MINUTES On motion of Councilman Reynolds , seconded by Councilman Howard , the minutes of the regular meeting held April 28 , 1969 , were approved by a six yea vote . ; 5 . PUBLIC HEARINGS None 6 . PETITIONS , REQUESTS , AND COMMUNICATIONS (a ) COMMUNICATION FROM ELMER N . OLSON COMPANY CONCERNING OUTDOOR STORAGE Mr . John Peltier , manager of Elmer N . Olson Company , was present explaining their need to use City property adjacent to their business for boat storage . 133 Council Minutes , May 5 , 1969 b. ( a ) It was explained to him by Council that there is no way such permission can be legally granted . 7 , RESOLUTIONS AND ORDINANCES ( a ) RESOLUTION ORDERING PREPARATION OF PLANS AND SPECIFICATIONS , IMPROVEMENT NO, 69 -o06 . RE50LUTION NO, 3724 It was moved by Councilman Howard , seconded by Councilman Reynolds , to waive reading and adopt Resolution No . 3724 entitled , " Resolution Ordering Preparation of Plans and Specifications , Improvement No . 69 - 06 . " Motion carried with seven yeas . (b ) RESOLUTION ORDERING PREPARATION OF PLANS AND SPECIFICATIONS , IMPROVEMENT NO. 69 - 07 . RESOLUTION NO, 3725 It was moved by Councilman Galinson , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3725 entitled , " Resolution Ordering Preparation of Plans and Specifications , Improvement No . 69 - 07 . " Motion carried with seven yeas . (c ) RESOLUTION SETTING POLLING PLACES AND NAMING ELECTION JUDGES - JUNE 1969 REFERENDUM , Councilman Galinson expressed concern about proper selection of election judges and asked for staff report on the manner in which they are following the statutory authority. RESOLUTION NO. 3726 It was moved by Councilman Graves , seconded by Councilman Galinson , to waive reading and adopt Resolution No . 3726 entitled , " Resolution Setting Polling Places and Naming Election Judges for Special Election , June 3 , 1969 . " Councilman Galinson seconded and the motion carried with seven yeas . 8 . REPORTS OF OFFICERS , BOARDS , AND COMMITTEES (a ) REPORT CONCERNING ADDITIONAL STOP SIGNS IN AQUILA AREA ' Councilman Galinson moved to defer this matter to May 19 , 19690 Councilman Koch seconded and the motion carried with seven yeas . (b ) REPORT CONCERNINC SIGNS REGULATING PARKING AT UTICA AVENUE AND 'JEST 23RD STREET , RESOLUTION NO , 3728 It was moved by Councilman Koch , seconded by Councilman Galinson, to waive reading and adopt Resolution No . 3728 entitled , " Resolution Authorizing Placement of Traffic Control Signs Regulating Paring and Repealing Resolution No . 2965 Entitled ' Resolution Authorizing Placement of Traffic Control Signs Regulating Parking ' . " Motion carried with seven yeas . _ (c ) REPORT CONCERNING JOINT AGREEIidENT HOPKINS SEWER FORCE MAIN ( M & C NO . 69 - 1 1 ) . 135 Council Minutes , May 5 , 1969 8 . (c ) RESOLUTION NO. 3729 It was moved by Councilman Graves , seconded by Councilman Koch. , to waive reading and adopt Resolution No . 3729 entitled , " Resolution Declaring Intention of City of St . Louis Park to Join in Joint Construction of Joint Sanitary Sewer Lines from Hopkins through St. Louis Park and Minneapolis . " Motion carried with seven yeas . It was suggested by Councilman Heltzer that a committee of Council meet with political leaders in Hopkins concerning this proposal , as well as pollution along Minnehaha Creek. Mayor Thiel and Councilmen Reynolds and Heltzer were appointed to meet with Hopkins political leaders concerning mutual problems . It was suggested that the City Managers be included in these joint meetings . (d ) MINUTES OF PLANNING COMMISSION MEETING HELD APRIL 16 , 1969 . Upon hearing no objections , the Mayor ordered the minutes to be received for filing . Councilman Galinson expressed concern about the Commission making requests for staff reports , as these requests should be made through the Council , not directly to the staff. (e ) FINANCIAL REPORT OF THE CITY FOR 1968 . Councilman Graves moved to refer to Finance and Audit Committee . Councilman Heltzer seconded and the motion carried with seven yeas . (f ) REPORT CONCERNING STOP SIGN STUDY AT JOPPA AND SUNSET , RESOLUTION NO. 3730 It was moved by Councilman Koch , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3730 entitled , 'Resolution Authorizing Placement of Stop Signs for Traffic Control at Inter - section of Joppa Avenue and Sunset Boulevard . " Motion carried with seven yeas . 9 . After further discussion concerning the traffic patterns in the area , Councilman Koch moved to deny the special permit . Councilman Graves seconded the motion . ( Fieltzer arrived at 9 : 45 pome ) Mr . Wally Bruce and Mr . Sidney Lorber , attorney representing the applicant , said that they felt they were not given a chance to be heard and to show their plans before Council had already decided to deny the permit . Mr . Bruce indicated that he would restrict by record on his deed the use of any of the remainder of the property in this area to a nursing home . He felt the traffic problems had been solved by the A�Iest 22nd Street cul - de - sac and that nursing homes do not generate much traffic . Councilman Koch withdrew his motion and moved to table with the intention of studying the area . Councilman Galinson seconded the motion which carried 4 - 39 Councilmen Heltzer , Howard and Reynolds voting nay . 137 i Council Minutest May 5 , 1969 qo (b ) APRIL CREEK JOINT POWERS AGREEMENT ( DEFERRED FROM P RIL 14 AND APRIL Zg , � 9b9 ) . RESOLUTION NO, 3731 It was moved by Councilman Galinson , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3731 entitled , " Resolution Authorizing Joirt and Cooperative Agreement Providing for the Establishment of a Bassetts Creek Flood Control Commission to Plan , Control and Provide for Development of Bassetts Creek. " Motion carried with seven yeas . Councilman Galinson indicated that the City Attorney had raised some valid points concerning the language of the agreement which he could bring up at a later date , but that he was anxious to IL have this agreement authorized at this time . /L The City Attorney said that this agreement had been prepared byr� by /4 Mr . Curtis Pearson acting as City Attorney and that he intended i to sign all resolutions for this project and back up Mr . Pearson as representing the City . (c ) AMENDMENT TO GARBAGE COLLECTION CONTRACT ( DEFERRED FROM APRIL 21 AND APRIL 28 , 1969 ) . Mayor Thiel indicated that it was his feeling that garbage service should be simplified to collection of a limited number of cans , perhaps two , in order to have a lower assessment for residents . Councilmen Galinson and Koch were in favor of a more complete pick up . Councilman Galinson moved to authorize Mayor and City Manager to execute on behalf of the City. Councilman Graves seconded and the motion carried with six yeas . ( Councilman Heltzer was not present ) . (d ) COMMITTEE REPORT CONCERNING RESIDENCY REQUIRE - MENTS ( DEFERRED FROM MARCH 10 AND APRIL 14 , 1969 ). Councilman Koch moved to waive first reading and set second reading for May 12 , 1969 , Councilman Galinson seconded and the motion carried 6 - 1 , Councilman Graves voting nay . NEW BUSINESS a ( a ) MEETING PLACE - HENNEPIN COUNTY LEAGUE OF MUNICIPALITIES a Mayor Thiel stated that the League would like to meet at the St. Louis Park City Hall in the coming year . Council - man Reynolds moved that staff be instructed to use Council Chambers for these meetings , if not in conflict with other committed uses , for one year at the customary rate . Council - man Graves seconded the motion which carried unanimously . (b ) PARKING - WEST LAKE STREET - HIGHV, AY ? - DAKOTA y Councilman Heltzer moved that the Planning Department and the Planning Commission make a recommendation to Council in regard to solution to the parking problem on West Lake Street , between Highway 7 and Dakota Avenue . Councilman Koch seconded the motion which carried unanimously . 11 . (b ) Councilman Heltzer moved that letter of commendation be sent to Gregory Joseph , Benilde High School , and Ronald Abrams , St , Louis Park High School , as being finalists in the Minneapolis Star World Affairs Program . Councilman Koch seconded and the motion carried with six yeas . ( Councilman Galinson had left the meeting ) . ( c ) COMMENDATION - PLANNING DIRECTOR , PLANNING COMMISSION CHAIRMAN AND CITY MANAGER , Councilman Reynolds commended the Planning Director , City Manager and Planning Commission Chairman for their excellent representation of the city at the Metropolitan Council , 12 . C LAIMS , APPR OPRIA TI ONS A ND C ONTRAC T PA YME NTS ( a ) VERIFIED CLAIMS On motion of Councilman Graves , seconded by Councilman Reynolds , the list of verified claims prepared by the Director of Finance and presented to the Council dated May 5 , 1969 in the total amount of $ 65 , 807 . 44 for vendors was approved , and the City Manager , City Clerk , and City Treasurer were authorized to issue checks covering same by a six yea vote .
