LOUIS PARK , MINNESOTA MAY 32 1971 A special meeting of the City Council was called to order b Mayor 7 ; 10 p . m . Y y Howard at The following Councilmen were present ; Robert Reynolds Frank Fleetham Leonard Thiel Frank Howard Councilman Heltzer arrived at 7 ; 50 p . m . Also present were the City Manager , Assistant City Manager , City Attorney , City Clerk , Chief of Police , Police Officers Bullock and Landgren , and Acting Secretary , The City Attorney gave a summation of the situation and explained that the hearing was called as a hearing on revocation or suspension of the on - sale non- intoxicating liquor license of the Park Taveimn , 7201 Minnetonka Boulevard , due to a recent violation of the non - intoxicating liquor license ordinance involving a minor . The Attorney stated that the officers report indicated that Terrance A . Peterson 1 and Kevin R . Kamerud had entered the Park Tavern on the evening of April 19 , 1971 , and that Mr . Peterson purchased a pitcher of beer from a Tavern employee , Mr . Donald J . Baggenstoss . The Attorney further stated that no identification was exhibited by Mr . Peterson nor was an affidavit requested by Mr . Baggenstoss , The Attorney stated that Mr . Peterson , Mr . Kamerud , and Mr . Baggenstoss had then entered pleas of guilty in Hennepin County Municipal Court to charges resulting from this incident and had received fines of $ 25 , $ 25 and $50 respectively . The City Attorney then asked that the documentary evidence be received by the Mayor on behalf of the City Council and declared to be findings of fact . These documents included the Notice of Hearing ; subpoenas with affidavits of service attached ; transcripts of proceedings :) f the Hennepin County Municipal Court of February 22 , 1971 and March 18 , 1971 ; and copies of the proceedings and records Of the St . Louis Park Police Department , Mayor Howard then determined that the Park Tavern was not represented by counsel and asked if the representatives agreed with the facts as presented by the City Attorney . The owner , Mr . Ben Weber , responded that he did . ` The Council questioned Mr . Mel Von Helgate , Park Tavern Manager , who sated that Mr • Kamerud and Mr . Peterson had entered the Tavern from the rear entrance on a busy evening and joined a number of friends at a booth adjacent to the front door . He explained that Mr . Peterson came to the bar with an empty pitcher and explained that the bartender assumed that they had already been checked and therefore provided the beer . Mr . Von Helgate explained that the Tavern employees had been instructed to ask for driver ' s licenses and other proof of identification when in doubt of patron ' s ane . He alsostated that his employees were instructed to ask the patron to execute an affidavit if sufficient proof has not been supplied . i 133 Special C o ty Council. Peterson , age 20 , Who stated that he had not been in the etra beerrn • and that his purpose for entering was together because the felt previously 0ndicated that Mr . Kamerud and their �'71Vtersontfurther stated that when they i it would be easier to be served . Thiel then questioned Mr . Kevin R . ICamerud who indicated agreement with Mr . Peterson ' s account . He also stated that they arrive approximately 11 : 45 p . me and ordered a hamburger in addition to purchasing the pitcher of beer . Mr . Thiel questioned Officer Bullock who indicated that they arrived at the requi Park Tavern for routine check and to inform them of closingthe indicatednts thator the General Hospital bond referendum date . officer B he had checked the Park Tavern about 12 times over the past year and have no indication of prior problems . Councilman Thiel moved that the on - sale non - intoxicating malt liquor license be not suspended or revoked . The motion was seconded by Councilman Fleetham . Councilman Reynolds stated that this action was not in accord with Council policy as there was some negligence and indicated that very close scrutiny would be given to the penalty involved if such an incident ever occurred again . He also indicated that instructions to the employees regarding identification of patrons should be established in writing and renewed verbally on a regular basis .
