CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Howard at 8 : 12 p . m . 2 , INVOCATION There was no invocation since no one from the Ministerial Association had been scheduled for this optional meeting . 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Murray Galinson Richard Graves James Heltze r Leonard Thiel Frank Howard Also present were the City Manager , Assistant City Manager , Planning Director , Director of Public Works , City Assessor , and Secretary. 4 . MINUTES On motion of Councilman Fleetham , seconded by Councilman Heltzer , the minutes of the regular meeting held May 3 , 1971 , were approved by a six yea vote . Councilman Robert Reynolds arrives. at 8 : 55 pm . 5 . PUBLIC HEARINGS La ) IMPROVEMENT NO, 71 - 01 , PAVING , CURB AND GUTTER , SIDEWALK REPAIR , AND MISCELLANEOUS CONTINGENT UTILITIES IN PAVING AREA CONSISTING OF ALL STREETS WITHIN THE CITY LIMITS LYING EAST OF HIGHWAY 100 AND SOUTH OF EXCELSIOR BOULEVARD TO QUENTIN AVENUE AND SOUTH OF WEST 40TH STREE T FROM QUENTIN EASTERLY TO THE CITY LIMITS ; AND WEST 40TH STREET FROM NATCHEZ AVENUE TO JOPPA AVENUE (WHICH WERE NOT INCLUDED IN PROJECT 69 - 02 ) , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED APRIL 29 AND MAY 69 1971 . 135 Council Minutes , May i 0 , 1971 5 ( ) Ya Ma or Howard opened the hearing . . The Director of Public Works explained the proposed project and the changes which were made since the protect was originally proposed . The changes were made according to Council ' s policy to retain streets that have five or more years of wear before major repairs are believed to be required . Mr . H. O. Nelson , 4265 Ottawa Avenue , suggested that only one side of his street between 42 -L and 1vlorningside be paved since the other half had been done after storm sewer was constructed . He was told that this was a temporary mat that would not last . Mr . Nelson also suggested blacktop curb but was told that in this climate it would not stand up . Mr . Edward Lofstrom , 4366 Browndale ; Mr . Lynn Geyer , 4374 Browndale ; and Mr . Ron Poeschel , 4217 Utica Avenue, spoke in opposition to the proposed improvement of their streets . Mr . Robert Arnold , 4065 Toledo Avenue , wanted assurance that all underground utilities are in and that there would be priorities for putting in streets so that the heavy traffic isn ' t routed over the newly paved areas . Mr . Robert Whalton , 4152 Toledo Avenue ; and Mr . Robert Olson, 4200 Toledo Avenue , spoke in favor of the improvement . Mr . Brian Butler , 4028 Wooddale Avenue , asked that traffic not be permitted to use the alley as a thoroughfare during the construction . Mr . Bill Addington , 3937 Kipling Avenue , and Mr . W . Waterbury, 3944 Kipling Avenue , felt that 40th Street between Joppa Avenue and Natchez Avenue should be eliminated from the project . Mr . Richard Groetsch , 4040 Salem Avenue , said his street is a dead end and should be eliminated from the project , with only surface repairs to be made . Mr . Morris Hanson , 4212 Salem Avenuej asked that if the project is ordered to be done the contractor be required to use all safety precautions in storage of his m q e rotection of children in the neighborhood , aterials for th p Mrs . Betty Grehl , 4225 4306 Browndale Ottawa Avenue ; Mr . RESOLUTION NO, 4230 It was moved by Councilman Thiel , seconded by Councilman Reynolds , to 'waive reading and adopt Resolution No . 4230 entitled , " Resolution Ordering Improver. . ent , Ordering Preparation of Plans , 7 and Authorizing Advertisemen-c for Bids , Improvement No . 71 - 01 . " The motion carried 7 - 0 , (b ) IMPROVEMENT NOt 71 - 05 , CONSTRUCT AND INSTALL PAVING , CURB AND GUTTER , SIDEWALK REPAIR AND MISCELLANEOUS CONTINGENT UTILITIES IN THE AREA LYING NORTH OF MINNETONKA BOULEVARD , EAST OF TRUNK HIGHWAY 100 , AND SOUTH OF WEST 26TH STREET ( T . H . 100 TO PRINCETON AVENUE ) AND SOUTH OF WEST 28TH STREET ( PRINCETON AVENUE TO INGLEWOOD AVENUE ) , AND WEST OF INGLEWOOD AVENUE , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED APRIL 29 AND MAY 6 , 1971 . Mayor Howard opened the hearing . The Director of Public Works explained briefly the changes made in the project since the previous public hearing . Mr . Roger Israel , 2822 Salem Avenue ; Mr . G . Held , 2835 Salem Avenue ; Mr . Al Hoglund , 2719 Raleigh Avenue ; Mr . I . B . O ' Connor , 5033 West 28th Street ; and Mr . Steven Lang , 2819 Salem Avenue , spoke in favor of the proposed project . Mr . I , H � Riven , 2637 Raleigh Avenue ; Mrse Pauline Perlman , 5100 West 28th Street ; Mr . Edward Haynes , 2709 Toledo Avenue ; Mr . Arnold Lidfors , 2801 Quentin Avenue ; Mr . Frank Pucci , 2. 837 Quentin Avenue ; Mr . Frank Montroy : 2320 Quentin Avenue ; Mrs . Charlotte Roe , 2817 Quentin Avenue ; Mrso Max Berg , 2640 Quentin Avenue ; Mrs Gordon Stewart , 4600 West 28th Street ; and Mr . Robert Shapiro , 2700 Raleigh Avenue , spoke against the proposed improvement . Mr . Sidney Lorber , 2743 Raleigh Avenue , spoke against portions of the project which he felt were not necessary at this time . Mrs . Josephine Nemerov , 2719 Quentin Avenue , brought to the attention work she felt was inferior that was done in street construc - �� tion 20 years ago . Mr . The Planning Director described the plat and its proposed development, Mr , Otto Schmid , Urban Planning , was present representing the subdivider , Mr . C . Freidheim . Mr . Robert Ehrenberg also represented the developer . There being no one else present wishing to speak concerning this matter , Mayor Howard declared the hearing closed . It was moved by Councilman Thiel , seconded by Councilman Graves , to approve the preliminary plat of Park Center . The motion carried 7 - 0 . 6 . PETITIONS , REQUESTS , AND COMMUNICATIONS None 7 . RESOLUTIONS AND ORDINANCES (a ) FIRST READING OF PROPOSED ORDINANCE AN.LENDING ORDINANCE NO. 781 ADOPTED APRIL 24 , 1961 ENTITLED " AN ORDINANCE PROVIDING FOR THE REMOVAL, OF SNOW , ICE , AND RUBBISH FROM SIDEWALKS , THE ELIMINATION OF WEEDS FROM PUBLIC AND PRIVATE PROPERTY AND THE REPAIR OF SIDEWALKS AIND THE COLLECTION OF THE COSTS OF SUCH WORK WHEN DONE BY THE CITY AS A SPECIAL ASSESSMENT AGAINST PROPERTY BENEFITED " , AND ADDING TWO NEW SECTIONS It was moved by Councilman Galinson , seconded by Councilman Reynolds , to waive first reading of proposed ordinance and set date for second reading May 17 , 1971 • (b ) RESOLUTION AUTHORIZINGPINT COV#6NT AGREEMENT WITH HENNE 138 council Minutes , May 10 , L971 7 . (b ) FOR MAINTENANCE OF TRAFFIC CONTROL SIGNALS RESOLUTION NO. 4232 It was moved by Councilman Heltzer , seconded by Councilman Graves , to waive reading and adopt Resolution No . 4232 entitled " Resolution Authorizing Agreement with Hennepin County for Maintenance of Traffic Control Signals . it The motion carried 7 - 0 . ( c ) RESOLUTION APPROVING PLANS , SPECIFICATIONS AND SPECIAL PROVISIONS , HE NNE PIN COUNTY PROJECT 6840 , COUNTY STATE AID HIGHWAY NO, 18 RESOLUTION NO , 4233 It was moved by Councilman Reynolds , seconded by Councilman Fleetham , to waive reading and adopt Resolution No . 4233 entitled , " Resolution Approving Plans , Specifications and Special Provisions Hennepin County Project 6840 , County State Aid Highway No . 18 . " The motion carried 7 - 0 . Councilman Galinson moved to authorize staff to inform the County that it is the feeling of Council that it is a hazard to the citizens of St . Louis Park for fire and police that they will not allow the City to put a turn in for emergency vehicles so they can get across without going to Wayzata Boulevard or Cedar Lake Road , and that the median strip should be lighted . Councilman Fleetham seconded and the motion carried 7 - 0 . 8 . REPORTS OF OFFICERS , BOARDS , AND COMMITTEES (a ) REPORT OF PLANNING COMMISSION. ( CASE NO. 70 - 76 - S . Pe ) GIVING NO RECOMMENDATION UPON THE REQUEST OF CARL J . AND RICHARD H . REISS FOR A SPECIAL PERMIT UNDER SECTION 6 : 045 . 2 SUBDIVISION 5 OF THE ZONING ORDINANCE TO INSTALL A CANOPY OVER AN EXISTING OUTSIDE STAIRWAY AT THE EN 'T' RANCE TO REISS ' LIQUOR STORE; LOCATED IN AN I - 3 DISTRICT ON LOTS 29 , 30 , 31 , BLOCK 174 , REARRANGEMENT OF ST . LOUIS PARK , ALSO KNOWN AS 6900 WEST LAKE STREET Councilman Reynolds moved to authorize staff to prepare resolution it with conditions . Councilman Graves seconded , granting special perm but after discussion Councilman Reynolds withdrew his motion . After discussion concerning the canopy creating a fire hazard , Councilman Thiel moved to defer the matter for two weeks . (c ) RECOMMENDATION OF PLANNING COMMISSION (CASE NO. 70 - 30 - ST ) RELATIVE TO STUDY OF W OODDALE AVENUE BETWEEN EXCELSIOR BOULEVARD AND WEST 44TH STREET The report was ordered by the Mayor to be received for filing . (e ) ANNUAL FINANCIAL REPORT 1970 Councilman Thiel moved to refer to the Finance and Audits Committee for study and direct publication of a summary as required by Section 6 . 14 of the Charters Councilman Grave seconded and the motion carried 7 - 0a 9 . UNFINISHED BUSI14ESS ( a ) STREET OPENING PERMIT REQUESTED BY MINNEAPOLIS GAS COMPANY ( DEFERRED FROM MAY 3 , 1971 ) Councilman Graves moved to t� _ble . ( a ) Councilman Thiel moved to consent and approve the promotions of James Quinn , John Riordan , Arnold Johnson , and Raymond Boisvert to positions of Fire Technician , and Omar Mc Gary to the position of Fire Chief. (b ) SELECTION OF LAND APPRAISAL FIRM FOR REPUBLIC CREOSOTE PROPERTY Councilman Reynolds moved co authorize City Manager to employ appraisal firm in an amount not to exceed $ 1 , 000 . Councilman Heltzer seconded and the motion carried 7 - 0 . (c ) DISCUSSION OF PAVING - WEST 22ND STREET AND NEVADA AVENUE ( REQUESTED BY MAYOR HOWARD ) Councilman Graves moved that city forces place a skin mat on 22nd Street at Nevada for parking lot for Little League . Councilman Heltzer seconded and the motion carried 7 -- 0 . (d ) REMOVAL OF MEMBER OF CITIZENS ADVISORY COMMITTEE Councilman Reynolds moved to remove Frank Pucci from the Citizens Advisory Committee . Councilman Galinson seconded and the motion was defeated by a 5 - 2 vote , Councilmen Reynolds and Galinson voting yea . ( e ) FLAG AVENUE CUL - DESAC Councilman Galinson that a change order be prepared to cul - de - sac Flag Avenue rather than connect it to Gettysburg . Councilman Reynolds seconded but the motion was withdrawn awaiting a formal report . 11 . MISCELLANEOUS ( a ) COMMUNICATIONS FROM CITY MANAGER 1 . Louisiana Avenue Bridge , Grading , etc . The City Manager requested authorization to advertise for bids . RESOLUTION NO. 4234 It was moved by Councilman Reynolds , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 4234 entitled , " Resolution Approving Plans and Specifications and Ordering Advertisement for Bids , Improvement No . 62 - 27 .
