LOUIS PARK , MINNESOTA JUNE 2 , 1969 1 , CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Thiel at 8 : 19 p . m . 2 , INVOCATION Invocation was given by Rev . Paul Obenauf of the W ooddale Lutheran Church . 3 . ROLL CALL The following Councilmen were present at roll call : Richard Graves Frank Howard Richard Koch Robert Reynolds Leonard Thiel Also present were the City Manager , City Attorney , Planning Director , Director of Public Works , City Assessor , and Secretary . Councilman Galinson arrived at 8 : 35 p . m . 4 • MINUTES On motion of Councilman Reynolds , seconded by Councilman Koch , the Minutes of the regular meeting held May 26 , 1969 , were approved by a five yea vote . ( Councilman Galinson was not present ). 5• PUBLIC HEARINGS (a ) PROPOSED PRELIMINARY PLAT OF KLOCEK ' S ADDITION NORTHWEST CORNLR OF 29TH STREET AND NATCHEZ AVLNUE ) REQUESTED BY ALBIN KLOCEK . Mayor Thiel opened the hearing . Mrs Albin Klocek , 4700 West 29th Street , was present to answer questions concerning the plat . After discussion concerning dedication of land to straighten a jog in the street , Mayor Thiel declared the hearing closed . 162 s ! Council Minutest June 2 , 1969 was moved by Counci (a ) It lman Reynolds , seconded by Councilman 5 , rove the preliminary plat . Motion carried Galinson , to app unanimously . (b ) IMPROVEMENT NO. 69 - 13 , ALLEY PAVING , GLENHURST PLACE BETWEEN GLENHURST AVENUE AND HUNT NGTONAVENUE FROM CEDAR LAKE AVENUE (WEST 27TH STREET ) NORTH 560 FEET TO ITS END , AS PUBLISHED IN NOTICE OF HEARING PUBLISHED MAY 22 AND MAY 29 , 1969 . Mayor Thiel opened the hearing . The Director of Public Works described the proposed improvement giving its location , width and method of construction . Mr . John Broughton , 2847 Quentin Avenue , representing his mother on Glenhurst and Mr . Mark Wexler , 2644 Glenhurst Avenue , were present and spoke in favor of the improvement . Mr . Bill Mortensen , 2643 Huntington Avenue , presented a petition signed by two - thirds of the property owners in opposition to the improvement . The City Assessor explained the method that would be used for assessing this improvement on the basis of its enhancement of the market value of the property . Mrs . Mark Wexler , 2656 Glenhurst , suggested humps in the concrete alley to slow down traffic since this was one of the main obj ections to the improvement . Mr . Earl Shaw , 2649 Huntington Avenue ; Mr . Grant Anderson , 2643 Huntington , Mr . J . S . Hooper , 2641 Huntington ; Mrs . Frank Janes , 2668 Glenhurst ; and Mr . Walter Wenzel , 2656 Glenhurst spoke in Opposition to the improvement but many of them asked for better maintenance of the alley . Mr . Ron Berman , 5837 West 25 -L Street , inquired about the costs of alley maintenance . Mayor Thiel declared the hearing closed . RESOLUTION NO, 3750 It was moved by Councilman Graves , seconded by Councilman Galinson , to waive reading and adopt Resolution No . 3750 entitled , " Resolution Approving Plans and Specifications and Authorizing Advertisement for Bids , Improvement Nos . 66 - 06 , 68 - 22 , 68 - 31 , 68 - 32 , 68 - 369 68 - 37 , 68 - 39 , 68 - 429 68 - 43 , 68 - 59 , 69 - 14 , and 69 - 22 . " Motion carried unanimously . (b ) PROPOSED ORDINANCE RELATING TO MINNEHAHA CREEK AND THE LANDS ABUTTING SAID CREEK ; ESTABLISHING REQ UIRE - MENTS FOR DEVELOPMENT OF ABUTTING LANDS AND PROVIDING FOR THE ISSUANCE OF PERMITS TO CONTROL DEVELOPMENT AND TO PREVENT OCCUPANC )( AND ENCROACHMENTS UPON THE BED , BANKS , AND FLOOD PLAIN OF SAID CREEK . Councilman Galinson moved to refer the proposed ordinance to the City Attorney and the Plannin ; Commission . Councilman Reynolds seconded and the motion carried unanimously . 8 • REPORTS OF OFFICERS , BOARDS , AND COMMITTEES (a ) PRELIMINARY REPORT OF DIRECTOR OF PUBLIC WORKS AND ASSESSMENT REPORT WITH RESPECT TO IMPROVEMENT NO. 68 - 571 ALLEY PAVING , BETWEEN WEST 35 ? (f ) REPORT CONCERNING PLACEMENT OF STOP SIGNS RESOLUTION NO . 3753 an It was moved by Councilman Galins on , seconded by Councilrn Graves , to waive reading and adopt Resolution No . 3753 entitled , 165 Council Minutes , June 2 , 1969 8 , (f ) " Resolution Authorizing Placement of Stop Signs for Traffic Control at Intersection of West 36th Street and Brunswick Avenue . " Motion carried unanimously . ( g ) REPORT FROM HUMAN RIGHTS COMMISSION CONCERNING DISCRIMINATION WITH RESPECT TO HIRING OF TEACHERS Councilman Galinson moved to forward to School Board , Councilman Howard seconded . Rabbi Goodman was present speaking for the Human Rights Commission , Councilman Reynolds moved to amend the motion to forward without comment as to approval or disapproval . Councilman Galinson seconded . After discussion , Councilman Reynolds withdrew his motion to amend . Councilman Galinson moved to amend the motion to state that it be forwarded to the school board and that the school board be informed of Council ' s concern in this regard and would like to have their opinion as to the comments made in the report and that Council would like to have a joint meeting with them at their earliest possible convenience after they have been able to study and make their own report to discuss this matter and other matters of joint concern . Councilman Graves seconded the amendment to the motion. Vote on the original motion carried unanimously,, as did the amendment . (h ) MINUTES OF HUMAN RIGHTS COMMISSION MEETING HELD MAY 21 , 1969 . Jack Beugen , 4218 Basswood Road , were present as owners of the land in question . Councilman Graves moved to defer but the motion lost for lack of a second . RESOLUTION NO. 3755 After much discussion and when no agreement could be rea ched, it was moved by Councilman Reynolds , seconded by Councilman Koch , to waive readingand adopt Resolution No . 3755 entitl for P " Resolution Authorizing Taking of Land by Eminent Don'aled Street Purposes and other Municipal Uses . ( c ) RESOLUTION NO, 3756 It was moved by Councilman Reynolds , seconded by Councilman Galinson , to waive reading and adopt Resolution No . 3756 entitled , " Resolution Authorizing Joint and Cooperative Agreement Relating to Construction of County State Aid Highway No . 18 and West 36th Street . ItMot - on carried unanimously. 10 . NEW BUSINESS ( a ) EMPLOYEE APPOINTMENTS AND PROMOTIONS ( M & C NO. 69 - 16 ), Councilman Galinson moved to consent and approve appointment of Lyle Hanks as Recreational Coordinator and Robert Graham as Assistant City Planners and the promotion of Robert Helmer to Engineering Technician III Councilman Howard seconded the motion . Councilman Koch moved to amend the motion to defer the appoint - ment of Recreational Coordinator to June 9 with the understanding that at that time Council will have a record of the number of hours in the day he will be at school , hours he is to be working for the City , the salary to be paid � o him from the City plus salary to be paid from school funds . Councilman Galinson seconded . Vote on the amendment lost 1 - 5 , Councilmen Galinson , Graves , Howard , Reynolds , and Thiel voting nay . Vote on the original motion carried unanimously . (b ) LAND ACQUISITION - 27TH STREET AND DAKOTA AVENUE Councilman Reynolds moved to accept deed from Minneapolis , c G, Northfield and Southern Rail vaY dated May 27 , 1969 , authorize " payment of $ 50 , 000 and authorize City Clerk to file same for record . Councilman Graves seconded and the motion carried unanimously . (c ) POLLUTION OF MINNEHAHA CREEK Councilman Galinson moved that Council go on record stating that their feeling is that the pollution of Minnehaha Creek is not only a local matter and the Governor should be so informed with copies Of the letter to Hopkins , Edina , Legislators , and Minnehaha Creek Watershed District . Councilman Graves seconded and the motion carried unanimously . Motion lost for lack of a second . (f ) CANVASSING Or JUNE 3 REFERENDUM Councilman Reynolds moved to canvass votes of the June 3 bond referendum at 5 : 00 P . M . , June 5 , 1969 . Councilman Graves seconded and the motion carried unanimously . 11 . MISCELLANEOUS ( a ) DAMAGE C LA. IMS 1 . Mr . Leo Meyman , 3320 Webster Avenue 2 . Mr . Edward Bukstein , 1441 Hillsboro Councilman Reynolds moved to file above claims with the City Clerk for proper action by the City Manager and City Attorney. Councilman Howard seconded and the motion carried unanimously, 12 . CLAIMS , APPROPRIATIONS , AND CONTRACT PAYMENTS ( a ) VERIFIED CLAIMS On motion of Councilman Graves , seconded by Councilman Galson, the lists of verified claims prepared by the Director of Finance and presented to the Council dated June 2 , 1969 in the total amllullt5 of 3 460 . roped' $ 26 for payroll and $47 298 * 26 for vendors were aPP and the City Manager , City Clerk , and Cit Treasurer were authorized to issue checks covering same by a six yea vote . 13 .
