LOUIS PARK , MINNESOTA March 24 , 1969 1 , CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Thiel at 8 : 10 P . m . 2 . INVOCATION Invocation was given by Councilman Frank Howard . 3 . ROLL CALL The foaowing Councilmen were present at roll call : Murray Calinson Richard Graves James Heltzer Frank Howard Richard Koch ` Robert Reynolds Leonard Thiel Also present were the City Manager , City Attorney , Planning Director , Director of Public Works , Supervisor of Zoning and Inspection , and Secretary . 4 ., MINUTES On motion of Councilman Graves , seconded by Councilman Reynolds , the minutes of the regular meeting held March 17 , 1969 and special meetings held March 13 and 19 , 1969 , were approved by a seven yea vote . 5 . Mayor Thiel opened the hearing . Mayor Thiel opened the hearing . The Planning Director summarized the requested variance . Dr . Marshall Short , 2512 Huntington , appeared in his own behalf, showing transparencies of the area and explaining the need for the variance . Mayor Thiel declared the hearing closed. RESOLUTION NO. 3695 It was moved by Councilman Howard , seconded by Councilman Koch , to waive reading and adopt Resolution No . 3695 entitled , " Resolution Granting Variance in Rear Yard Depth from the Requirements of Section 6 : 064 . 5 of the St . Louis Park Zoning Ordinance . It Motion carried 6 - 1 , Councilman Heltzer voting nay. (c ) PROPOSED REZONING OF PROPERTY NORTH AND EAST OF THE INTERSECTION OF QUENTIN AVENUE AND WEST 39TH STREET FROM R - 4 , ONE TG ELEVEN FAMILY RESIDENCE DISTRICT AND B - 2 , GENERAL, BUSINESS DISTRICT , TO R - B RESIDENTIAL BUSINESS DISTRICT REQUESTED B Y BALTINOx� R. Because of a letter received by Council from Robert Ehrenberg of Charles Friedheim Co . r �' equesting additional land to be rezon Councilman Reynolds e Y moved to continue the hearing , referring th e � , matter to the Planning Commission . Richard Fudali , secretary of Builders Equity and Bill Dolan , 50 (c ) M Engineer , were present representing the applicant . i Mr . Fudali indicated that the petitioner would be donating 50 , 000 square feet of land for streets if the rezoning would be approved . Councilman Reynolds changed his motion to continue hearing to April 7 and that the matter be referred , along with the letter from Friedheim to the Planning Commission on April 2 . Councilman Galinson seconded but after further discussion Councilman Reynolds withdrew his motion and moved to waive first reading and set date for second reading April 14 , 1969 , referring the letter from Friedheim Company to Planning Commission on April 2 . Council - man Galinson seconded and the motion carried unanimously. Mr . Robert Ehrenberg , Beltline Industrial Park , indicated an interest in the zoning change and proposed roadpatterns . 6 . " Motion carried unanimously . 8 . REPORTS OF OFFICERS , BOARDS , AND COMMITTEES (a ) MONTHLY FINANCIAL REPORT - FEBRUARY 1969 There being no objection , Mayor Thiel ordered the report to be received for filing. 9 . UNFINISHED BUSINESS ( a ) NEWSPAPER DISPENSERS ON PUBLIC RICHT - OF - W- AY Mr . Howard Mithun , 423 Portland Avenue , attorney for Minneapolis Star and Tribune was present . It was pointed out by Staff that the dispensers are illegal as they now exist . After questioning by Council Mr . Mithun agreed that the Star and Tribune would indemnify the City by means of bond and Councilman Galinson moved that staff contact Minneapolis Star aro Tribune and request that they send an agreement holding the GitY of St. Louis Par lameles from an exi � tenC ; of vendingy damage caused by machines in the Cit Councilman Howard seconded the motion carried unanirnously . 93 armless ( amended 4/ 7 / 69) Council Minutes , March 24 , 1969 9 . ( a ) RESOLUTION NO, 3698 It was moved by Councilman Galinson , seconded by Councilman Reynolds , to waive reading and adopt Resolution No . 3698 entitled , " Resolution Requesting Preparation of Bill for Legis - lative Action at 1969 Session Relative to Newspaper Vending Machines by the City of St . Louis Park , Minnesota . " Motion carried unanimously . (b ) SPECIAL PERMIT - RIDGWA f CONSTRUCTION COMPANY - CHANGE IN PLANS The Supervisor of coning and Inspection pointed out that the proposed revision is not in substantial compliance with the original plans . Mr . William Rosen , attorney and Robert Ridgway , applicant were present. 4 Councilman Galinson , along with other Councilmen , expressed concern about the heavy flow of traffic onto Franklin Avenue , with access planned only in that direction . There was also concern about parking problems because of additional rental charges for garages . Mr . Marvin Rothstein , 1820 Pennsylvania Avenue , said that the residents in the area had been told that there would be no entrances or exits on Franklin Avenue . RESOLUTION NO. 3699 It was moved by Councilman Froward , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 3699 entitled , " Resolution Amending Resolution No . 2896 Granting Permit Under Section 6 : 176 . 4 of the St . Louis Park Zoning Ordinance for Residential Development Unit , Multiple Dwelling , Ridgway Construction Company . " Motion carried 6 - 1 , Councilman Koch voting nay . ( c ) CONFLICT OF INTEREST - POLICE CIVIL SERVICE COMMISSION RESOLUTION NO . 3700 It was moved by Councilman P� eltzer , seconded by Councilman Galinson , to adopt Resolution No . 3700 entitled , " Resolution Requesting Mayor to Call Hearing Relative to Possible Conflict of Interest of Chairman , Police Civil Service Commission . JOHNSON It was moved by Councilman Graves , seconded by Councilman Reynolds , to accept deed and authorize City Clerk to file same for record . Motion carried unanimously . (b ) EMPLOYEE PROMOTION - PARKS & RECREATION DEPARTMENT Councilman Heltzer moved to concur with the promotion of Rodney W . Stendel to the position of Park Maintenanceman I. Councilman Galinson seconded and the motion carried unanimously. (c ) PROPOSED CHARTER CHANGES Councilman Graves requested the City Attorney prepare a resolution for discussion by Council on April 7 relative to several proposed charter changes that would then be forwarded to the State Legislatw (d ) OFFICIAL DESIGNATE Councilman Graves asked that he be designated as the official designate of the City to the National League of Cities Conference in Washington , D .
