ROLL CALL The following members were present at roll call : Murray Galinson Richard Graves James lieltzer Frank Howard Robert Reynolds Leonard Thiel Also present were the City Manager , Assistant City Manager , Cit Attorney , Planning Director , Director of Public Works , Director of Finance , Supervisor of Zoning and Inspection , and Acting Secretary , 39 RESOLUTIONS AND ORDINANCES ( a ) SECOND READING OF PROPOSED ORDINANCE AMENDING THE ST . LOUIS PARK ORDINANCE CODE RELATING TO FEES AND CHARGES TO BE PAID CITY FOR SPECIAL SERVICES , SECTION 1 : 271 ENTITLED " STREET AND ALLE Y VACATIONS " , AND SECTION 1 : 2720 ENTITLED " ZONING AND RELATED MATTERS " , AND ORDINANCES NO, 733 , PASSED DECEMBER 28 , 1959 AND NO* 8290 PASSED MARCH 12 , 1962 RELATING TO " ZONING AND RELATED MATTERS " ORDINANCE NO. 1089 Councilman Heltzer questioned whether paragraph ( 1 ) of Section 1 : 272 should be revised to eliminate possible ambiguity and to remove what might be considered unfairness of requiring individuals to pay for Planning Commission initiated rezoning procedures . The City Attorney explained that the ordinance did not require the Council to exact payment and that the provision could be applied to individual or comprehensive rezoning procedures as deemed necessary. ( B ) ( 1 ) (b ) ENTITLED THE SAME " FILING FEE " AND ORDINANCE NO. 846 RELATING SUBJECT , PASSED JULY 23 , 1962 ORDINANCE NO. 1090 It was moved by Councilman Galinson , seconded by Councilman Howard , to waive reading and adopt Ordinance No . 1090 entitled , " An Ordinance Amending Section 6 : 303 Entitled ' Preliminary Plan b , Filing Fee ' , of the St . Louis Park Ordinance Code , as Amended for Ordinance No . 846 Passed July 23 , 1962 , Relating to Procedure the Subdivision of Lands in the City of St . Louis Park . " The motion carried 6 - 0 . SECOND READING OF PROPOSED ORDINANCE AMENDING THE (c ) ST . LOUIS PARK ZONING ORDINANCE RELATING TO VARIANCES AND SPECIAL PERMITS , SECTION 6 : 205 . 5 ENTITLED " EXTENSION OF TIME ORDINANCE NO. 1091 i After discussion of the provisions of the proposed ordinance with 1 respect to possible waiver of fees , it was moved by Counc1 man Heltzer , seconded by Councilman Graves , to change the second sentence of Section 6 : 205 . 5 , Extension of Time to read : " The fee for such extensions shall be Seventy - five Dollars ( $ 75 . 00 ) for each request for extension of time , provided , however , that at the time of granting such extension the City Council may waive such fee and direct the return of a part or all thereof to the applicant if the Gity has not incurred additional expense by reason thereof * " , and to waive reading and adopt Ordinance No . 1091 entitled , " An Ordinance Amending Ordinance No . 730 Passed December 28 , 1959 , Entitled the St . (b ) Present to discuss the program with the Council were representatives of es Rudolph , Gene Kretchmer , and Andy Aronson , Northern States Power Company . Mr . Rudolph explained the procedures used in preparing the " Midblock Street and Alley Lighting Proposal " as submitted to the Council . In response to questions by the Council , Mr . Rudolph indicated that ornamental lighting fixtures could not be supplied by NSP , and that ornamental poles cannot be installed with overhead wiring . Mayor Thiel inquired about underground service installation and Mr . Rudolph replied that it will be some time until such conversions can be made as NSP is currently involved in placing major feeder lines underground . In addition , 800 of all new distributions are underground systems and NSP suffers a manpower shortage in this area . Operating charges for underground service with laminated poles would be $ 1 . 00 per pole per month more than overhead wiring due to increased cost of underground service maintenance . The City Manager indicated that the staff agreed in principle with the number of lights and placement recommendations made by NSP but that the easements needed would be a major problem . There is also agreement on the priorities timetable . Discussion followed on the possibility of reducing the program time period . Council - man Galinson stated that some residents will object to paying for the program when their area is not included for several years . Councilman Heltzer felt that the program must maintain sufficient flexibility to meet traffic and law enforcement problems as they arise . Mayor Thiel requested the NSP representatives to supply information to the Council on the shortest time possible to guarantee completion of the program and the timetable for underground service installation with ornamental poles in the area . In addition , NSP was requested to investigate the possibility of purchase of ornamental poles from the City upon installation . After further discussion , it was moved by Councilman Heltzer , seconded by Councilman Howard , to support the concept of paying for the Midblock Street and Alley Lighting Program from General Funds . After consideration , Councilman Howard subsequently withdrew his second because he felt that payment decision should be postponed if substantially higher costs might be involved in ornamental lighting . The motion was then seconded by Councilman Graves and carried 5 - 1 , Councilman Galinson voting nay . The motion carried unanimously . g (e ) REPORT OF ATTORNEY , TWIN CITIES DISPOSAL INC . VS CITY OF ST . LOUIS PARK It was moved by Councilman Howard , seconded by Councilman Heltzer , that the Council recess at 9 : 50 and meet in private with the City ' s defense attorney to review the proceedings . Councilman Galinson stated that such action was necessary as a public meeting could be injurious to the City ' s position . The motion carried 6 - 0 . The Council reconvened at 10 : 20 p . m . (f ) POLICE CIVIL SERVICE COM1v%dSSION It was moved by Councilman Heltzer , seconded by Councilman Howard , to appoint Mr . Robert Wheelock to fill the unexpired term of Mr . Frank Boule ( deceased ) on the Police Civil Service Commission . The motion carried 6 - 0 . On motion by Councilman Heltzer , seconded by Councilman Howard , the Council recessed for ten minutes at 10 : 30 p . m . by a six yea vote . Council reconvened at 10 : 40 p . m . ( g ) DISCUSSION OF SITE SELECTION OF CENTRAL GARAGE FACILITY Mayor Thiel suggested that the matter of site selection be discussed in private with the architect to protect the City ' s bargaining position in property acquisition . The Council subsequently recessed to the jury room at 10 : 45 pm . where they received the site consideration r` report of Joel Glotter , architect . ?after some discussion , Councilman i Reynolds moved to authorize the architect to obtain a firm bid price on Site No . 7 from two independent appraisers and to authorize a 1 maximum of $ 600 expenditure for the services of the appraisers . The motion was seconded by Councilman Galinson and carried by a 361 Council Minutes , November 24 , 1969 4 . ( g ) 5 - 1 vote , Councilman Heltzer voting nay . The Council reconvened in the Council Chambe r s at 11 : 3 0 p . m . (h ) INTERVIEW OF LAW FIRMS The City Manager proposed setting date for Council interview of law firms for Saturday , December 13 and to limit presentation to 15 minutes with a total of 45 minutes allocated for individual firm interview . The Council agreed and set time for first interview to begin at 9 : 00 a . m . (i ) METROPOLITAN TRANSIT COMMISSION REPRESENTATIVE Councilman Heltzer moved to designate Mayor Thiel as Council representative to the Metropolitan Transit Commission meetings and to name Mrs . Arthur Ingersoll as alternate representative . The motion was seconded by Councilman Howard and carried unanimously . 5 . UNFINISHED BUSINESS ( a ) PROPOSED VARIANCE FROM SECTIONS 6 : 044 . 1 AND 60# 064 . 5 OF THE ZONING ORDINANCE RELATIVE TO SETBACK RELATIVE TO SETBACK REQUIREMENTS TO PERMIT A DETACHED DOUBLE GARAGE AT 8616 CEDAR LAKE ROAD ( CASE NO. 69 - 29 - VAR . ) AS DESCRIBED IN NOTICE OF HEARING PUBLISHED AUGUST 7 , 1969 ( DEFERRED FROM SEPTEMBER 8 , 1969 ) RESOLUTION NO , 3876 It was moved by Councilman Galinson , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 3876 entitled , " Resolution Granting Variance in Side Yard and Front Yard Setbacks from the Requirements of the St .
