CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Frank Howard at 8 : 08 p . m . 2 . INVOCATION Invocation was given by Rev . Father Cecil Houle of the Holy Family Catholic Church . 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Murray Galins on Richard Graves James Heltzer Leonard Thiel Frank Howard Also present were the City Manager , Assistant City Manager , City Attorney , City Assessor . Planning Director , Director of Public Works , and Secretary , Mr . Warren Pfeiffer of the Chamber of Commerce presented to Council their new St . Louis Park informational brochure . 4 . MINUTES On motion of Councilman Galinson , seconded by Councilman Fleetham , the minutes of the regular and special meetings held March 1 , 1971 and special meeting held March 8 , 1971 , were approved by a six yea vote with the following change : Page 56 , Section 8 ( o ) , third paragraph , change the vote to 5 - 1 , Councilman Fleetham voting nay . 5 . PUBLIC HEARINGS i ( a ) IMPROVEMENT NO, 71 -- 05 , PAVING , CURB AND GUTTER , SIDEWALK REPAIR AND MISCELLANEOUS CONTINGENT UTILITIES IN AREA BOUNDED BY T . Ho 100 , INGLEWOOD AVENUE ., MINNETONKA BOULEVARD AND WEST 26TH STREET , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MARCH 4 AND MARCH 11 , 1971 Mayor Howard opened the hearing . 67 Council Minutes , March 15 , 1971 lained the project , showing the 5 . Pauline Perlman , 5100 West 28th Street ; Al Hovland , 2719 Raleigh Avenue ; Frank Pucci , 2837 Quentin Avenue ; Andrew Weinberger , 5132 Vilest 29th Street ; A . R . Lidfors , 2801 Quentin Avenue ; Diane Pierce , 2837 Ottawa Avenue spoke against the proposed improvement . J . D . Smith , 4913 West 28th Street ; Roger Israel , 2822 Salem Avenue $ and Mr . Braaten , 2847 Quentin Avenue spoke in favor of the project , Mr . Israel indicated that his feeling was that government by petition was not desirable because people often sign petitions without full information. Mr . 'Edward IIaynes , 2709 Toledo , disagreed with Mr . Israel and said he hoped Council would give proper consideration to petitions . Mr . David Rickert , 2830 Ottw va Avenue , asked why Lake Forest did not have curbs . He was told that this is scheduled as part of the Capital Improvements Program , Mrs , Marion Gepner , 5000 West 28th Street , suggested a survey be made to meet the needs and wishes of all people in the area . Carol Blum , 2920 Princeton , asked what is planned for her street* She was told it would be paved at its present width. She felt the street is satisfactory as it is . Staff summarized maintenance costs and gave comparison figures • Stephen Smith , 2840 Princeton , questioned costs of assessment • He was told the cost is $ 8 . 00 per front foot plus any additional assessment there might be for the side streets . 68 Council Minutes , Iviarch i 5 , 19 ',` 1 5 . ( a ) Edward Rouse , 2810 Ottawa Avenue ; firs . Evelyn Rieven , 2636 Raleigh Avenue ; and Manny Katz , 2631 Salem Avenue also questioned assess - ment charges and the policy was further explained by the City Assessor . Mrs . Maurice Gotkin , 2637 Quentin Avenue , said she was still paying for curb and gutter that was put in 4 or 5 years ago . Firs . Toberman , 2809 Ottawa Avenue , asked if there was a ceiling ' on the bid that will be accepted . The Mayor indicated that they could reject all bids if they felt they were too high but that no actual ceiling had been placed . Mr . Don Peterson , 2831 Toledo Avenue , asked about assessment charges for land ownel by the State . He was told they would be assessed for their portion . He also asked if there was a possibility of polling the property owners to see if the majority of them object to or want this project . There being no one else wishing to speak , Mayor Howard declared the hearing closed . After discussion by Council , Councilman Thiel moved to defer action to March 29 , 1971 , Councilman Galinson seconded and the motion carried 5 - 1 , Councilman Graves voting nay . 6 . PETITIONS , REQUESTS , AND COMMUNICATIONS ( a ) COMMUNICATIONS FROM COSOM CORPORATION AND MCCOURTNEY PLASTICS REQUESTING EXTENSION OF TIME FOR COMPLIANCE TO AIR POLLUTION ORDINANCE It was moved by Councilman Galinson , seconded by Councilman Thiel , to extend the time to Ju -ie 15 , 1971 for Cosom Corporation and April 15 , 1971 for McCourL- ney Plastics . The motion carried 6 - 0 . (b ) NOTICE OF INTENT TO CONDUCT BINGO GAME IViARCH 28 , 1971 BY FRANK LUNDBERG AMERICAN LEGION POST , 5707 EXCELSIOR BOULEVARD Mayor Howard ordered the notice to be received for filing . 7 . The motion carried 6 - 0 . (b ) REPORT OF FIRE LANE STUDY - AREA OF JE WISH CO1vjMUNITY CENTER RESOLUTION NO , 4179 It was moved by Councilman Galinson , seconded by Councilman Thiel , to waive reading and adopt Resolution No . 4179 entitled , " Resolution Authorizing Placement of Traffic Control Signs Establishing Fire Lanes . ( Hearing was set for April 19 , 1971 . ) ( d ) REPORT OF CITY MANAGER (M & C NO. 71 - 13 ) RELATIVE TO REQUEST FOR PEDESTRIAN BRIDGE , HIGHWAY NO . 100 AT WEST 26TH STREET Mr . and Mrs . Nathan Gottesman , who had expressed an interest in this matter , were present at the meeting . It was suggested by Councilman Galinson that they meet with staff to discover what kinds of information the State requires in order for them to consider this project . Councilman Galinson also suggested that if the bridge is constructed it should have ramps rather than steps to accommodate bicycle traffic . ( e ) CONSULTANT ' S REPORT WITH RESPECT TO LOUISIANA AVENUE EXTENSION - WEST 32ND STREET TO OXFORD It was moved by Councilman Heltzer , seconded by Councilman Graves , to defer this matter to March 16 , 1971 at a special meeting to be held at 5 : 00 p . m ,, The motion carried 6 - 0 . (f ) PRELIMINARY REPORT OF DIRECTOR OF PUBLIC WORKS AND ASSESSMENT REPORT WITH RESPECT TO IMPROVEMENT NO. 62 - 27 , STREET PAVING , LOUISIANA AVENUE FROM EXCELSIOR BOULEVARD TO OXFORD STREET Resolution No . 4168 , adopted March 1 , 1971 , set date for hearing March 29 , 1971 so no action was necessary at this meeting . (j ) REPORT OF CITY MANAGER CONCERNING LEASING OF RAILROAD PROPERTY ADJACENT TO ALABAMA PARK It was moved by Councilman Thiel , seconded by Councilman Graves , to authorize execution of the lease . The motion carried 6 - 0 . It was suggested that a longer term lease or acquisition be investigated. Councilman Graves seconded and the motion carried 6 - 0 . Councilman Heltzer moved to retain for utilities and pedestrian use and that a road not be constructed . He was informed that he is in violation of the zoning ordinance and wanted to know what recourse he could take . He was told to confer with the Planning Director as to the feasibility of a rezoning . The motion carried 6 - 0 . 12 , CLAIMS , APPROPRIATIONS , AND CONTRACT PAYMENTS ( a ) VERIFIED CLAIMS On motion of Councilman Graves , seconded by Councilman Heltzer , the lists of verified claims prepared by the Director of FinanCe and presented to the Council dated March 15 , 1971 in the total amounts of $ 3 , 021 . 17 for payroll , and $ 158 , 146 . 98 for vendors were approved , and the City Manager , City Clerk , and City Treasurer were authorized to issue checks covering same by a six yea vote . 74 Council Ivieeting , March 15 , 1971 12 .
