted is 25 . 6 units per acre . He also said that the plan had been reviewed numerous times and that the consultant , Midwest Planning , had `b worked with 20 to 30 differented plans . Councilman Thiel stat that the developer could , without a special permit , build 430 units on this property . It was Councilman Galinsont s feeling that to act on this matter at this time would be premature since the plan being presented to Council had been revised since it had been reviewed by the Planning Commission . 236 Council 11riinute s , Augus t i u , 1911 t f 8 � ( a ) Tvir . Richard such Neslund , explained that they :gad been work ' ing c of i two years and of the rnany plans that had been developed n this property over during that time . 1-ie indicated that he hand revised had meet with the St . Louis Park citizens adjacent to that area and that they objected to the access onto Natchez so the plan he presented to Council had eliminated this access , with the only ingress and egress to be 14 , from Cedar Lake Road . This require some other revisions to the plan which moved the swimrniar,, pool , relocated some of the units , and changed the shape of the public park . Mrs . Ingersoll , chairman of the Planning G0 [Y1YriIsslon , said that she was seeing this plan for the first tirne and could not give a recommendation of the Planning Cornrn * sion as a whole . :d , Mr . Jim Windey , 1601 Princeton Avenue , presented a petition which was filed with the secretary . He spoke for the neighborhood indicating that they were not opposed to the project but had much concern for aggravating present traffic problems in this area . He expressed objection to access on Natchez Avenue , but agreed to the modified plan to enter and exit onto Cedar Lake Road . He iE said the residents were much in favor of a park on that property , OR but felt that the City would not be in a position to purchase this )ENTAL property . NORTH Mr . Doug Fruen , 1624 Ottawa Avenue , suggested closing off E Ottawa Avenue and Old Cedar Lake Road and permitting that area to be used as a park . 09 The Director of Public Works gave information relative to average daily traffic counts on Cedar Lake Road , Mrs . Colin Campbell , 4712 Cedar Lake , said he did not seriously object to the plan showing no access onto Natchez Avenue but would like Council to investigate a joint park with Golden Valley and would if there would be such a meeting . like citizens notified Vote on the motion was defeated 2 - 5 , Councilmen Galinson , Graves , Heltzer , Reynolds , and Mayor Howard voting nay . Councilman Fleetham moved that the State Highway Department be requested to erect no right turn signs off Highway 100 onto West 16th Street . Councilman Thiel seconded and the motion carried 7 - 0 . Councilman Fleetham moved that the County be urged to develop curvilinear street to alleviate traffic at Ottawa Avenue . Council - man Thiel seconded and after some discussion the motion carried 6 - 1 , Councilman Galinson voting nay . Councilman Fleetham moved that the City and County cooperate in the design of Cedar Lake Road and Highway 100 to Edgewood Avenue . Councilman Galinson seconded and the motion carried 7 - 0 . It was moved by Councilman Thiel , seconded by Councilman Galinson , that staff contact the Metropolitan Transit Commission as to the possibility of extending the bus line to the J ewish Community Center and return . The motion carried 7 - 0 . It was moved by Councilman Thiel , seconded by Councilman Galinson , to ask the City legal staff to look into proceedings to discover if we can legally get onto Highway 12 as it pe rtains to the Cedar Lake Road bridge matter . Councilman Heltzer moved that the Mayor be directed to establish a joint meeting with the Golden Valley Village Council or Planning Commission .on . The motion carried 6 - 0 . Councilman Galinson left the meeting . (b ) TRAFFIC PROBLEM - WEST 38TH STREET Mr . Clarence Moe , 4305 West 38th Street , was present to express concern on a traffic problem on West 38th Street . The City Manager indicated that this information would be formulated in a couple of weeks . ( e ) STREET WIDTH - 2900 FLOCK , QUENTIN AVENUE Councilman Fleetham explained that the people in the 2900 block of Quentin Avenue had a petition signed by 900 of the residents to maintain the street width at 32 feet , but he understood that this could not be done without removing trees . Councilman Fleetham moved to have sti let as wide as possible without removing trees . Councilman Graves seconded and the motion carried 6 - 0 .
