MINUTES On motion of Councilman Galinson , seconded by Councilman Heltzer , the minutes of the regular meeting held May 24 , 1971 , were approved by a sever yea vote , 5 . Mayor Howard opened the hearing . There being no one present wishing to speak concerning this matter , Mayor Howard closed the hearing . Council ' asked that the City Attorney clarify Section 2 . 04 before the time of the second reading . It was moved by Councilman Galinson , seconded by Councilman Graves , to waive first reading of proposed ordinance amending Section 2 . 04 of the Home Rule Charter and set date for second reading June 14 , 1971 . The motion carried 7 - 0 . It was moved by Councilman Heltzer , seconded by Councilman Graves , to waive first reading of proposed ordinance amending 6 . 07 of the Home Rule Charter and set date for second reading June 14 , 1971 . The motion was defeated 5 - 2 , Councilmen Fleetham and Thiel voting nay. ( Motion to carry requires unanimous vote ) , 6, PETITIONS , REQUESTS , AND COMMUNICATIONS (a ) COMMUNICATION FROM NATHAN H . GOLDSTONE , BROOKSIDE DRUG , RELATIVE TO PAVING , CURB AND GUTTER , AND REPLACING OF SIDEWALK ON BROOKSIDE AVENUE . The Director of Public Works described the proposed project as presently designed . The City Manager indicated that at the public hearing the Coto were told that there would be no widening of streets in the area . Councilman Thiel suggested that staff bring in a sketch of this area showing whether it is feasible to use the boulevard area for parking . (b ) APPLICATION FOR AMENDMENT TO NON - INTOXICATING MALT LIQUOR LICENSE OF THE PIZZA HOUSE It was moved by Councilman Graves , seconded by Councilman Galinson , to set date for public hearing June 21 , 1971 . It The motion carried 7 - 0 . e COMMUNICATION FROM REPRESENTATIVE PETRAFESO CONCERNING COUNCILMANTAX PROPOSAL ( REQUESTED BY COUNCILMAN HELTZER ) Representative Petrafeso presented to the Council HF 3160 concerning a proposed tax on equipment used by federal defense contractors and asked that the Council pass a resolution favoring this proposal and hold a public hearing on this matter . Mrs . Rosalie Goldstein spoke in favor of the proposed legislation. Councilman Galinson moved that this matter be placed on the June 14th I agenda for discussion . Councilman Heltzer seconded and the motion carried 7 - 0 . " All existing motor service stations shall conform to Subdivisions 4 , 7 , 849 8 , 10 , 112 12 , 13 , and 15 on or before July 30 , 1972 . When a service station is remodeled at a cost estimated to be fifty ( 50 ) per cent or more of the current market value of the improvements on the premises , it shall no longer be considered an existing station , and all of the requirements of this section shall apply. " He asked that the ordinance be re - referred to the Planning Commission to give him an opportunity to work with them on some points of the ordinance . Councilman Reynolds moved to refer the Ordinance to the Planning Commission asking that they review Subdivision 17 as well as the entire ordinance .
