INVOCATION There being no one present from the Ministerial Association , no invocation was given. 3 , ROLL CALL following Councilmen were Present at roll call : The o g Frank Fleetham Murray Galinson Richard Graves Leonard Thiel Frank Howard Also present were the City Manager , Assistant City Manager . City ' Assessor , Director of Finance , Director of Public Wor st Attorney , City Planning Director , and Secretary . Councilman Heltzer arrived at 8 : 12 p . m . 4 . ( a ) MINUTES motion of Councilman Graves , seconded by Councilman Fleethamt On 1970 were the minutes of the regular meeting held August 3 , bens PP Y approved b a five yea vote . (Councilman Thiel was out of the chain (b } FLAG PRESENTATION Commander Bloomer and the Color Guard of the Veterans of refiring Foreign Wars presented new flag for the Council Chambers , the old colors . 5 . PUBLIC HEARINGS ' a PROPOSED REZONING OF PROPERTY NORTH OF WEST 26T14 STREET ON HAMPSHIRE AVENUE EXTENDED FROM R Zv SINGLE FAMILY RESIDENCE DISTRICT TO R - 3 , TWO � IVIILY RESIDENCE DISTRICT , AS DESCRIBED IN NOTICE OF PUBLISHED AUGUST 6 , 1970 ( CASE NO . 6 8Z. - 3 ? - . ) RFQUE5Tf; D 163 Council Minutes , August 17 , 1970 5 . (a ) BY GORCO CONSTRUCTION COMPANY Mayor Howard opened the hearing . Mr . Sheldon Coplin , Gorco Construction Company , urged that the City either rezone the property or acquire it for park purposes . He also indicated that if the property were rezoned he would take immediate steps to Tlat and develop the property . Councilman Heltzer spoke in favor of acquiring the property for open space and park purposes . There being no one else present interested in this matter , Mayor Howard declared the hearing closed . It was moved by Councilman Thiel , seconded by Councilman Fleetham , to waive first reading of proposed ordinance rezoning the property and set date for second reading September 21 , 1970 . The vote on the motion failed 3 - 3 , Councilmen Heltzer , Galinson and Graves voting nay . Councilman Heltzer moved that staff be directed to negotiate to discover if the City can obtain an agreeable price for this property . Councilman Graves seconded . After discussion the motion failed 3 - 3 , Councilmen Howard , Fleetham and Thiel voting nay . 6 . PETITIONS , REQUESTS , AND COMMUNICATIONS (a ) COMMUNICATIONS FROM COUNTY COMMISSIONER Mr . Budd Robb , County Commissioner , appeared explaining to Council that land north of West 36th Street adjacent to County Road No . 18 was being dedicated t the City without most . Pair . Robb also told the Council that according to incomplete records the County felt that the valuations of St . Louis Park were running 3 % to 4 % under what was felt to be equal . it was the feeling of Council that St . Louis Park has always paid their fair share and that perhaps other communities were just now rising to this level . 7 . The original motion to delete Sections 1 and 2 carried 6 - Oe ORDINANCE NO . 1118 It was moved by Councilman Fleetham , seconded by Councilman Graves , to waive second reading and adopt Ordinance1118 Matin of entitled , " Regulating Ordinance Relating to the Licensing and g g Sales of Intoxicating Liquor , Establishing Types of Licenses and Setting Fees Therefor , Amending the St . Louis Park Ordinance Code Section 2 : 1306 , entitled ' Granting of Licenses ' s Section 2 : 1307 , Entitled ' Conditions of License ' s and Section 2 : 1308 , Entitled , ' Hours of Operation ' . " The motion carried with six yeas . (b ) RESOLUTION SETTING POLLING PLACES AND NAMING ELECTION JUDGES RESOLUTION NO. 4002 It was moved by Councilman Graves , seconded by Councilman Thiel , to waive reading and adopt Resolution No . 4002 entitled , " Resolution Setting Polling Places and Naming Election Judges for States Primary Election September 15 , 1970 . " The motion carried 6 - 0 . (c ) RESOLUTION CORRECTING RESOLUTION NO. 1271 , ADOPTED MAY 9 , 1960 WHICH ADOPTED AND AUTHORIZED PUBLICATION AND FILING OF MAP OF FUTURE STREETS OR OTHER PUBLIC USE RELATING TO RALEIGH AVENUE AND INDUSTRIAL ROAD NORTH OF EXCELSIOR BOULEVARD AND EAST OF HICHwAf 100 RESOLUTION NO . 4003 i It was moved by Councilman Galinson , seconded by Counci wed , Graves , to waive reading and adopt Resolution No . 4003 entitled ) 190 " Resolution Correcting Resolution No . 1271 , Adopted May 9 ' Which Adopted and Authorized Publication and Filing of '%4aP of 165 Council Minutes , August 17 , 1970 7 . (d ) RESOLUTION EXTENDING SYMPATHY TO THE FAMILY OF DONALD SEVERSON RESOLT:, T TON NO, 4004 It was moved by Councilman Fleetham , seconded by Councilman Graves , to waive reading and adopt Resolution No . 4004 entitled , " Resolution Extending Sympathy to the Family of Donald J . Severson . " The motion carried 6 - 0 . (e ) RESOLUTION APPROVING THE APPOINTMENT OF THE COM - MISSIONERS OF THE HOUSING AND REDEVELOPMENT AUTHORITY OF ST . LOUIS PARK , MINNESOTA RESOLUTION NO. 4005 It was moved by Councilman Graves , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 4005 entitled , " Resolution Approving the Appointment of the Commissioners of the Housing and Redevelopment Authority of Ste Louis Park , Minnesota . " The motion carried unanimous lye 8 . ( a ) Mr . Wallace Bruce was present . RESOLUTION NO , 4008 It was moved by Councilman Galinson , seconded by Councilman Thiel , to waive reading and adopt Resolution No . 4008 entitled , " Resolution Granting Special Permit under Section 6 : 176 . 4 of the St . Louis Park Zoning Ordinance for Residential Development Unit , Sixty - six Unit Apartment Building , Wallace T . Bruce . ” The motion carried 6 - 0 . (b ) REPUBLIC CREOSOTE PROPOSAL ( DEFERRED FROM JULY 20 , 1970 ) . Councilman Graves moved to table this matter . Councilman Fleetham seconded and the motion carried 6 - 0 . (c ) FENCING OF OPEN WATER AREAS ( DEFERRED FROM AUGUST 3 , 1970 ) . Councilman Heltzer explained that he had taken a survey of people adjacent to the ponding area at 32nd Street and Oregon Avenue and that none of these people favored fencing of the pond but instead preferred that it be landscaped . Mrs . Robert Aske , 1640 Kilmer , and Mrs . Betty Hardacker , 1801 Melrose Avenue , spoke in favor of landscaped ponds as opposed to chain link fencing . Councilman Galinson moved that the City in any future contracts require fencing of any open bodies of water during the construction period and that bids on all such construction projects be alternative bids , one with chain link fent ing and one without so that Council can at the time determine the need . Councilman Heltzer seconded this motion . Councilman Thiel moved to amend that fences of a temporary nature be installed during construction of a hazardous nature and be a part of the project cost , and that if the sump is to be permanent grading plans b e a part of the project . Councilman Galins Councilman agreed that the fencing during construction should be temporary . Thiel ' s amendment failed for lack of a second . Vote on the original motion carried 6 - 0 . Councilman Heltzer moved that the sump at 32nd and Oregon be landscaped rather than fenced . Councilman Graves seconded and the motion carried 6 - 0 . (f ) VACATION OF PUBLIC UTILITY EASEMENT - ASTLEFORD PARK RESOLUTION NO, 4009 It was moved by Councilman Heltzer , seconded by Councilman Galinson , to waive reading and adopt Resolution No . 4009 entified ' " Resolution for Hearing on Petition to Vacate Public Utility Ease - ment . " ( Hearing to be August 31 , 1970 ) . The motion carried 6 " 4 • 169 Council Iviinutes , August 17 = 1970 104 ( g ) APPRECIATION - VETERANS OF FOREIGN WARS Councilman Thiel moved that appreciation be expressed to the Veterans of Foreign Wars for the flag presented to the City . Councilman Galinson seconded and the motion carried 6 - 0 . (h ) SANITARY SEWER - HOPKINS FORCE MAIN Councilman Heltzer expressed concern because of the need to construct the sanitary sewer in West Lake Street which is a permanently paved street . The City Manager explained that since this project involved Hopkins , the Metropolitan Sewer Board and federal funds it would be most difficult at this time to make any changes in the plans but indicated every effort to have the route changed to some other street . 11 . MISCELLANEOUS ( a ) SPECIAL ASSESSMENTS - INTEREST RATE It was moved by Councilman Galinson , seconded by Councilman Thiel , to waive reading and adopt resolution raising interest rate on special assessments to 8 % . The motion carried 4 - 2 , Council - men Heltzer and Graves voting nay . Councilman Fleetham moved to reconsider . Councilman Heltzer seconded and the motion carried 4 - 2 , Councilman Galinson and Mayor Howard voting nay. The vote on the original lost 3 - 3 , Councilmen Heltzer , Graves and Fleetham voting nay . RESOLUTION NO. 4010 It was moved by Councilm : - -n Heltzer , seconded by Councilman Graves , to waive reading and adopt Resolution No . 4010 entitled , " Resolution Stating Policy for Interest Rate ( 7 % ) to be Charged on Special Assessments . " The motion carried 4 - 2 , Councilmen Fleetham and Thiel voting nay . (b ) HOUSE DEMOLITION - WEST 36TH STREET ( WOLFE PARK ) Councilman Graves moved that the Fire Department be permitted to burn structures on West 36th Street adjacent to Wolfe Park. Councilman Fleetham seconded and the motion carried 6 - 0 . (c ) PUBLIC RELATIONS TRAINING Councilman Galinson moved that Dr . Geier be authorized to conduct Public Relations Training for employees . (b ) PAYMENTS ON CONTRACT WORK Partial Payment No . 9 , Paving , Curb and Gutter and Sidewalk Repair , Imp . Nos . 66 - 55 , 69 - 02 , 69 - 19 , 69 - 18 , and 66 - 50 - Blacktop Service Company - $ 7 , 282 . 13 . On motion of Councilman Heltzer , seconded by Councilman Graves , the above payment on contract work presented by the City Engineer was approved , and the City Manager , City Clerk and City Treasurer were authorized to issue a check for the amount by a six yea vote . 13 .
