minutes of the regular meeting held May 24 , 1971 , were approved by a sever

Mayor Howard opened the hearing .
There being no one present wishing to speak concerning this matter ,
Mayor Howard closed the hearing .
Council ' asked that the City Attorney clarify Section 2 . 04 before the
time of the second reading .
It was moved by Councilman Galinson , seconded by Councilman Graves ,
to waive first reading of proposed ordinance amending Section 2 . 04 of
the Home Rule Charter and set date for second reading June 14 , 1971 .
The motion carried 7 - 0 .
It was moved by Councilman Heltzer , seconded by Councilman Graves ,
to waive first reading of proposed ordinance amending 6 . 07 of the
Home Rule Charter and set date for second reading June 14 , 1971 .
The motion was defeated 5 - 2 , Councilmen Fleetham and Thiel voting
nay. ( Motion to carry requires unanimous vote ) ,

DRUG , RELATIVE TO PAVING , CURB AND GUTTER , AND REPLACING
OF SIDEWALK ON BROOKSIDE AVENUE .
The Director of Public Works described the proposed project as presently
designed . The City Manager indicated that at the public hearing the

were told that there would be no widening of streets in the area .
Councilman Thiel suggested that staff bring in a sketch of this area
showing whether it is feasible to use the boulevard area for parking .

It was moved by Councilman Graves , seconded by Councilman Galinson ,

Representative Petrafeso presented to the Council HF 3160 concerning
a proposed tax on equipment used by federal defense contractors and
asked that the Council pass a resolution favoring this proposal and
hold a public hearing on this matter .
Mrs . Rosalie Goldstein spoke in favor of the proposed legislation.
Councilman Galinson moved that this matter be placed on the June 14th I
agenda for discussion . Councilman Heltzer seconded and the motion
carried 7 - 0 .

Mr , Robert Thornburg , Secretary of Minnesota Petroleum Council , was
present objecting to several subdivisions , but his greatest objection was
to Subdivision 17 . " All existing motor service stations shall conform to
Subdivisions 4 , 7 , 849 8 , 10 , 112 12 , 13 , and 15 on or before July 30 ,
1972 . When a service station is remodeled at a cost estimated to be
fifty ( 50 ) per cent or more of the current market value of the improvements
on the premises , it shall no longer be considered an existing station , and
all of the requirements of this section shall apply. " He asked that the
ordinance be re - referred to the Planning Commission to give him an
opportunity to work with them on some points of the ordinance .

Mr . Allen Christy expressed his objection to Subdivision 17 and also
to that part of the ordinance relating to number of nozzles on pumps .
Councilman Reynolds moved to refer the Ordinance to the Planning Commission
asking that they review Subdivision 17 as well as the entire ordinance .
Councilman Heltzer seconded and the motion carried 7 - 0 .

that member being selected by the President of the League of Women

10 . NEW BUSINESS
(a ) EMPLOYEE APPOINTMENTS
It was moved by Councilman Graves , seconded by Councilman Galinson,
to consent and approve the appointment of Ken Vraa as Recreation Facdiv
Director and Erick Norlin as Building Maintenanceman II. The motion
carried 6 - 0 .
(b ) COMMITTEE FOR POOL OPENING
Councilman Galinson and Councilman Reynolds were appointed by the
Mayor to the pool opening committee , with Councilman Galinson as
chairman .
(c ) BANK DEPOSITORY
Councilman Graves moved that staff investigate the possibility of
Edina State Bank being designated as a depository and prepare the
necessary resolution . Councilman Heltzer seconded and the motion
carried 4 - 2 , Mayor Howard and Councilman Fleetham voting nays
(d ) STREET IMPROVEMENTS - SHELARD PARK
The City Manager explained that the Shelard developers have requested
streets in their project and have sent a letter stating they would
accept 100 % of the assessment , but that the City Attorney indicated
that this is not acceptable and therefore are working on this .
