LOUIS PARK , MINNESOTA April 12 , 1971 The special meeting of the City Council was called to order by Mayor Frank Howard at 5 : 30 p . m . The following Councilmen were present : Frank Fleetham Murray Galinson Richard Graves James Heltzer Robert Reynolds Frank Howard Also present were the City Manager , Assistant City Manager , Director of Finance , Director of Planning and Acting Secretary , Capital Improvements Program Councilman Galinson indicated interest in seeing a continuation of the Capital Improvements Program but stated that a need existed for analyzing requirements for street improvements as he felt present Council policy is too restrictive . Mayor Howard explained that a substantial paving area was adopted several years ago in the first ward area and resulted in a significant cost savings which was subsequently adopted as Council policy . Mayor Howard further indicated that the Council must adhere to the opinions of a professional engineer and that apparently the Council has failed to communicate the need to the public . Councilman Heltzer suggested that the paving improvement be withheld if , in the engineer ' s judgment existing paving would last five years or more , and that curb and gutter should remain unless the engineer is convinced that it would adversely affect the paving . Councilman Reynolds suggested that the City Manager and Engineer make these determinations and work with the Council and that the Council not maice these determinations as a result of Public pressure . Councilman Graves requested that maintenance costs on streets deleted from paving areas be calculated . Mayor Howard suggested that staff also compute eventual replacement costs of streets deleted from paving areas . Councilman Galinson moved the Council recommend to the Charter Coumision Charter change which would allow the Ci a Ch gty to assess costs of street maintenance , without public hearings , to the abutting property owners . The motion was seconded by Councilman Graves and carried by a 64 vote . Councilman Galinson then moved the Council go on record in favor of the Capital Improvements Program for paving , curb and gutter throughout the City where needed for streets or surface drainage purposes with individual streets deleted from paving areas when in need of no replacement or major repairs for four years or less in the professional judgment of the engineer . The motion was seconded by Councilman Graves . Councilman Fleetham indicated objection stating that this policy would degrade project areas . Councilman Heltzer suggested it is very important for the City to keep up on paving , curb and gutter as part of the Capital Improvements Program . i Councilman Reynolds stated he was in favor of doing away with all area hearings and revert to improvements on a block by block basis * Councilman Galinson subsequently withdrew his motion . Councilman Heltzer moved that the Council establish policy for area wide paving projects to state that streets be deleted from the paving program if , in staff ' s judgment , the street can survive five years without major repair . The motion was seconded by Councilman Reynolds with the amendment to reinstate a deleted street if fifty. one (5170) per cent of the residents petition for the improvement . The Director e Public Works explained that major repair meant that blading would be be required for correction of street surface deficiencies . The City Manager asked if the Council was including curb and gutter in the n° on to which Councilman Heltzer responded es . Councilman Reynolds subsequently withdrew his second stating that he opposed allowing retention of rolled curb and gutter . The motion was then seconded by Councilman Fleetham . The City Manager then asked if this would be the last year of the eight dollar per front foot assessment for paving improvement . Mayor Howard responded that it would be . The motion was then carried by a 6 . 0 vote . Mayor Howard then requested that staff investigate the possibility of combining public hearings for storm sewer and street paving improvements . Improvement No . 71 - 04 Councilman Reynolds announced he intended to conduct a meeting with the residents of the paving area on Wednesday at 7 : 30 p . m . at the American Legion Hall and that he requested Council approval to have the Director of Public Works available at that meeting . Councilman Heltzer suggested that the Citizens Advisory Committee should be available at the meeting and assist in communication with the residents . American Legion Letter Mayor Howard explained that he had received a letter from the National Commander of the American Legion requesting endorsement of an American Legion request for release of the Prisoners of War currently held in detention in North Vietnam . It was moved by Councilman Galinson , seconded by Councilman Fleetham that the City Council will authorize communication of its support to the American Legion . The motion was carried by a 6 - 0 vote . 1971 Bond Sale (M . & C . 71 - 15 ) It was moved by Councilman Reynolds , seconded by Councilman Galinson to : 1 . authorize the issuance of $ 2 million dollar special assess - ments bonds and $ 4 million dollars general obligation bonds with 15 year maturities . 2 . engage the firm of Piper , Jaffray and Hopwood Inc . to act as financial consultants in the proposed sale 3 . engage the firm of Howard , LeFevere , Lefler , Hamilton and Pearson to render the approving Iegal bond opinions 4o authorize securing current credit ratings from Moody Is Investor Service Inc , and Standard & Poors Corporation .
