ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Murray Galinson Richard Graves James Heltzer Leonard Thiel Also present were the City l�,ianager , Assistant City Manager , City tor , Acting Director of Public Attorney , City Assessor , Planning Direc Works , and Secretary . Mayor Howard arrived at 8 : 40 pm , 4 . MINUTES On motion of Councilman Graves , seconded by Councilman Gali o by the minutes of the regular meeting held April 20 , 1970 , were approved five yea vote . 5 . PUBLIC HEARINGS ( a ) IMPROVEMENT NO, 70 - 20 , PAVING , CURB , GUTTER , AND SIDEWALK , . IN PAVING DISTRICT # 5 BOUNDED IN GENERAL EST MINNETONKA BOULEVARD ON THE NORTH , ITIEST 33RD ST ON THE SOUT :I , TEXAS AVENUE ON THE EAST AND AQUILA AVENUE ON THL WEST , AS DESCRIBED IN NOTICE OF PUBLISH E D APRIL 9 AND APRIL 169 1970 . President Pro Tem Thiel opened the hearing * oSed proJe � t The Actin Director of Public Vl? orks explained the prop s , indicatinggthat the design is based on the soil and traffic condition 83 council Minutes , April 27 , 1970 5 , ( a ) Slides were used to illustrate the need for the improvement by showing the present condition of the streets . " Before " and " after " slides were shown of a previously completed project . The City Assessor explained the assessment policy . Mr . Jeff Fine , 2430 Nicollet Avenue , represented General Realty, owner of apartment buildings in the area of the proposed improvement . He brought with him pictures of the area and he said he felt that only reasonable and necessary improvements should be made . He also said that he felt tenants in apartment buildings should be notified of the public hearings . Mayor Howard arrived and assumed the chair . Mr . John Turnacliff , 3066 Texas Avenue , questioned the cost of sidewalks proposed and also the removal of trees that would be in the way of sidewalk construction. Nir . Stephen Francis , 3146 Texas Avenue , told of the bad condition of the sidewalks in front of his residence . There being no one else present wishing to speak at this hearing , Mayor Howard closed the hearing . Council discussed the possibility of assessing sidewalks on an area basis , rather than the present policy of assessing abutting property owners . G" RESOLUTION NO. 3951 3y It was moved by Councilman Fleetham , seconded by Councilman Thiel , to waive reading and adopt Resolution No . 3951 entitled , " Resolution Crdering Improvement and Ordering Preparation of Plans Improvement No . 70 - 20 " , amended to include only the following sidewalks : east side of Virginia Avenue only ; south 6� side of 31st Street from Virginia to Xylon ; both sides of 31st from Xylon to Aquila ; west s ide of Xylon from 31st to 3 2nd Street ; and south side of 32nd Street from Texas Avenut to Xylon Avenue . The motion carried 5 - 1 , Mayor Howard voting nay . Councilman Galinson moved to reconsider . The motion was seconded by Councilman Thiel and carried 6 - 0 . Councilman Galinson moved to amend the motion that the sidewalks on 32nd Street from Texas Avenue to Xylon Avenue be on the north side of the street . Council - man Thiel seconded and the motion carried 5 - 1 , Mayor Howard , % vot i ng nay . Ray Singer , 7330 West 14th Street , presented a petition in 0 osition to the proposed project ( 77 signatures ) . he displayed PP slides showing conditions of the area . Mr . VJ alter Anderson , 1600 Louisiana Avenue ; Iver . Peter Bromine , 1826 Maryland Avenue ; Alpha. hiodroff , 1851 Nevada Avenue , Mr . Howard Buska , 1815 Maryland Avenue ; and Mrs . Delores Friedman , 1635 Pennsylvania , spoke in opposition to sidewalks . Mr . 4 Bill Johnson , 1401 Maryland Avenue , was opposed to the , project except in some of the low areas where it seemed necessary@ Iver . Jack Schear , 1428 Iviaryland Avenue , spoke in favor of the improvement , as did Mr . William Johnson , 1820 Maryland Avenue . Mr . Robert Lane , 1835 Nevada ; Firs . Shelton Fisher ; Mir . Orrin Pierce , 7448 West 16th Street ; and Mr . Paul Bourdeau , 1441 Nevada Avenue , questioned cost and assessment of the proposed improve - ment. There being no one else present desiring to speak, Iv, ayor Howard closed the hearing . RESOLUTION NO , 3952 It was moved by Councilman Galinson , seconded by Councilman Thiel , to waive reading and adopt Resolution No . 3952 entitled ' " Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No . 70 - 22 , " amending to delete all new f sidewalks in the area described and deleting the improverne Avenue paving , curb and gutter on Vilest 14th Street from Louisiana to its dead end . After discussion Councilman Thiel moved to amend to include paving , curb and gutter on West 14th Street ,l , Councilman Fleetham seconded the motion which carried 5 ' 85 Council Minutes , April 27 , 1970 50 (b ) Councilman Galinson voting nay , The motion as amended carried unanimously . 6 . STREET FROIV-L DAKOTA AVENUE TO LOUISIANA AVENUE AND DAKOTA AVENUE FROM MINNETONKA BOULEVARD TO 28TH STREET ; ESOLUTION NO . 3953 It was moved by Councilman Graves , seconded by Councilman Galinson , to waive reading and adopt Resolution No . 3953 entitled , " Resolution Authorizing Placement of Signs for Traffic Control . " The motion carried 6 - 0 . 9 . UNFINISHED BUSINESS ( a ) RECREATIONAL FACILITY REPORT Councilman Heltzer reported on the trip taken to Illinois to visit recreational facilities as an aid in planning the new ice arena and swimming pool proposed for the City . !-ie indicated that the Park Ridge facility seemed to be the type most desirable for the c14-y and that they offered their coopera � tion , (b ) COIv11vlISSION APP0INT1viENT Councilman Galinson moved to appoint IVirs . Bruce N.Litchell I to fill the unexpired term of Mir . Albert Hyster on the Parks and Recreation Advisory Commission .
