CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Howard at 8 : 23 p . m . Z . INVOCATION Invocation was given by Rev . Paul Obenauf of the Wooddale Lutheran Church . 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fl e e tham Richard Graves James Heltzer Theodore Rudy Leonard Thiel Frank Howard i Also present were the City Manager , Assistant City Manager , City Attorney , City Clerk , Planning Director , City Assessor , Director of Public Works , Police Chief , and Secretary . Councilman Galinson arrived at 8 : 55 p . m . 4 . MINUTES On motion of Councilman Heltzer , seconded by Councilman Thiel , the minutes of the regular meeting held November 15 , 1971 , were approved by a six yea vote . 5 . PUBLIC HEARINGS ( a ) APPLICATION FOR VARIANCE { CASE NO. 7142 - VAR ) FROM THE REQUIREMENTS OF SECTION 6 : 064 . 5 OF THE ZONING ORDINANCE M AT 1800 MELROSE AVENUE - BY WILLIAM CORBIN Mayor Howard opened the hearing * to speak , the Mayor declared There being no one present wishi• n g the hearing closed . Louis Park Zoning Ordinance . 11 The motion carried ( Councilman 6 - 0 . Galinson was not present ) . (b ) APPLICATION OF ST . LOUIS PARK ANCHOR INN , INC . FOR TRANSFER OF STOCK FROM GEORGE FAUST ' S ' Mayor Howard opened the hearing . There being no one present wishing to speak , the Mayor declared the hearing closed . It was moved by Councilman Heltzer , seconded by Councilman Thiel , to approve the transfer of stock . The motion carried 5 - 0 . ( Councilman Galinson was not present and Councilman Graves was out of the chambers ) * ( c ) APPLICATION OF ROYAL COURT FOR TRANSFER OF STOCK The application was withdrawn ; therefore , no hearing was held . bj PETITIONS , REQUESTS , AND COMMUNICATIONS ( a ) PETITION PRESENTED BY ALFRED RELPH , 1617 BLACKSTONE , RELATIVE TO NEIGHBORHOOD POSITION WITH RESPECT TO I - 394 ( Discussed along with Items 6 (c ) and ( d ) ) . (b ) PETITION PRESENTED BY ALFRED RELPH , 1617 BLACKSTONE AVENUE , REQUESTING SIDEWALKS ALONG CEDAR LAKE ROAD FROM ZARTHAN AVENUE TC GFORGIA AVENUE A. l Mr . Alfred Relph presented petition from people in the area requesting sidewalk cons tructior_. He explained that the school children were being tem-porarily bussed to Eliot School because of the danger to pedestrians caused by traffic . He requested that , the entire neighborhood be assessed for this sidewalk . After discussion concerning the legality of area assessment or assessing it to the school district , Councilman Galinson asked that these methods of assessment be investigated with a report brought to Council December 20 , if possible, and that the School Administration be asked not to remove bus :; ing until a permanent solution is resolved . Willow .Lane , and I�.i 2112 Parklands , urged Council : o take a stand o � r ' Howard George , and presented a resolution urging the Highway pl osing I - 394 Freeway their present alternatives . g Y Department to abandon They indicated that the problem is an area wide mass transit problem . Mrs . Arthur Ingersoll of the Citizens Advisory Committee o � presented a resolution urging the Highway ' Department to permit the Metropolitan Council to assume the position of primary res onsibilit for planning and direction of I - 394 , p y Mr . Alfred Relph , 1617 Blackstone , asked Council not to take a stand on I - 394 until all facts have been gathered and the Metropolitan Transit Commission makes their studies . RESOLUTION NO, 4397 It was moved by Councilman Heltzer , seconded by Councilman Graves , to waive reading and adopt Resolution No . 4397 entitled , "A Resolution Urging the State Highway Department to Abandon the Pending I - 394 Project and Seek Alternative Solutions to the Transporta - tion Problems of the Western Suburbs , " omitting the words in the last paragraph : "for the sake of any business or residential develop - ments in the western area . " Councilman Fleetham moved to defer the matter to December 20 , 1971 , Councilman Thiel seconded and the motion failed 3 - 4 , Councilmen Galinson , Graves , Heltzer , and Mayor Howard voting nay . The motion to adopt the resolution carried 4 - 3 , C -) uncilmen Fleetham , R . .dy , and Thiel voting nay. 7 . RESOLUTIONS AND ORDINANCES (a ) SECOND READING OF PROPOSED ORDINANCE AMENDING THE ST . LOUIS PARK ORDINANCE CODE RELATING TO THE SALE OF i INTOXICATING LIQUOR BY ADDING SECTION 2 : 1314 ENTITLED " LICENSING OF EMPLOYEES " , It was moved by Councilman Heltzer , seconded by Councilman Rudy , to reject the proposed ordinance . Louis Park to Protect the Public Health , Safety and Welfare by Establishing Minimum Standards Governing Basic Equipment and Facilities , Physical Condition , Maintenance , Occupancy and Use of Such Dwellings , Premises and Structures : Providing for Administration , Enforce - ment and Penalties for Violation Thereof , and Repealing Ordinance No . 1052 ' By Adding a New Section Numbered and Titled as Follows : " . effective date being July 1 ! 1972 . The motion carried 7 - 0 . Jim Windey , representing the Cedarhurst Neighborhood Association , urged Council to construct an ice arena at Cedarhurst Park . UNFINISHED BUSINESS ' ( a ) REPORT RELATIVE TO T - ALLEY , XENWOOD / YOSEMITE AND LAKE / 33RD ( DEFERRED FROM NOVEMBER 1 , 1971 ) Mr . Alvin Rogella , 5725 West Lake Street , was present urging a reply to his request for reconsideration of his assessment and additional construction in the alley ( Imp . No . 70 - 51 ) . 362 Council Minutes , November 29 , 1971 9 , (a ) The City Attorney explained that the basis for the assessment had been set according to fundamental law and that any action to change the assessment or expand the improvement would require notice to all property owners . No action was taken on this matter . (b ) REDUCTION OF BOND - ,SHE :- ARD PARK RESOLUTION NO , 4402 It was moved by Councilman Fleetham , seconded by Councilman Thiel , to waive reading and adopt Resolution No . 4402 entitled , " Resolution Accepting Partial Completion of Work and Authorizing Cash Bond for Remainder Shelard Park . (c ) RESOLUTION AUTHORIZING PLACEMENT OF SIGNS PROHIBITING THROUGH TRAFFIC ON WEST 38TH STREET RESOLUTION NO , 4403 It was moved by Councilman Thiel , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 4403 entitled , " Resolution Authorizing Placement of Signs Prohibiting Through Truck Traffic on West 38th Street .
