CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Thiel at 8 : 10 p • m • 2 . INVOCATION ' by Councilman Richard Koch . Invocation was given 3 . ROLL CALL The following Councilmen were present at roll call : Murray Galinson Richard Graves James Heltzer Richard Koch Robert Reynolds Leonard Thiel 4 . MINUTES On motion of Councilman Galinson , seconded by Councilman Graves , the minutes of the regular meeting held May 5 , 1969 and special meeting held April 28 , 1969 , were approved by a six yea vote with the following amendment : Page 138 , 9 (b ) . . . Mr . Pearson acting as attorney for communities involved. " 5 . PUBLIC HEARINGS None 6. PETITIONS , REQUESTS , AND COMMUNICATIONS ( a ) COMMUNICATION FROM PHILLIP STERN CONCERNING GH�� GES OF ASSESSING DEPARTMENT ( TABLED APRIL 21 , 1969 ) 9 It was moved by Councilman Galinson, seconded by Councdn'an Graves , to remove this matter from the table . Motion carried with five yeas . ( Councilman Heltzer was out of the chambers )' Mr . ( a ) After discussion concerning whether this charge was a tax or a fee for service , Councilman Galinson moved to file the corres - pondence and have Council take the matter under consideration . Councilman Reynolds seconded and the motion carried with six yeas . 7 . RESOLUTIONS AND ORDINANCES ( a ) RESOLUTION APPROVING AGREEMENT - ELECTRIC LIGHTING SYSTEM - HIGHVIAY 100 BETWEEN VEST 39TH STREET AND WEST 42ND STREET . RESOLUTION NO. 3732 It was moved by Councilman Reynolds , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3732 entitled , " Resolution Authorizing Contract with State of Minnesota for Fluorescent Lights . " Motion carried with five yeas . ( Councilman Heltzer was out of the chambers ) . (b ) RESOLUTION APPROVING AGREEMENT - SIGNAL SYSTEM AT HIGFkWA Y 100 INTERCHANGE , EAST AND WEST RAMPS AND TRUNK HIGHWAY 169 ( EXCELSIOR AT ti'TOODDALE ) . RESOLUTION NO. 3 733 It was moved by Councilman Galinson , seconded by Councilman Reynolds , to waive reading and adopt Resolution No . 3733 entitled , " Resolution Authorizing Contract with State of Minnesota for Traffic Control Signals . " Motion carried with six yeas . ( c ) RESOLUTION APPROVING CONSTRUCTION PLANS , HENNEPIN COUNTY PROJECT NO. 6725 - COUNTY ROAD 18 AND WEST 36TH STREET , RESOLUTION NO. 3 734 It was moved by Councilman Galinson , seconded by Councilman Reynolds , to waive reading and adopt Resolution No . 3734 entitled , " Resolution Approving Construction Plans , Hennepin County Project No . 6725 , County Road 18 and Ylest 36th Street . " Motion carried with six yeas . (d ) RESOLUTION APPROVING CONSTRUCTION PLANS 68 - 16 SP 2334 - 20 ( 100= 5 ) SIGNAL SYSTEM AT HIGHWAY 100 INTERCHANGE EAST AND WEST RAMP AND TRUNK HICHWA Y 169 ( EXCELSIOR AT W O ODDA LE ) . 144 Council Minutes , May 12 , 1969 RESOLUTION No* 3735 7 . (d ) seconded by Councilman It was moved by Councilman Graves , Resolution No . 3735 entitled , Koch , to waive reading and adopt „ Resolution App rovin g Construction Plans and Specifications for Traffic Control System at Interchange of Trunk Highway No . 169 ( Excelsior Boulevard ) and W ooddale Avenue , and at the Intersection of Trunk Highway No . 100 Ramps and Excelsior Boulevard . " Motion carried with six yeas . (e ) RESOLUTION APPROVING CONSTRUCTION PLANS 69 - 15 SP 2734 - 19 ( 100 = 5 ) , ELECTRIC LIGHTING SYSTEM , HIGHWAY N0. 100 BETWEEN WEST 39TH STREET AND WEST 42ND STREET , RESOLUTION NO . 3736 It was moved by Councilman Galinson , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3736 entitled , " Resolution Approving Construction Plans and Specifications for Electric Lighting System at Highway No . 100 Between West 39th Street and West 42nd Street , " Motion carried with six yeas . (f ) PROPOSED ORDINANCE AMENDING CITY CHARTER ( SEE LEGAL OPINION NO, 253 , DATED 5 / 2 / 69 ) . Councilman Heltzer moved to send ordinance to Charter Commission for advice and recommendation and request to initiate action under other statute . Councilman Graves seconded and the motion carried unanimously . ( g ) SECOND READING OF PROPOSED ORDINANCE REZONING PROPERTY NORTH AND EAST OF ThE INTERSECTION OF QUENTIN AND WEST 39TH STREET FROM R - 4 , ONE TO ELEVEN FAMILY RESIDENCE DISTRICT , TO R - B RESIDENTIAL BUSINESS DISTRICT ( CASE NO. 69 - 6 - Z , ) , On motion by Councilman Graves , seconded by Councilman Koch , this matter was deferred to May 19 . Motion carried unanimously' ( h ) SECOND READINC OF PROPOSED ORDINANCE AMENDING SECTION 1 : 303 SUBDIVISION C ENTITLED " RELATIONSHIP TO OTHER CITY PERSONNEL AND RESIDENCE " OF THE ST . LOUIS PARI{ ORDINANCE CODr, , R REQUIREMENTS FOR CITY ELATING TO RESIDENCE EMPLOYEES . Councilman Graves moVed to table this matter .' TREATMENT E It was moved by Councilman Heltzer , seconded by Councilman Reynolds , to approve plans as submitted . Motion carried unanimously . ! t ( c ) REPORT OF CITY MANAGER CONCERNING INVESTMENTS ( M & C No . 69 . 13 ) . After discussion concerning proper methods of investments , Councilman Reynolds moved that the local banks not be given preference . Councilman Galinson seconded and the motion carried unanimously. It was moved by Councilman Reynolds , seconded by Councilman Galinson , that the City should give preference to the Plymouth National Bank , all things being equal , to their authorized limit . Motion carried 5 - 1 , Mayor Thiel voting nay . Councilman Reynolds moved that staff should , without regard to local banking institutions , invest city ' s money strictly on the highest and best interest yield type of securities including all types of legal government securities . Councilman Graves seconded and the motion carried unanimously . ( d ) REPORT CONCERNING JOINT HENNEPIN COUNTY POLICE RADIO SYSTEM ( M & C NO, 69 - 12 ) . Councilman Galinson moved to participate in area wide communica - tion system and purchase necessary equipment out of 1969 funds . Councilman Graves seconded and the motion carried unanimously . ( e ) MINUTES OF PLANNING COMMISSION MEETING HELD MAY ? , 19699 There was discussion as to whether or not public hearings should be held at the Planning Commission level . UNFINISHED BUSINESS None 10 , NEW BUSINESS (a ) TABULATION OF BIDS - STREET WORK SUPPLIES Councilman Heltzer moved to delete portion of contract awarded to Blacktop Service and readvertise that portion of the contract . After discussion . Councilman Heltzer withdrew this motion . Councilman Reynolds moved to designate Blacktop Service , B & R Rock Products , Bryan Rock Products , Inc . , Northwest Gravel Co . , Richards Oil Co . , Anderson Aggregates , Inc . , and River Warren Aggregates , Inc . as the lowest responsible bidders and authorize Mayor and City Manager to execute contracts . Councilman Koch seconded and the motion carried 4 - 1 , Councilman Heltzer voting nay and Councilman Galinson abstaining . (b ) TABULATION OF BIDS - PRESSURIZED TAR AND ASPHALT KETTLE , Councilman Reynolds moved to designate Hayden - Murphy EguiPment Company as the lowest responsible bidder and accept bid . Councilman Graves seconded and the motion carried unanirn°usly (c ) PLANNING COMMISSION APPOINTMENT Councilman Galinson moved to appoint Mr . Robert Wolfe to the Planning Commission to fill the unexpired fired term of Mr • h �{eit Meland . Councilman Graves seconded and the motion carried unanimously . 147 f Council Minutes , May 12 , 1969 Joe (d ) CITIZENS TAX COMMITTEE Mr . Ronne Berman , 5837 We 25 -! Street , and Mr . A . J . Trangle , 5536 West 25 -1 Street , appeared before Council questioning a letter to the editor in which he defended City employees who had been publicly criticized by the Tax Committee . Council - man Reynolds road a detailed report wriL4ten by the City Manager explaining the parr ; c111a : jor that had been criticized . It was suggested by Council that if the committee has substantiated accurate inforrrat. on this should be brought to the attention of the Council or Buff rather than the newspaper because of the effect of this ;ci.nc'. 1� �.'olicit ;r on the morale and efficiency of employees . The committee admitted that they probably had used the wrong c.ppro :- cii bu': ' .hat they were concerned about the use of taxpayerr, ' moley ,, (e ) SANITARY SEWER CONNECTION Councilman Reynolds moved that Council approve the temporary connection to be made by West Suburban Builders to the St . Louis Park Water and Sewer system . Councilman Galinson seconded and the motion carried unanimously . 11 . MISCE LLA NE OUS (a ) DAMAGE CLAIMS - R . K . Farr ( Mrs . ) , 1441 Kentucky Avenue Councilman Graves moved to file above claim with the City Clerk for proper action by the City Manager and City Attorney . Council - man Reynolds seconded and the motion carried unanimously. 12 . CLAIMS , APPROPRIATIONS , AND CONTRACT PAYMENTS ( a ) CONTRACT PA YM11. NT Partial Payment , Improvement Nork 620,O85 , Storm Sewer City of Minneapolis , $ 105 , 529 . 45 , Councilrran Reynolds moved to approve above payment .
