M . 4 • MINUTES On motion of Councilman .Reynoles ; secondee' by Coimcilman Heltzer , the minutes of the regular meeting June ?, 1 , 1971 , were approved by a five yea vote . 5 ' PUBLIC HEARINGS (a ) PROPOSED ASSESSMENT FOR IMPP, OVEMENT NO. 66 - 17 , CENTRAL STORM SEWER , AS DESCRIBED IN 'NOTICE OF HEARING PUBLISHED JUNE 172 1971 Mayor Howard opened the hea. ringe The Mayor explained the cost and proposed assessment for this project, 191 i Council Minutes , July 6 , 1971 Mr . Herb Finch , Reilley Tar and Chemical. Corporation , presented 5 . (a ) osit on to the assessment of the a letter to Council expressing, oPP project because it did not benefit the property . Mr . L. P . Mason , Chicago Northwestern Railroad , spokes in opposition to the proposed assessment in that their storm water doe not flow into the area being assessed . Miss Anne Herren , 3144 Nevada Avenue , spoke against the amount being assessed against her property because it is not low land , in her opinion. Mr . John Healy , Dayton Rogers , explained that his companywill have not be included in the assessment area because another The Cit Assessor to be constructed before their area can be drained . y said that the assessment was only about one - half the rage afor drama e because of the portion of the property presently being $ by the Highway Department . Mr , Healy said it was his feeling that Dayton Rogers should not be assessed for f uture laterals which are necessary to make the system workable . Mr . Bert Mankoff , 3334 Zarthan Avenue , explained that his area was not being properly drained and felt the assessment was not proper . Mr . Wayne Long , engineering consultant , explained that at the design stage it was decided not to rebuild the old sewer in this area at this time , since it would mean making rather deep cuts between homes because the street did not have sufficient underground remaining for this construction Mrs . Millie Oberg , 5200 Minnetonka Boulevard and Mr . Ken Payne , 3125 Louisiana Avenue , had questions Zoncerning their assessment which were properly answered by the City Assessor and the Mayor • Mrs , Lindgren , 3221 Dakota A -enue , asked how ',he assessment was determined and had the policy explained to her by the City Assessor . Mr . Kayeska , 3157 Webster , said that his retainingwall had been cracked and his driveway slipped during the storm ewer construction• Mr . George Johnson, 3363 Zarthan Avenue , protested the assessment because he had no benefit . Mr . Ray Long , 3219 Blackstone , complained about dust in his area. Y and RESOLUTION NO, 4269 It was moved by Councilman Reynolds to waive reading and adopt Resolution No . 4269 entitled , '- Resolution Adopting Assessment " excluding area of 33rd , 34th Street and Zarthan Avenue , Councilman Thiel seconded , requesting that all questions that were brought to the attention of the Council be brought back within three weeks and all those people being reconsidered for possible abatement be given a 30 - day extension for pre - payment to avoid interest if the Assessor ' s decision prevails . The motion carried 5 - 1 , Councilman Heltzer voting nay . Councilman Heltzer questioned the time schedule for the finishing of the pond at 31st and Oregon . He was told by the consultants that it would be substantially finished in a couple of weeks . Councilman Fleetham requested that the area of 34th and Zarthan be I restudied . (b ) IMPROVEMENT NO, 69 - 25 , PAVING , CURB AND GUTTER , AND SIDEWALK ON NEVADA AVENUE FROM CEDAR LAKE ROAD TO WEST 22ND STREET AND WEST 22ND STREET FROM NEVADA AVENUE 500 FEET WEST TO PROPOSED CUL- DE - SAC , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED JUNE 24 ,AND JULY 1 , 1971 Mayor Howard opened the hearing , The Director of Public Works r ' escribed the proposed project . Mr . Sidney Lorber , representing Bryn Mawr Homes , Inc . , owner Of Westwood Nursing Home , spoke in favor of the proposed improvement . Mr . Bill Rosen , attorney representing Ridgway Claymor , inquired whether the driveway from 22nd Street into their apartment complex would be closed by this project . He was told that it would be left open. There being no one else present wishing to speak , the Mayor declared the hearing closed . RESOLUTION NO ,* 4270 It Was moved by Councilman Thiel , seconded by Councilman Fleetham , 199 Council Minutes , July 6 , 1971 5 . (b ) to waive reading and adopt Resolution No . 4270 entitled , " Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No . 69 - 25 . " The motion carried 6 _ p . 6 . PETITIONS , REQUESTS , AND COMMUNICATIONS ( a ) PETITION FOR PERMANENT ?AVING ZARTHAN AVENUE BETWEEN WEST 26TH STREET AND WEST 27TH STREET (M & C NO. 71 - 25 ) It was moved by Councilman Fleetham , seconded by Councilman Heltzer , to table this matter , The motion carried 6 - 0 . (b ) REQUEST FOR EXTENSION OF AIR POLLUTION DEADLINE - COSOM CORPORATION The Director of Public Health explained that Cosom Corporation had a study made of their problem and that they had received several sources for their solution which required further investigation . Mr . Norris , Director of Engineering of Thermotec , owner of Cosom , was present urging approval of the extension of time . After discussion concerning their various problems , Councilman Thiel moved to extend their compliance date to August 16 , 1971 , with a report back to Council on that date . Councilman Graves seconded and the motion carried 6 - 0 , (c ) COMMUNICATION FROM WESTWOOD NURSING HOME REQUESTING PERMISSION TO CONSTRUCT TEMPORARY SERVICE ROAD Mr . Sidney Lorber explained that if fire lanes are established immediately at Ridgway Claymor and West 22nd Street is improved , there would be no need for this temporary service road . There being no further discussion , the communication was ordered by the Mayor to be received for filing . Mr . Paul pink , architect of the Westwood Nur assured Council that the be sing Home , rm required by the special permit would be constructed before occupancy . 7 .
