CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Thiel at 8 : 15 p . m • 2 . INVOCATION Invocation was given by Rev . Quinten Alfors of the St . Louis Park Evangelical Free Church . 3 . ROLL CALL The following Councilmen were present at roll call : James Heltzer Frank Howard Richard Koch Leonard Thiel Also present were the City Manager , Assistant City Manager , City Attorney, City Assessor , Finance Director , Planning Director , Director of Public Works , and Secretary. Councilman Galinson arrived at 8 : 29 p. m . 4 . MINUTES On motion of Councilman Koch , seconded by Councilman Howard , the minutes of the regular meeting held September 15 , 1969 , were approved by a four yea vote . 5 . PUBLIC HEARINGS ( a ) PROPOSED VARIANCE FROM PROVISIONS OF SECTION 6 : 094 . 5 OF ZONING ORDINANCE TO PERMIT CANOPY IN THE SETBACK AREl' AT 3200 VIRGINIA AVENUE , AS DESCRIBED IN NOTICE OF HEARING D PUBLISHED SEPTEMBER 11 9 ( CASE 9 ( c 1 b A No. 9 6 - 38 - VAR . ) REQSTE BY SAM SEGAL AND CHARLES WAISS , Mayor Thiel opened the hearing . Councilman Howard moved to continue hearing to September 29 ' 1969 Councilman Koch seconded and the motion carried 4 - 0 . 6 . PETITIONS , REQUESTS , AND COMMUNICATIONS None 282 Council Minutes , September 22 , 1969 7 . RESOLUTIONS AND ORDINANCES (a ) RESOLUTION DECLARING COST TO BE ASSESSED AND ORBERING PREPARATION OF PROPOSED ASSE SSIVIENTS , RESOLUTION NO, 3831 It was moved by Councilman Heltzer seconded b Gilman Koch , to waive reading and adopt Resolution No . 3831 enti Zed Declaring Cost to be Assessed and Ordering Preparation " Resolution Assessment . " Motion carried with five yeas . p °f Proposed (b ) RESOLUTION CALLING HEARING ON SPECIAL ASSESSMENTS RESOLUTION NO, 3832 It was moved by Councilman Heltzer , seconded by Councilman Howard , to waive reading and adopt Resolution No . 3832 entitled , " Resolution for Hearing on Proposed Special Assessment , Improvement Nos . 6646 , 66 - 36 , 66 - 47 , 68 - 22 , 68 - 23 , 68 - 31 , 68 - 321 68 - 36 , 68 - 37 , 68 - 39 , 68 - 429 68 - 43 , 68 - 591 69 - 14 , 69 - 229 66 - 551 69 - 02 , and 69 - 19 . " Motion carried 5 � 0 . 8. REPORTS OF OFFICERS , BOARDS , AND COMMITTEES (a ) REPORT OF STOP SIGN STUDY - WESTWOOD HILLS DRIVE AND FRANKLIN AVE NUE , Mr . Stanley Chauss , 8208 West Franklin , spoke in favor of stop signs at this intersection , indicating a preference for afour - way stop . RESOLUTION NO. 3833 It was moved by Councilman Koch , seconded by Councilman Howard , to waive reading and adopt Resolution No . 3833 entitled , " Resolution Authorizing Placement of Traffic Control Signs at Intersection of Westwood Hills Drive and Franklin Avenue and Repealing Resolution No * 3424 . It Notion carried 5 now 0 . (b ) MONTHLY FINANCIAL REPORT - AUGUST 1969 UPon hearing no discussion , the report was ordered by the Mayor to be received for filing . (c ) MINUTES OF HUMAN RIGHTS COMMISSION MEETING HELD SEPTEMBER 17 , 1969 . 283 Council Minutes , September 22 , 1969 Koch moved to authorize the staff to investigate and contact g , (c ) Councilmanos sibilit of placement of trainees in the City TCOIC concerning the possibility Hall , Councilman Galinson seconded and the motion carried 5 - 0 , Councilman Koch explained the desire of Human Rights Commission to sponsor " Gospel Erupts " concert . Councilman Galinson moved that this Council go on record encouraging ission to further investigate than that they o the Human Rights Comme Y of having a " Gospel Erupts " concert in St . Louis Park h a concert bring back to us information concerning the cost of such helpful in arriving and other such information that they feel would be help g Councilman at a decision . Councilman Heltzer seconded the mora of the Edina Koch suggested that staff get a report from Dick By Human Rights Commission concerning their experience wit his e concert . After discussion , Councilman Galinson wit�odwhether the motion and asked for opinion of the City Attorneyon then moved that staff City can legally do this . Councilman Gal sible as to the cost of a " Gospel Erupts " report back as soon as pos in concert and a brief description of the program and how it we ree ort be Edina . Councilman Koch seconded and asked that this sam p duplicated and sent to the Human Rights Commission , The motion carried 5 - 0 . Councilman Heltzer moved that the Council request of the School Board that , with the approval of the teachers involved , a member of the Human Rights Commission be admitted to a meeting with certain teachers and the School Board relative to discriminatory hiring practices . Councilman Howard seconded and the motion carried 5 - Oe Councilman Heltzer moved that Council adopt a position , if it is in legal concurrence with the Charter , that the recommendation of the Commission be accepted to consider applications of persons under 21 years of age to be appointed to Commissions . Councilman Howard seconded and the motion carried 5 - 0 . Councilman Galinson asked that the City Attorney prepare the proper amendment to the ordinance establishing the Human Rights Commission permitting a representative from the School Board to be a Commissioa member . P . ) ( DEFERRED FROM SEPTEII/iB y R 8 , 1969 ) e Councilman Heltzer moved to defer this matter to September 29 1969 . Councilman Galinson seconded and the motion carried 5 - o . 10 . NEW BUSINESS ( a ) TABULATION OF BIDS - IRON REMOVAL PLANT , IIviPROVEMENT NO. 69 - 41 . Mr , Harry Mayeron , Orr - Schelen - Mayeron , explained that the bid far exceeded the engineers ' estimate because of the great increase in construction costs in the past nine months . After discussign concerning the priority , financing , and cost of this improvement , Councilman Galinson moved to reject all bids . Councilman Howard seconded and the motion carried with 7 ,- �' five yeas . (b ) LAND ACQUISITION - Park Purposes - Wolfe Park - Lot 3 , Block 4 , Westmoreland Park . Councilman Heltzer moved to accept deed and authorize City Clerk to file same for record . Councilman Howard seconded and the motion carried 5 - 0 . ( c ) LAND ACQUISITION - Construction Easement - Retaining Wall 41st Street and Quentin Avenue . Part of Lot 16 , Auditor ' s Subdivision Number 308 , Improvement No . 69 - 02 . It was moved by Councilman Howard , seconded by Councilman Heltzer to accept deed and authorize City Clerk to file same for record . Motion carried 5 - 0 . 1Z ' C1MS , APPR OPRIA TIONS , AND CONTRACT PAYMENTS ( a ) VERIFIED CLAIMS On motion of Councilman Heltzer , seconded by Councilman Howard , the lists of verified claims prepared by the Director of Finance and presented to the Council dated September 22 , 1969 in the total 285 Council Meeting , September 22 , 1969 amounts of $ 5 , 569 . 44 for payroll , and $416 , 680 . 12 for vendors 12 . ( a ) am Cit Clerk and Cit were approved , and the City Manager , Y Y Treasurer were authorized to issue checks covering same by a five yea vote . (b ) PA. YMENTS ON CONTRACT WORK Partial Payment No . 2 . Improvement Nos . 66 - 06 , 68 - 22 , 68 - 310 - 43 , 68 68 - 32 , 68 - 36 , 68 - 379 68 - 39 , 68 - 42 , 68 66 - 36 , 66 - 47 , and 68 - 23 - Concrete Alley Pavi- 59 , 69 - 14 , 69 - 22 , ng and Sidewalks - Concrete Specialties , Inc . - $ 51 , 503 . 81 . On motion of Councilman Heltzer , seconded by Councilman Howard , the above payment on contract work presented by the City Engineer was approved , and the City Manager , City Clerk and City Treasurer were authorized to issue a check for the amount by a five yea vote . 13 .
