LOUIS PARK , MINK',, S OTA May 26 , 1969 1CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Thiel at 8 : 22 p , m . 2 . INVOCATION Invocation was given by Councilman Howard , 3 . ROLL CALL The following Councilmen were present at roll call : Murray Galins on Richard Graves James Heltze r Frank Howard Richard Koch Robert Reynolds Leonard Thiel Also present were the City Manager , City Attorney , Planning Director , Director of Public Works , and Secretary . 4 . MINUTES On motion of Councilman Howard , seconded by Councilman Reynolds , the minutes of the regular meeting held lviay 19 , 1969 , were approved by a seven yea vote . 5 . PUBLIC HEARINGS None 6 . PETITIONS . REQUESTS ; AND COMMUNICATIONS (a ) NOTIFICATION OF INTENT TO HOLD BINGO GAMES - GEMELUS CHESEL SYNAGOGUE , 2734 RHODE ISLAND AVENUE . (b ) MONTHLY FINANCIAL REPORT - APRIL 1969 Upon hearing no discussion , the report was ordered by the Mayor to be received for filing , (c ) REPORT CONCERNING REGULATION OF PARKING - DAKOTA AVENUE FROM 26Th STREET TO MINNETONKA BOULEVARD RESOLUTION NO , 3 747 It was moved by Councilman Graves , seconded by Councilman Koch , to waive reading and adopt Resolution No . 3747 entitled , " Resolution Authorizing Placement o � Traffic Control Signs Regulating Parking . It Motion carried unanimously . It was suggested that a letter be sent to residents on Dakota Avenue explaining that this was a temporary action in order that trucks could use Dakota Avenue to haul fill to the nearby park . ' RESOLUTION NO. 3748 It was moved by Councilman Meltzer , seconded by Councilman Reynolds , to waive reading and adopt Resolution No . 3748 entitled , " Resolution Receiving Petition ) Preliminary Reports , Approving Same and Ordering Improvement No . 68 - 47 . " Motion carried unanimously , ( e ) REPORT OF THE PLANNING COMMISSION ( CASE NO. 68 - 38 - Z . ) RECOMMENDING FAVORABLY UPON T1-1E REQUEST OF SHELARD DEVELOPMENT CO . TO REZONE A PORTION OF THE PROPERTY LOCATED IN THE' NORTHWEST QUADRANT OF STATE HIGHWAY NO. 12 AND COUNTY HIGHWAY NO, 18 FROM B - 2 , GENERAL BUSINESS DIST �-- ICT , TO RB , RESIDENTIAL BUSINESS DISTRICT , It was moved by Councilman Reynolds , seconded by Councilman Graves , to set date for public hearing on June 9 , 1969 . Motion carried unanimously . It was indicated by the Planning Director that several meetings had been held with boundary communities concerning this rezoning and that nothing concrete had evolved from these meetings . Councilman Howard moved that staff write letter to the Metropolitan Council advising them that Council has set the date for hearing and that the reason for this action is that Council believes cooperation is essential , that this City advised boundary communities of these plans approximately one year ago and only Minnetonka appeared and it is the feeling of Council that this City has cooperated and sees no reason to defer further . Councilman Cralinson seconded this motion which carried unanimously . (f ) REPORT OF PLANNING DIRECTOR WITH RESPECT TO FINAL PLAT OF ISENSEE ' S FIRST SUBDIVISION ( BETWEEN GETTYSBURG AND HILLSBORO , COUNTY ROAD 18 AND MINNEhAHA CREEK ) - REQUESTED BY EARL A , H . ISENSEE , ARTHUR J . SHASKY AND CLARA V . MCDERMOTT The Planning Director described the proposed plat . He indicated that it meets the requirements of the Comprehensive Plan but that the Watershed District prefers to have a wider easement along the creek . Councilman Graves moved to defer this plat until the report is received from the V, atershed District . Councilman Heltzer seconded � After ouncilman Councilman Reynolds moved to table this mate Graves seconded and the motion carried unanimously . (b ) LAND ACQUISITION - STREET EASEMENT FOR EXTENSION OF TEXAS AVENUE ( DEFERRED FROM MAY 19 , 1969 ) . Councilman Howard moved to accept deed from Sonny Miller j Construction Co . and authorize City Clerk to file same for record . Councilman Galinson seconded and the motion carried unanimously . ( c ) AGREEMENT NO. PW 13 - 05 - 69 , COUNTY PROJECT NO. 6725 , COUNTY ROAD 18 AND WEST 36TH: STREET ( DEFERREF FROM MAY 19 , 19 69 ) . Councilman Graves moved td waive reading and adopt resolution authorizing agreement . Councilman Heltzer seconded the motion• Ved After discussion , Councilman Graves withdrew his motion and MO to defer to June 2 , 1969 . Councilman Reynolds seconded and the motion carried unanimously , 10 . NEW BUSINESS ( a ) EMPLOYEE APPOINTMENTS It was moved by Councilman Graves , seconded by Councilman Howard , to consent and approve the following appointments : Charles Caron , Conrad Miller , and Richard Larson as firefighters ; and Steven Co Vollmer as Laborer in the " 4 i 159 --W Council minutes , May 26 , 1969 10 . (b ) LAND ACQUISITION - ACCEPTANCE OF DEED FOR RIGHT OF WAY - AQUILA AVENUE , Councilman Meltzer moved to accept the following deeds and authorize City Clerk to file same for record : 3 rr� United National Investors Corp . , May 22 , 1969 � v Teachers Insurance & Annuity Association of ' America , May 23 , 1969 ; and Minnesota Teachers 4' Realty Corporation , May 23 , 1969 . Councilman Graves seconded and the motion carried unanimously . Councilman Meltzer moved that the Manager be authorized to employ a consulting engineer to work with the Department of Public Vt, orks and City Planner to plan the Aquila Avenue extension . Councilman Graves seconded and the motion carried unanimously . (c ) PROPOSED CHANGE ORDER NO . 5 to ASPHALT PAVING CONTRACT WITH BURY & CARLSON TO EXTEND COMPLETION DATE TO JUNE 16 , 1969 . Councilman Reynolds moved to defer to June 9 , 1969 . Councilman Howard seconded and the motion carried unanimously . ( d ) EMPLOYMENT OF CONSULTING ENGINE ER Councilman Graves moved that the City Manager be authorized to employ outside consultants to assist with alley paving , street design , inspection and other such work until the vacancies are filled with personnel and schedules are met . Councilman Heltzer seconded and the motion carried unanimously . ( e ) CONNECTION TO SANITARY SEWER Councilman Reynolds moved that an ordinance be drafted toward the end of having all residences connected to the sanitary sewer . Councilman Heltzer seconded and the motion carried unanimously . There was concern expressed concerning the hardship for people on fixed incomes . The City Attorney indicated that there would be no way the City could provide relief to these people .
