LOUIS PARK , MINNESOTA October 5 , 1970 1 , CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Howard at 8 : 06 p . m . 2 . INVOCATION Since no one was present from the Ministerial Association , there was no invocation . Mayor Howard presented an award to the Director of Finance from the Municipal Finance Officers Association for the financial reporting of the City. A commendation of the Police Department for their rescue work sent to the Council by Mr . John Billman was read by the Mayor . 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Murray Galinson James Heltzer Robert Reynolds Leonard Thiel Frank Howard Councilman Graves arrived at 8 : 25 p . m . and Councilman Thiel left the meeting at 1 : 25 a . m . Also present were the City Manager , City Attorney , Planning Director , Director of Finance , Assessor , Director of Public Works , and Secretary . 4 • MINUTES �► motion of Councilman Galinson , seconded by Councilman Heltzer , the minutes of the regular meeting held September 219 1970 and the special meeting held September 289 1970, were approved by a six yea vote . 5' PROPOSED SPECIAL ASSESSMENT OF IMPROVEMENTS COMPLETED WITHIN THE CITY AS DESCRIBED IN NOTICE OF HEARING PUBLISHED UPTEIVIBER 10 , 1970 : 216 Council Minutes , October 3P 1970 5 . (a ) Mayor Howard opened the hearing . . 65 - 46 , Storm Sewer , North Central Area : Improvement No The CitY Assessor explained the assessment policy for residential and commercial storm sewers . Mr . Don Hagen , 1014 West Excelsior , Hopkins , spoke in opposition to the assessment policy . Mrs . Lester IvicGowan , 1345 Colorado Avenue , and Mrs . J . Gatten , 1332 Colorado Avenue , objected to being assessed at the commercial rate when the land use is residential . Mr . Tony Klapperick , 1832 Kentucky Avenue , objected tot e amount of his assessment as compared to that of a neighbor . y Assessor explained that credit was given for assessments previously paid . Mr . Jerry Brill , attorney for Barrett Moving and Storage , indicated that it was his opinion that they should not have been included since the area was already served by storm sewer . After discussion , Councilman Galinson moved the assessment be reduced in the John A . Johnson Addition lots which are used for single family dwellings , but zoned commercial , be assessed on the same formula as those zoned for single family dwellings . Councilman Reynolds seconded the motion . Councilman Galinson amended his motion that when the property is sold and put into commercial use the remainder of the assessment would go on this property . The motion carried 7 - 0 . A letter was received by Council questioning some of the work that was done on this project by Gerald B . Gries , 1800 Idaho Avenue South . A letter was also received from INlr . Paul H . Hauge , representing Shakey ' s Pizza Parlor , questioning the degree of benefit to the property. Mayor Howard closed the hearing on this improvement , since no one else present wished to speak on this matter . I Improvement No . 68 - 01 , Storm Sewer , in West 34th Street frorn Decatur Lane to Minnehaha Creek : Mr . Mort Leder , 3337 Decatur Lane , felt the storm sewer was not necessary for his property since the water drains into the creek . Mr . Earl Isensee , 4617 Golf Terrace said that he had installed storm sewer in his addition at his own expense and did not feel that 217 Council Minutes , October 5 , 1970 5 . (a � he should be assessed for this improvement . The City Assessor explained that he would be assessed with this taken into consideration. There being no one else present to speak concerning this improvement , Mayor Howard declared the hearing closed . Improvement No . 69 - 06 , Storm Sewer , in area bounded in general by T . H . 100 on the west ; City limits on the south % Natchez Avenue on the east ; and Excelsior Boulevard on the north , and Improvement No , 69 - 07 , Storm Sewer , in area bounded in general by Niinnehaha Creek on the south : T . H . 100 on the east ; Excelsior Boulevard on the north ; and Dakota Avenue extended on the west : Mr . Alexander McLeod , 3946 Alabama Avenue , questioned the amount of his assessment and the method of credits for storm sewer was explained to him . Mr . Neal Susla , 5511 Vermont said that he had not received credit for previous storm sewer . The City Manager explained that some of these were put in with paving some years ago . Mr . Robert Schwinn , 4306 Alabama Avenue , said that the Mayor had saiand d that only those who received notices would be assessed lamed thatt several people had not received notices . The Mayor exp he had said that only those who were sent notices would be assessed . Mr . Louise Roldacher , 4232 Alabama Avenue , indicated that some in her neighborhood did not receive notices . 5825 Excelsior Boulevard he Mr . Fimon , 4245 Alabama Avenue , explained that she did not receive the notice and that she should have been given credit for previous pay - ments . Mr . Willard Schwartz , 4306 Brook Lane , felt the sewer did not benefit his property . Mr . Allen Schneider , 4181 Xenwood Avenue , said he was willing to pay his assessment but objected to water ponding in front of his home . Mr . Arthur Caine , 4033 Xenwood Avenue , inquired when the required thirty days for pre - payment would begin . He was told it would begin the following day but if any credit was found his money would be refunded. Mrs . Bates , 4305 Alabama Avenue , said that she received no notice of the hearing and did not benefit from the storm sewer . Mr . Walter Nelson , 4027 Yosemite Avenue , said he had lived at that address 20 years and had always had storm sewer . Mr . A . W . Lampe , 3924 Dakota Avenue , objected to the method of assessment of his property at Brunswick Avenue and Excelsior Boulevard , Mr . Paul Johnson , 4912 lviorningside Road , and Mr . Jerry Bronstein , 4908 lviorningside Road , had complaints concerning the drainage of their particular property . They were assured that any errors would be corrected . to Mr . Al Wallin , 4258 Wooddale Avenue , protested his assessment on the grounds that he had already granted an easement without any cost . Mr . Councilman Reynolds moved that the assessment be reduced on Hae Ned Lumber Company , 5825 Excelsior Boulevard to $49 000 and th assessment between Devaney and Wooddale be reduced .
