CALL TO ORDER City Council was called to order by Mayor Fruk A regular meeting of the Howard at 8 : 18 p . m . Z . INVOCATION Since there was no one present from the Ministerial Association , no invocation was given . 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Murray Galinson Richard Graves James Heltzer Frank Howard Also present were the City Manager , City Attorney , Planning Director , Acting Director of Public Works , Assessor , Sanitarian , Director of Finance , and Secretary. Councilman Reynolds arrived at 8 : 25 and Councilman Thiel at 8 : 22 p . m . 4 . MINUTES On motion of Councilman Galinson , seconded by Councilman Fleetham , the minutes of the regular meeting held July 6 , 1970 and special meeting held July 13 , 1970 , were approved by a five yea vote . 5 . PUBLIC HEARINGS (a ) IMPROVEMENT OF HIGHWAY 100 FROM WEST 41ST STREET TO SOUTH CITY LIMITS , STATE IMPROVEMENT NO. 2734 - 18 , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED JULY 9 AND JULY 16 , 1970 Mayor Howard opened the hearing . The Acting Director of Public Works explained the project as propOsed by the State Highway Department , N` G . N. LaPitz , 4220 Vernon * Mr . Tom Motzko , 4160 Vernon ' and. r . Mrs . Barbara Beale , 5527 Vermont , had questions concerning the 147 ,ounal Minutes , July 20 , 1970 5 . (a ) assessment of the project . They were told they would not be re - assessed for utilities previously assessed . There being no one else present wishing to speak to this hearing . Mayor Howard declared the hearing closed . RESOLUTION NO, 3996 It was moved by Councilman Graves , seconded by Councilman Fleetham , to waive reading and adopt Resolution No . 3996 entitled , " Resolution Ordering Improvement , State Improvement No . 2734 - 18 . " The motion carried 6 - 1 , Councilman %seltzer voting nay. (b ) PROPOSED AMENDMENTS TO ZONING AND SUBDIVISION ORDINANCE ADDING SECTIONS REGULATING FLOOD PLAIN DISTRICT , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED JUNE 25 , JULY 21, AND JULY 99 1970 Mayor Howard opened the hearing . Councilman Galinson explained that he felt it would be beneficial to have a public informational meeting before the ordinance was adopted since there are many questions to be answered . Mr . Ken Pottle , 8900 Vilest 34th Street , asked for an explanation of the ordinance . Councilman Heltzer said that the major objective was to prevent people from building in an area that studies have shown are in the flood plain and to prevent filling in of the creek. He also explained that the flood plain zoning is not being undertaken by St. Louis Park alone , but by the joint powers provision with surrounding communities . The City Attorney explained that the Legislature now requires flood plain ordinances . Mr . Morton Greenberg , 3318 Decatur Lane , and Mrs . Howard Sigal 3333 Decatur Lane , expressed concern: as to uses along the creek and their desire to preserve and enhance the area . Mr . Richard Hunegs , 8907 Minnehaha Circle , said that according to the ordinance in its present form anyone wishing to build would have to give* an easement to the City before a permit could be issued . He said that if the concern is with industrial undeveloped and unplatted land this should be indicated in the ordinance . He also asked that a policy statement be drawn to accompany this ordinance so that every - one would understand its intent Irene Scott , attorney representing Sdkin & Linoff , expressed a desire to meet with the council representative of the Minnehaha Creek Watershed 148 Council Minutes * July 201 1970 would not be it Planner so that their zoning w 5 * (b ) District and the C y reduced without compensation . There being no one present interested in this hearing , Mayor Howard declared the hearing closed . It was moved by Councilman Galinson , seconded by Councilman Fleetham , to deny the request for rezoning . The motion carried 6 - 0 (Councilman Graves was not present ) . Councilman Reynolds voted in favor of the motion for six reasons given by staff in their report. 6 . PETITIONS , REQUESTS , AND COMMUNICATIONS ( a ) COMMUNICATION FROM LAKELAND DOOR COMPANY AND MIL-' CITY PLYWOOD REQUESTING EXTENSION OF TIME FOR CONS " PLIANCE WITH AIR POLLUTION ORDINANCE Mr . Jerome Bloom of Lakeland Door Company was present requesting Council to grant an extension of time . After discussion concerning the intent of the applicant and time that had elapsed since the passage of the ordinance , Councan 149 ,O„�i, Minutes , July Z0 , 1970 6 . ( a ) Reynolds moved to give a two - month extension and within that two months a definite proposal and contract be in the hands of the Sanitarian to proceed with the work , Councilman Thiel seconded the motion . After further discussion , Councilman Reynolds withdrew his motion and Councilman Heltzer moved to deny the request . Councilman Graves seconded and the motion carried 7 - 0 . ? . RESOLUTIONS AND ORDINANCE . ORDINANCE NO. 1116 It was moved by Councilman Graves , seconded by Councilman Reynolds , to waive second reading and adopt Ordinance No . 1116 entitled , " An Ordinance Providing for Separate License Fees for Stations and Private Outlets Amending the St , Louis Park Ordinance Code Sections 2 ; 1025 through 2 ; 1029 entitled ' Gasoline Service Stations " . The motion carried 6 - 0 . ( Councilman Graves was not present ) . 9 . UNFINISHED BUSINESS ( a ) REPUBLIC CREOSOTE PROPOSAL Since the attorney representing Republic Creosote could not be present this matter was deferred to August 3 , 1970 • 151 Council Minutes , July 20 , 1970 9 . (b ) LOUISIANA AVENUE; PAVING PROJECT After discussion concerning who was responsible and what should be done to correct the settlement in this paving project , Council asked that they be given a report relative to the under - ground utilities in that area . ( c ) ACCEPTANCE OF DEED - TORVAL JORVIG PROPERTY Councilman Thiel moved to accept deed and authorize City Clerk to file same for record . Councilman Galinson seconded and the motion carried with seven yeas . (d ) STOP SIGN STUDY Councilman Heltzer requested a stop sign study at West 34th and Decatur and the bridge and West 34th Street . He also asked that a review be made of the stop sign at 34th Street and Aquila . 10 . NEW BUSINESS ( a ) CITIZENS ADVISORY COMMITTEE APPOINTMENTS This matter was deferred to August 3 , 1970 . (b ) DISCUSSION OF CHAIN LINK FENCING IN PARKS ( REQUESTED BY COUNCILMAN GALINSON ) Councilman Galinson moved that staff bring , as soon as possible , a survey of the bodies of water in the City and cost of chain link fencing these bodies of water individually and as a whole .
