Bruce Pederson of the Westwood Lutheran Invocation was gbRev Church . 3 , ROLL CALL The following Councilmen were present at roll call : Murray Galinson Richard Graves James Heltzer Frank Howard Richard Koch Also present were the City Manager , City Attorney , City Assessor , Planning Director , City Engineer , and Secretary . Mayor Thiel arrived at 9 : 10 p . m . 4 . MINUTES On motion of Councilman Koch , seconded by Councilman Galinson , the minutes of the regular meeting held September 8 , 1969 , were approved by a five yea vote . 5 . PUBLIC HEARINGS (a ) PROPOSED SPECIAL ASSESSMENT FOR IMPROVEMENTS COMPLETED WITHIN THE CIT Y , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED AUGUST 21 , 1969 . President Pro Tem Howard opened the hearing . Mr . Robert Greenberg , attorney representing Mr . Henry Lapide5s a property owner in the area was interested in the assessn' ent of the grading project , Improvement No . 66 - 24 , in the area of i West 26th and 27th Streets and Yosemite and Zarthan AVenues • Mr . Greenberg asked that Councils read the payment a ent over a p ten - year period . Mr . Charles Alexander , abutting land owner , expressed the same view . 276 Council Iviinutes , September 15 , 1969 5 . (a ) There being no one else present interested in the levying of the assessments , President Pro Tem Howard closed the hearing , RESOLUTION NO , 3827 It was moved by Councilman Galinson seconded by Councilman Koch , to waive reading and adopt Resolution No . 3827 amended to spread the grading ; Improvement No . 66 - 24 , over a ten - year period , and entitled , " Resolution Adopting Assessment " . Motion carried 4 - 1 , President Pro Tem Howard voting nay . This resolution adopted assessments for Improvement Nos , 66 - 24 , 68 - 16 , 68 - 17 , 68 - 46 , and 66 - 72 , b, PETITIONS , REQUESTS , AND COMMUNICATIONS None 7 . RESOLUTIONS AND ORDINANCES ( a ) FIRST READING OF AN ORDINANCE RELATING TO LICENSING AND REGULATING SALES OF INTOXICATING LIQUOR AND AMENDING THE ST . LOUIS PARK ORDINANCE CODE , IN SECTIONS 2 : 1301 , SUBD . (k ) ENTITLED " DEFINITION OF TERMS " ; SECTION 2 : 1303 , ENTITLED " APPLICATION FOR LICENSES " , SECTION 2 : 1307 , SUBDS . ( a ) , ( b ) , (f ) , AND ( m ) , ENTITLED " CONDITIONS OF LICENSE " . Councilman Graves moved - to waive first reading and set date for second reading September 29 , 1969 , Councilman Koch seconded the motion . Councilman Galinson moved to amend Section 3 , 2 : 1303 to read , " fee to be $ 100 per owner of a partial interest and in no event to be less than $ 500 . " Councilman Heltzer seconded the amendment to the motion which carried with five yeas . The original motion also carried with five yeas . (b ) FIRST READING OF AN ORDINANCE REGULATING SALES OF NON - INTOXICATING MALT LIQUOR TO INTOXICATED PERSONS AND ALLOWING CERTAIN MINORS TO BE EMPLOYED WHERE NON - INT OXICA TING MALT LIQUOR IS SOLD , AMENDING THE ST . LOUIS PARK ORDINANCE CODE IN SECTION 2 : 108 ( a ) , ENTITLED " CONDITIONS OF LICENSE AND REGULATIONS ; SALES TO MINORS PROHIBITED " . ORDINANCE * NO. 1074 After discussion concerning the urgency of the passage of this ordinance , Councilman Koch moved to pass as an emergency ordinance , effective immediately , Ordinance No . 1074 entitled , " An Emergency Ordinance Establishing a Section of Traffic Analysis , Safety , Control , and Reporting in the Department of Engineering ; Providing for Appointment by the City Manager and Supervision by the Director of Public Works ; and , Setting Forth { Qualifications and Duties of Appointees Who Shall Be Known as ' Traffic Safety Aides . " Councilman Heltzer seconded the motion which carried with five yeas . (e ) SECOND READING OF PROPOSED ORDINANCE AMENDING PERSONNEL ORDINANCE TO INCLUDE EMPLOYEE STUDY INCENTIVE PLAN ., ORDINANCE NO. 1075 It was moved by Councilman Graves , seconded by Councilman Galinson , to waive second reading and adopt Ordinance No . 1075 entitled , " An Ordinance Establishing a Study Incentive Program and Providing Regulations Therefor , It Motion carried with five yeas . Councilman Koch moved to approve and authorize Street Department to proceed with the improvement . Councilman Graves seconded the motion which carried with five yeas . (b ) REPORT OF CITY MANAGER - LANDSCAPING , KNOLLWOOD PLAZA Councilman Graves moved to authorize expenditure of $ 3 , 183 . 05 for landscaping costs at Knol .wood Plaza . Councilman Koch seconded and the motion carried with five yeas . (c � REPORT WITI; RESPECT TO STREET LIGHTING - FRANCE AVENUE , Councilman Galins on mored to authorize additional lighting on France Avenue in cooperation with City of Minneapolis . Council - man Koch seconded and the motion carried with five yeas . Councilman Graves moved to authorize to conclude the purchase .� � of Parcels 4 and 5 in the 39th Street condemnation on behalf of the City for $ 19 , 500 . Councilman Koch seconded and the motion carried with five yeas . (b ) COOPERATIVE AGREEMENT - MINNEHAHA CREEK WATERSHED DISTRICT ( DEFERRED FROM SEPTEMBER 81 1969 ) . ' RESOLUTION NO. 3829 It was moved by Councilman Heltzer , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3829 entitled , " Resolution Authorizing Joint and Cooperative Agreement Providing for Prepara - tion of a Coordinated Land and Water Management Plan for Develop - ment and Maintenance of Minnehaha Creek . " Motion carried with five yeas . 10 . NEW BUSINESS ( a ) MARTIN CONWAY - DISCUSSION CONCERNING HENNEPIN COUNTY LEAGUE OF MUNICIPALITIES , Mr . Conway did not appear at the meeting . (b ) AWARD OF CONTRACT FOR STORM SEWER , SANITARY SEWER , AND WATLR MAIN , IMPROVEMENT NOS , 65 - 46 , 68 - 01 , 68 - 47 , 69 - 05 , 69 - 061 and 69 - 07 . Mayor Thiel was not present . 11 • MISCELLANEOUS (a ) APPOINTMENT TO PARKS AND RECREATION ADVISORY COMMISSION It was moved by Councilman Heltzer , seconded by Councilman Howard , to appoint Mr . Albert liyster to fill the unexpired term of Mr . Marshall Lifson on the Parks and Recreation Advisory Commis sion . Motion carried with six yeas . 12 . CLAIMS , APPROPRIATIONS , AND CONTRACT PAYMENTS (a ) FINAL CONTRACT PAYMENT , IMPROVEMENT NOS , 68 - 27 AND 65 - 01 , TRAFFIC SIGNALS , HOFFMAN ELECTRIC CO. $ 71376e 00 . RESOLUTION NO. 3830 It was moved by Councilman Graves , seconded by Councilman Koch , to waive reading and adopt Resolution No . 3830 entitled , " Resolution Accepting Work on Traffic Signals , Improvement Nos . 68 _ 27 and 65 - 0111 . Motion carried with five yeas .
