Ralph Erickson of the Prince of Peace Lutheran Church . 3 , ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Murray Galinson Richard Graves James Heltzer Theodore Rudy Leonard Thiel Frank Howard Also present were the City Manager , City Attorney , Planning Director , Director of Public Works , and Acting Secretary. 4, MINUTES On motion of Councilman Galinson , seconded by Councilman Rudy , the minutes of the regular meeting held October 4 , 1971 , were approved by a seven yea vote . 5 , PUBLIC HEARINGS ( None ) 6• PETITIONS , REQUESTS , AND COMMUNICATIONS (a EQUt. ST OF DONALD STR ICKLAND TO ADDRESS COUNCIL CONCERNING TRAFFIC CONTROL BOX - 36TH STREET AND A.QUILA AVENUE ( REQUESTED BY MAYOR HOWARD ) Mr . (a ) Councilman H eltz I moved that the box be relocated on the south side r of the shrubs and authorize execution of a change order with C . S . McCrossan . The motion was seconded by Counclman Galinson and i carried 7 - 0 . (b ) REQUEST OF CITIZENS STATE BANK FOR COUNCIL CONSIDERATION NO. 71 - 57 - S . P . ) FOR SPECIAL PERMIT UNDER PROVISIONS OF ( CASE r SECTION 6 : 122 . 11 OF THE ZONING ORDINANCE REQUESTING ADDITIONAL DRIVE - IN FACILITIES ( ON PLANNING COMMISSION AGENDA OCTOBER 6 , 1971 - NO QUORUM ) The Planning Director explained the requested drive - in teller facility. He indicated that the request was for a two - year period when a new bank will be constructed across the street . RESOLUTION NO. 4377 . It was moved by Councilman Thiel , seconded by Councilman Rudy , to waive reading and adopt Resolution No . 4377 entitled , Resolution Granting Permit Under Section 6 : 122 . 11 of the St . Louis Park Zoning Ordinance for Additional Drive - In Teller Facility. 11 Councilman Galinson moved to amend to provide that the permit be approved for a period ending June 15 , 1973 . Councilman Thiel accepted the amendment as part of his original motion which carried 7 - 0 . (c ) REQUEST OF SENATOR WOLFE TO ADDRESS CC UNCIL Senator Wolfe presented Council with the most recent distribution formula of the tax bill presently being considered * He expressed utmost concern for the suburbs ' treatment in the bill as it appears to be written at this time . Mr . Dean Lund , Executive Chairman of the League of Minnesota Municipalities , further explained the proposed legislation. He indicated that the sururbs are being treated differently than anyone in the whole state . Representative Julian Hook spoke in opposition to the bill indicating that from St . Louis Park ' s point of view it is a regression. Councilman Fleetham moved that Council go on record opposed to the aid formula as proposed . Councilman Thiel seconded and the motion carried 6 - 1 ' Councilman Galinson voting nay . 7 . The motion carried 7 - 0 , ding November 1 , 1 (b ) SECOND READING OF PROPOSED ORDINANCE ADOPTING THE BUDGET FOR THE FISCAL YEAR 1972 AND AMENDING THE 1971 BUDGET AS ADOPTED BY ORDINANCE 1124 AND AN-LENDED BY ORDINANCE 11369 11389 11431 1150 AND 1151 ORDINANCE NO, 1168 It was moved by Councilman Thiel , seconded by Councilman Galinson , to waive second reading and adopt Ordinance No . 1168 entitled , " An Ordinance Adopting the Budget for the Fiscal Year 1972 and Amending the 1971 Budget as Adopted by Ordinance 1124 and Amended by Ordinance 1136 . 1138 , 1143 , 1150 and 1151 . " The motion carried 7 - 0 . (c ) SECOND READING OF PROPOSED ORDINANCE AMENDING THE ST . LOUIS PARK ORDINANCE CODE SECTION 1 : 752 ENTITLED " SEWER RENTAL RATES " AS HE, AMENDED BY ORDINANCE NO, 675 ADOPTED FEBRUARY 9 , 1959 , AND FURTHER AMENDED BY ORDINANCE NO. 966 ADOPTED MARCH 6 , 1966s ORDINANCE NO, 1029 ADOPTED APRIL 29 , 1968 , AND ORDINANCE NO, 1123 ADOPTED SEPTEMBER 21 , 1970 ORDINANCE NO. 1169 It was moved by Councilman Thiel , seconded by Councilman Heltzer , to waive second reading and adopt Ordinance No . 1169 entitled , "An Ordinance Amending the St . " The motion carried 7 - 0 . Councilman Heltzer said he felt volunteers should have same life insurance as regular firemen . The Mayor indicated that he felt equalization is not possible due to the personal jobs of volunteers . It was suggested that the matter be referred to the Council Insurance Committee with respect to equalizing insurance of regular and volunteer firemen and police , and that the insurance program of Edina and Bloomington be investigated . (f ) RESOLUTION OF SYMPATHY AND CONDOLENCE - ROBERT MCELIVIURRY RESOLUTION NO. 4380 It was moved by Councilman Thiel , seconded by Councilman Rudy , to waive reading and adopt Resolution No . 4380 entitled , " Resolution of Sympathy and Condolence . " The motion carried 7 - 0 . 8 . REPORTS OF OFFICERS , BOARDS , AND COMMITTEES (a ) REPORT OF TRAFFIC STUDY ( NO. 23 ) - RESIDENTIAL NEIGHBOR - HOOD NORTH OF MINNETONKA BOULEVARD AND BOUNDED BY BRUNSWICK AVENUE ON THE EAST AND LOUISIANA AVENUE ON THE WEST It was moved by Councilman Fleetha n , seconded by Councilman Heltzer , to authorize staff to prepare necessary resolution as recommended by the Engineer , adding a 4 - way stop at Dakota Avenue and West 28th Street . The motion carried 7 - 0 . (b ) REPORT OF TRAFFIC STUDY ( NO. 24 ) - INTERSECTION OF 29TH STREET AND MARYLAND AVENUE RESOLUTION NO , 4381 It was moved by Councilman Heltzer , seconded by Councilman Graves , 324 mutes : October 38 , 1971 9 (b ) to waive reading and adopt Resolution No . 4381 entitled , " Resolution Authorizing Placement of Stop Signs for Traffic Control at Intersection of Maryland Avenue and West 29th Street . It The motion carried 7 - 0 . (C ) REPORT OF TRAFFIC STUDY ( N0. 25 ) - INTERSECTION OF WEST 18TH STREET AND PENNSYLVANIA AVENUE ( REQUESTED BY COUNCILMAN GA LINSON ) Councilman Galinson moved to authorize staff to prepare necessary resolution for installation of stop signs on Pennsylvania Avenue at 18th Street for north and south bound traffic . Councilman Graves ' seconded and the motion carried 5 - 2 , Councilmen Thiel and Fleetham voting nay. It was moved by Councilman Thiel , seconded by Councilman Heltzer , that there be no more traffic studies . The motion failed 3 - 4 , Councilmen Rudy , Galinson , Fleetham , and Mayor Howard voting nay. (d ) MINUTES OF PARKS AND RECREATION ADVISORY COMMISSION MEETING HELD OCTOBER 13 , 1971 It was moved by Councilman Heltzer , seconded by Councilman Rudy, to authorize six tennis courts adjacent to the Ice Arena / Pool complex to be accomplished by a change order to the present contract in amount of approximately $38 , 300 with $300 for soil borings . The motion carried 7 - 0 , 9. UNFINISHED BUSINESS (a ) APPOINTMENTS TO ENVIRONMENTAL IMPROVEMENT COMMISSION It was moved by Councilman Galinson, seconded by Councilman Rudy , to appoint Nancy Stout , Mrs . B . Otto , Mrs , Theona Von Lorenz , Howard Segal , David Cross , Joseph Ge -.lman , Warren Leininger , Mrs . Mattie Peterson and Mike Stutzer . The motion carried 4 - 3 , Mayor Howard , Councilmen Thiel and Fleetham voting nay. There was disagreement over exclusion of Lawrence Kelley instead of a student. (c ) REPORTS OF STREETS AND HIGHWAYS SUBCOMMITTEE WITH RESPECT TO TRAFFIC PROBLEM ON WEST 38TH STREET ( REQUESTED BY COUNCIL SEPTEMBER 27 , 1971 ) The Mayor read the conclusions contained in the report of the sub - 1 committee of the Planning Commission . Mr . Seymour Getzug , 3801 Kipling Avenue ; Mr . Clarence Moe , 4305 West 38th Street ; and Mrs . Robert Abrahams , 3817 Kipling Avenue , expressed concern for the traffic on 38th Street and requested immediate action by Council to alleviate the problem . It was moved by Councilman Graves , seconded by Councilman Heltzer , to move the cul - de - sac at 38th and Lynn to 38th and Excelsior Boulevard and implement the remainder of the suggestions contained in Mr . Getzug ' s proposal . The motion failed 3 - 4 , Councilmen Rudy, Fleetham , Thiel , and Mayor Howard voting nay . After further discussion concerning the various proposals to alleviate the problem , Councilman Galinson moved to defer to November 8 , 1971 when a public hearing would be held with the entire study area included in notices to be sent . Councilman Fleetham seconded and the motion carried 7 - 0 . (d ) ASSESSMENT - IMPROVEN& ENT NO, 69 - 17 The City Assessor recommended that there be no assessment for side streets to owners of interior lots . It was moved by Councilman Graves , seconded by Councilman Galinson , to accept the Assessor ' s recommendation and that the assessment roll be amended accordingly . The motion carried 7 - 0 • 10 . NEW BUSINESS ( a ) TABULATION OF BIDS - BACKSTOPS AND FENCING ' It was moved by Councilman Graves , seconded by Councilman Galinson , to accept Crown Iron Works as the lowest responsible bidder in the amount of $ 3 , 705 . 00 . The motion carried 6 - 0 . ( Councilman Thiel left the meeting at 12 ; 20 a . m . ) (b ) APPOINTMENT TO SEWER SERVICE AREA NUMBER ONE ADVISORY BOARD 326 6o ci1 N&nutes , October 18 , 1971 100 (b ) It was moved by Councilman Graves , seconded by Councilman Galinson , that the City Manager be authorized to appoint a staff member to the advisory board . The motion carried 6 - 00 (Councilman Thiel was not present ) . (c ) RELOCATION OF OFFICES OF SUBURBAN HENNEPIN COUNTY NURSES ASSOCIATION ( REQUESTED BY COUNCILMAN FL EETHAM ) It was moved by Councilman Craves , seconded by Councilman Fleetham , that Council has no objection to relocation of offices . The motion carried 6 - 0 . ( Councilman Thiel was not present ) . J (d ) SALE OF CITY GARAGE; It was moved by Councilman Graves , seconded by Councilman Heltzer , to authorize City Manager to negotiate for sale of old city garage facility . The motion carried 6 - 0. ( Councilman Thiel was not present ) . (e ) AUTHORIZATION OF AD FOR BIDS - RADIO ALERT SYSTEM It was moved by Councilman Graves , seconded by Councilman Galinson , to authorize advertisement for bids . The motion carried 6 - 0 . ( Councilman Thiel was not present ) . (f ) BINGO - FIREMEN ' S BENEFIT It was moved by Councilman Graves , seconded by Councilman Galinson , that a bingo permit be granted for the Firemen 's Benefit Committee , Freidheim Office Building , for either November 14 or November 21 , 1971 . The motion carried 7 0 . (g ) REPORT OF I - 394 COMMITTEE REPRESENTATIVES Mrs . Arthur Ingersoll gave a report on the meeting of the Highway Department Advisory Committee and discussed the d he would arrange a meeting with concept.
