Councilman Graves seconded and the motion ea animous 1 un y (f ) REPORT OF CITY MANAGER - ALLEGED LIQUOR VIOLATION It was moved by Councilman Reynolds , seconded by Councilman Graves , to set date for public hearing on the alleged violation of Foo Chu Cafe , Inc . , on March 13 , 1969 at 5 : 00 P . M . Motion :f carried unanimously (g ) FINANCIAL REPORT - MONTH OF DECEMBER 1968 Upon hearing no objection , Mayor Thiel ordered the report to be received for filing . 9 . UNFINISHED BUSINESS (a ) RECOMMENDATION FROM PLANNING COMMISSION - CUL- DE - SAC AT 41ST STREET AND HIGHWAY NO. 100 j The Planning Director explained the project as originally approved and as presently proposed by the State Highway Department . Mr . Forre`stClapper , 4885 Barber Drive , Minnetonka , trustee of the Park Baptist Church , was present . He said that the church had formulated no opinion as they were awaiting the court decision on land condemnation . 43 Cbuncii Minutes , February 10 , 1969 9 . ( a ) After discussion concerning the parking problems of the church and the responsibility of payment for the proposed cul - de - sac , Councilman Howard moved to defer this matter to March 10 , 1969 . Councilman Galinson seconded and the motion carried unanimously. Councilman Galinson suggested that prior to March 10 Council be informed of the ramifications of the alternate proposed cul - de - sac . (b ) REPORT OF CITY ATTORNEY - NEWSPAPER DISPENSERS ON PUBLIC RIGHT - OF- WA Y The City Attorney explained that he had met with attorneys for the newspaper and they felt they had a right to placing the dispensers and that the City had a right to regulate them . Mr . Burry suggested that Council ask the legislature to include these with telephone booths , etc . Councilman Howard moved that Staff bring in a recommendation as to how the City can legally regulate these dispensers . Councilman Reynolds seconded and the motion carried unanimously. ( c ) HOMEWOOD PARK SECOND ADDITION r Councilman Galinson moved that this plats be placed on the agenda for February 17 . NEW BUSINESS � , g (a ) TABULATION OF BIDS FOR TRACTOR MOWER Councilman Howard moved to designate Minnesota Toro as the lowest responsible bidder , to accept bid in the amount of $ 6 , 355 and to authorize purchase . Councilman Reynolds seconded and the motion carried unanimously . (b ) HIGHWAY PLANS - HIGHWAY NO , 100 FROM 42ND STREET TO CITY LIMITS I Councilman Heltzer moved that this matter be sent to the Planning Commission for their February 19 meeting . Councilman Graves seconded and the motion carried unanimously . 11 . MISCELLANEOUS ( a ) JENNINGS RED COACH INN , INC , Councilman Howard moved to set date for public hearing on February 24 , 1969 to include off sale liquor in the present on sale and Sunday sale liquor license . Councilman Galinson seconded and 44 Council Minutes , February 10 , 1969 a the motion carried unanimously . 11 .
