A regular meeting of the City Council was called to order b Mayor

2 . INVOCATION
Invocation was given by Rev . Bennett Brudevold of the Aldersgate Methodist
Church,
3 , ROLL CALL
The following Councilmen were present at roll call :
Frank Fleetham
Murray Galinson
Richard Graves
James Heltzer
Robert Reynolds
Frank Howard
Also present were the City Manager , Assistant City Manager , City
Attorney , Planning Director , Director of Public Works , and Secretary .
4 . MINUTES
On motion of Councilman Reynolds , seconded by Councilman Galinson , the
minutes of the special and regular meetings held November 2 , 1970 were
approved by a six yea vote .
5 • PUBLIC HEARINGS
( a ) APPLICATION FOR TRANSFER OF STOCK BY FOO CHU CAFE , INC . ,
AS DESCRIBED IN NOTICE OF HEARING PUBLISHED NOVEMBER 5 ,
1970 .
Mayor Howard opened the hearing .
Mr . John Prueter , 6621 LYndale Avenue , attorney representing Foo
Chu Cafe applicants for transfer , was present to answer questions .
There beingno one else present wishing to speak at this hearing ,
Mayor Howard declared the hearing closed .

Councilman Galinson moved to approve the transfer of stock .
The motion was seconded by Councilman Reynolds but after
discussion concerning financial condition of the applicants., Council -
man Galinson withdrew his motion and moved to defer until
3 0 on that same
November 30 and have liquor violation heard at 6 : uire -
date , and asked that Council waive the normal one month re q
ment for renewal of this license because of the timing involved .
Councilman Heltzer seconded but after further discussion Council -
man Galinson withdrew his motion It was then moved by Councilman
Fleetham to defer the hearing to November 30 , 1970 . Councilman
heltzer seconded and the motion carried 4 - 2 , Councilman Galinson
and Mayor Howard voting nay . Councilman Galinson moved to set
date for public hearing on the liquor violation for 6 : 30 p . m . ,
November 30 , 1970 . Councilman Graves seconded . Councilman
Galinson amended his motion to include that the requirement that
Foo Chu ' s application be submitted 30 days before December 15 be
waived . Councilman Graves seconded this motion and the amended
motion carried 6 - 0 .
Mr . Herb Davis , in presence of his client , waived notice of
hearing of the liquor violation ,

7 . RESOLUTIONS AND ORDINANCES
( a ) PROPOSED ORDINANCE AMENDING ORDINANCE ESTABLISHING
BUILDING CONSTRUCTION CODES ADVISORY COMMISSION
It was moved by Councilman Reynolds , seconded by Councilman
Graves , to waive first reading of proposed ordinance and set
date for second reading November 30 , 1970 . The motion carried
5 - 1 , Councilman Heltzer voting nay .
( b ) PROPOSED ORDINANCE AMENDING ST ., LOUIS PARK ORDINANCE
CODE REGULATING USE OF WATER HYDRANTS
It was moved by Councilman Galinson , seconded by Councilman
Graves , to waive first reading of proposed ordinance and set
date for second reading November 30 , 1970 . The motion carried
6 - 0 .

RESOLUTION NO. 4090
It was moved by Councilman Galinson , seconded by Councilman
Graves , to waive reading and adopt Resolution No . 4090 entitled ,
" Resolution Requesting Maximum Allotment for General Maintenance
on State Aid Street System and Requesting the State of Minnesota to
Transfer Funds Pursuant to Chapter 443 Session Laws of Minnesota
1965 . " The motion carried 6 - 0 .

g , ( a ) Councilman Galinson called to the attention of the applicant that they
realize they are using two more units than provided and will have to
reduce the number on another site . They agreed that they were
aware of this .
(b ) REPORT OF STOP SIGN STUDY - CEDAR LAKs. AVENUE AND
HUNTINGTON AVENUE

OCTOBER 8 , 1970
Councilman Fleetham suggested this committee study inter - city and
intra - city bus routes .
Upon hearing no further discussion , the minutes were ordered by
the Mayor to be received for filing .
(d ) MINUTES OF HUISAAN RIGHTS COMMISSION MEETING HELD
OCTOBER 22 , 1970
Councilman Galinson asked City Attorney to determine if people
age 19 and even under could serve on commissions now that they
have the voting privilege . He also suggested that Staff look into
the possibility of an appropriate university or college conducting
a community survey of attitudes in human rights and related areas .
Upon hearing no further discussion , the Mayor. orde' red the minutes
to be received for filing .

Upon hearing no objection , the minutes were ordered by the lviayor

9 . UNFINISHED BUSINESS
( a ) PROPOSED VACATION OF PORTION OF WEST 33RD STREET
BETWEEN QUENTIN AVENUE AND RALEIGH AVENUE
( CASE NO . 70 - 47 - VAC . ) ( HEADING CLOSED , ACTION DEFERRED
FROM NOVEMBER 2 , 1970 ) .
It was moved by Councilman Galinson , seconded by Councilman
Graves , to waive first reading of proposed ordinance and set
date for second reading November 30 , 1970 .
The City Manager explained that the City has utilities in this location
and that staff recommends a planned development in this area.
Mr . Jorgen Jorgensen and Mr . Larry Schroeder were present
representing Northland Aluminum Co .
After discussion Councilman Galinson amended his motion to
include the dedication of land as shown on Exhibit I . Councilman
Graves seconded and the original motion as amended carried 6 - 0 .
(b ) APPOINTMENT TO FIRE CIVIL SERVICE COMMISSION ( TABLED
NOVEMBER 21 1970 ) .

Councilman Galinson moved to authorize City Manager to acquire .
Councilman Graves seconded but after discussion concerning
lack of public need , Councilman Galinson withdrew his motion .
It was then moved by Councilman Reynolds to reject the offer .
Councilman Galinson seconded and the motion carried 5 - 1 ,
Councilman Graves voting nay .
c CONSIDERATION OF STAFF NEGOTIATIONS WITH REPUBLIC
CREOSOTE FOR LAND ACQUISITION , LOUISIANA RIGHT OF WAY
BETWEEN GORHAM AND OXFORD
Councilman Galinson moved to defer this item to November 30 .
Councilman Reynolds seconded but after discussion Councilman
Galinson withdrew the motion .
Councilman Heltzer moved that staff be directed to tag Republic
Creosote every time they are in violation of the air pollution
ordinance . Councilman Graves seconded and the motion carried
6 - 0 .
It was moved by Councilman Reynolds , seconded by Councilman
Graves , that staff be directed to proceed with negotiations .
The motion carried 6 - 0 .
(d ) CONSIDERATION OF CONSULTANT SERVICES FOR DESIGN OF
LOUISIANA AVENUE SOUTH OF GORHAM AVENUE
Councilman Reynolds moved to authorize staff to retain consultant
services for design of Louisiana Avenue south of Gorham Avenue ,
with fee to be approved by Council . Councilman Galinson seconded
and the motion carried 6 - 0 .

10 . SERVICE STATION BUILDING PERMITS � p
Councilman Reynolds moved that staff be directed to put 90 - day I
moratorium on iissuance of building permits for service stations
in the City and that a revision be made in the zoning ordinance
requiring service stations be erected by special permit only .
Motion was seconded by Councilman Graves and carried 6 - 0 .
(f ) STOP SIGN STUDY - - 33rD STREET AND WEBSTER AVENUE
Councilman Fleetham moved that staff be directed to report on
feasibility of a four - way stop sign at West 33rd Street and
Webster Avenue . Councilman Reynolds seconded the motion and
it carried 6 - 0 .
11 . MISCELLANEOUS
( a ) CIVIC CALENDAR REPORT
It was moved by Councilman Reynolds , seconded by Councilman
Graves , to authorize advertisement for bids for civic calendar
report for 1971 . The motion carried 5 - 1 , Councilman Galinson
voting nay *
( b ) SEWER IviETERING STATION - WEST 39TH STREET AND
