1 . CALL TO ORDER
A regular meeting of the City Council was called to order by Mayor
howard at 8 : 05 p . m .
2. INVOCATION
The invocation was given by Reverend Quentin Alfors of the Evangelical
Free Church .
3 , ROLL CALL
The following Councilmen were present at roll call :

Also present were the Acting City Manager , City Attorney , City Assessor ,
Planning Director , Director of Public Viorks , Director of Parks and
Recreation, Finance Director , and Secretary.
4. MINUTES
On motion of Councilman Graves , seconded by Councilman Fleetham ,
the minutes of the regular meeting held September 8 , 1970 and special
meetings held September 12 and September 15 , 1970 , were approved by
a seven yea vote amended as follows : Page 191 - " . . motion was seconded
by Councilman Thiel and failed by a 3 - 3 vote , Councilmen Heltzer , Thiel

Citizens State Bank , spoke concerning the assessment . They

Councilman Reynolds moved to extend the payment period n carried

( 2 ) Improvement No . 66 - 50 , Paving Curb and Gutter , Natchez Avenue
from West 26th Street 225 feet south
There was no one present to speak on this assessment .
( 3 ) Improvement No . 67 - 31 , Grading , Salem Avenue from West
28th Street to �q est 29th Street
Iver , Andrew Weinberger , 5132 West 29th Street , said that
extra lot he owns is not buildable and should not be assessed
the full amount . It was explained to him that the assessment
had been pro - rated .
Councilman Fleetham moved to amend the resolution to except
Mr . Weinberger ' s assessment . Councilman Reynolds seconded
but after further consideration withdrew his second .
(4 ) Improvement No . 69 - 18 , Paving , Curb and Gutter , West 38th
Street from France Avenut to Excelsior Boulevard
Mr . Stanley Mrozek , 3754 Inglewood Avenue , explained that last
year he had paid $ 605 in assessments and had $ 1 , 548 for this
year . His sidewalk assessment was $448 . 52 . He did not want
and felt he had no need for the sidewalk .
Councilman Reynolds moved to defer the sidewalk portion of
the assessment on this improvement to October 5 , 19709 CoU"cil
man Galinson seconded . The motion carried 7 - 0 .

(4 ) Mr . Clarence Moe , 4305 West 38th Street ; Mr . 11obert
Sandberg , 3750 Inglewood Avenue ; and Mr . Don Bolke ,
3755 Inglewood Avenue expressed concern about heavy
traffic on this street and asked for this to be alleviated .
( 5 ) Improvement No . 69 - 36 , Paving Curb and Gutter , Virginia
Avenue from West 32nd Street to 550 feet south
There was no one present to speak concerning this assessment .
Mayor Howard declared the hearings closed .
RESOLUTION NO. 4037
It was moved by Councilman Galinson , seconded by Councilman
Fleetham , to waive reading and adopt resolution , as amended ,
entitled " Resolution Adopting Assessment . " The motion carried

(b ) IMPROVEMENT NOS , 70 - 24 AND 70 - 24A , PROPOSED GRADING ,
PAVING , CURB AND GUTTER ON FLAG AVENUE; , AS DESCRIBED
IN NOTICE OF HEARING PUBLISHED SEPTEMBER 3 AND
' SEPTEMBER 10 , 1970
Mayor Howard opened the hearing .
Mr . Earl Isensee , 4617 Golf Terrace , opposed the design of the
Flag Avenue extension. It was explained to him that this particular
design was necessary because of the interchange at that location.
Mr . George McDonald , 3306 Decatur Lane , explained that it was
his understanding that his street was permanently constructed by
the developer .
Mr . Tom Murphy , 3325 Decatur Lane , felt that there should be
access for County Road 18 before this extension is constructed .
Mr . Sherman Friedman , 3219 Aquila Lane , felt that this was the
ultimate solution to the traffic problem in the area . Iver . John
Causman , 9024 West 34th Street , agreed that this access is necessary.

Heltzer seconded . After further discussion , Councilman Galinson
withdrew and moved that the assessor ' s report be on agenda
October 19 as to preliminary limitation of the assessment area .
Councilman Fleetham seconded and the motion carried 7 - 0 .

It was moved by Councilman Galinson , seconded by Councilman
Heltzer , to waive reading and adopt Resolution No . 4038A entitled ,
" Resolution Approving Plans and Specifications and Authorizing
Advertisement for Bids , Improvement Nos . 70 - 24 and 70 - 24A . "
The motion carried 7 - 0 .

Mayor Howard opened the hearing .

There being no one else present wishing to speak on this matter ,
Mayor Howard closed the hearing ,
It was moved by Councilman Heltzer , seconded by Councilman
Thiel , to approve issuance of license transferring stock . The motion
carried 7 - 0 .
Councilman Heltzer moved to approve removal of restrictions of
the license . Councilman Thiel seconded and the motion carried 7 - 0 •

Mayor Howard opened the hearing .

BUDGET AND AMENDING THE 1970 BUDGET
Councilman Galinson moved that two attend the Atlanta Conference .
After discussion Councilman Galinson amended to one . The motion
was seconded by Councilman Thiel but later withdrawn by Councilman
Galinson .
Councilman Galinson moved that $ 300 be appropriated to send two to
Flint , IvAchigan to study the Lighted School Program . Councilman
Thiel seconded the motion. Councilman Fleetham moved to amend
the motion to include one - half the expenses for three citizens in
addition to the two Councilmen , making the total transfer $ 825 from
Emergency Appropriation Acct , No . 101 - 4970 - 4975 to Account No *
101 - 4010 - 1322 , Councilman Heltzer seconded . The vote on the
amendment carried 6 - i , Councilman Galinson voting nay . The
vote on the original motion carried 7 - 0 .
Councilman Reynolds moved that two members be sent to the
Atlanta Conference . Councilman Fleetham seconded but the motion
failed 5 - 2 , Councilmen Galinson and Heltzer voting nay ( requires
six votes to pass ) .

fencing the ponds .
Councilman Galinson moved that staff be directed to possible to pora diatel

fencing (snow fence ) about both ponds as soon as y
make whatever efforts necessary to obtain such fencing and set for first
meeting in March the question of permanent fencing of the ponds .
Councilman Graves seconded the motion . Councilman Galinson also
suggested that staff meet with Mr . Perry when they are about to put
up this temporary fencing and determine whether it will be possible
to put the fencing in only certain areas . Councilman Galinson changed
his motion to the first meeting in November . The second agreed with F
this change and the motion carried 6 - 1 , Councilman Fleetham voting
nay .
Councilman Galinson moved that $ 1 , 200 be transferred from Emergency
Appropriation , Account No . 101 - 4970 - 4975 , to .Account No . 101 . 4970 -
1650 , for erection of temporary fencing . The motion carried 6 1 :

Councilman Galinson moved to designate Lehn Electric as the lowest
responsible bidder and accept bid in the amount of $ 249 475 . Council -

Councilman Galinson moved that Rice Laboratories be employed
to do the water sampling in an amount not to exceed $ 2 , 090 . Council -
man Reynolds seconded and the motion carried 6 - 0 ( Councilman
Heltzer was not present ) .
(c ) REPRESENTATIVES TO HENNEPIN COUNTY LEAGUE:
Councilman Thiel and Mayor Howard ( alternate ) agreed to continue
to represent the City,
(d ) RAILROAD CONDEMNATION
Councilman Reynolds moved to accept award on Parcels 3 and 6 in
amount of $ 32 , 600 . Councilman Graves seconded and the motion
carried 6 - 0 ( Councilman Heltzer was not present ) .
( e ) REPUBLIC CREOSOTE
Councilman Galinson moveel that nothing be communicated to
Reilly Tar and Chemical C (%.".npany or their agents or representatives
without authority of the City Attorney . Councilman Thiel seconded
and the motion carried 6 - 0 ( Councilman Heltzer was not present ) .
12 . CLAIMS , APPROPRIATIONS , AND CONTRACT PA YMENTS
(a ) VERIFIED CLAIMS
On motion of Councilman Graves , seconded by Councilman Rey Olds
the lists of verified claims prepared by the Director of FinanCe
and presented to the Council dated September 21 , 1970 in the
total amounts of $ 7 , 245 . 42 for payroll , and $ 297 , 023 . 87 for
vendors were approved , and the City Manager , City Clerk , and
City Treasurer were authorized to issue checks covering she
by a six yea vote ( Councilman Heltzer was not present ) .

On motion of Councilman Fleetham , seconded by Councilman
Galinson , the above payments on contract work presented by
the City Engineer were approved , and the City Manager , City

their respective amounts by a six yea vote .
3 . Final Payment , cleaning and painting of Elevated Tower No . 3 ,
General Coatings , Inc . - $3 , 150 . 00 .
RESOLUTION NO. 4049
It was moved by Councilman Fleetham , seconded by Councilman
Galinson, to waive reading and adopt Resolution No . 4049 entitled ,
" Resolution Accepting Work on Cleaning and Painting of Elevated
Tower No . 3 . " The motion carried 6 - 0 ( Councilman Heltzer
was not present ) .
