1 . CALL TO ORDER
A regular meeting of the City Council was called to order by Mayor
Thiel at 8 : 05 p . m .
2 . INVOCATION
Invocation was given by Councilman Frank Howard .
3 . ROLL CALL
The following Councilmen were present at roll call :
Murray Galinson
Frank Howard
Richard Koch
Robert Reynolds
Leonard Thiel
Also present were the City Manager , Assistant City Manager , City
Attorney , Planning Director , Supervisor of Zoning and Inspection ,
Director of Public Works , and Secretary .
Councilman Heltzer arrived at 8 : 10 p . m . and Councilman Gravoa at
9 : 15 p . m .
4 . MINUTES
On motion of Councilman Galinson , seconded by Councilman Koch , the
minutes of the regular meet held November 3 , 1969 and special meetings
held November 7 and November 10 , 1969 , were approved by a five yea
vote , ( Councilmen Heltzer and Graves were not present ), with the
following change : on page 342 , first paragraph following conditions ,
omit " to its final stage by the time Shelard Park Development itself is
completed . "
5 . PUBLIC HEARINGS
(a ) PROPOSED PRELIMINARY PLAT OF HOMEWOOD PARK SECOND
ADDITION , 27TH AND ZARTHAN , REQUESTED BY HENRY
LA PI DES .
Mayor Thiel opened the hearing .
Iver . Malin Greenberg , representing the subdivider in the absence
of Mr . Robert Greenberg , said that he had read the report of the

Norton Neff , 2700 Xenwood and Him Hyde , 2701 Webster , expressed
concern about traffic in the area , especially on West 27th Street .
There being no one else present wishing to speak , Mayor Thiel
declared the hearing closed .
It was moved by Councilman Galinson , seconded by Councilman
Koch , to approve preliminary plat of Homewood Park Second
Addition , with the revisions suggested by the Planning Department .
The motion carried 6 - 0 . ( Councilman Graves was not present ) .
Councilman Reynolds moved that the Planning Commission initiate
a study of traffic in the area of West 27th Street , West 25 i Street ,
Vernon , and Alabama Avenue „ Councilman Howard seconded and the
motion carried with seven yeas .
(b ) PROPOSED VARIANCE AT 4104 ALABAMA AVENUE TO PERMIT
LOT FRONTAGE OF 46 FEET INSTEAD OF THE REQUIRED 75
FEET REQUESTED BY ELW OOD L . MASON ( CASE NO. 69 - 55 - VAR . ).

Mayor Thiel opened the hearing .
Mr . Elwood L. Mason , 4100 Alabama Avenue , was present urging
approval of the requested variance .
There was discussion as to whether or not this was a buildable lot
when divided , whether it would conflict with the Neighborhood Improve -
ment Plan and whether the City would want to acquire this property.
Mr . Carl Stege , 2548 Quebec expressed an indirect interest in the
property . He said he had several customers interested in the lot
and the builder would construct an attractive home if the variance
were granted .
There being no one else present interested in this matter , Mayor
3 Thiel declared the hearing closed .

Mr . Richard E . Lyngholm ,', �3F340 Xenwood Avenue , objected to
the granting of the variance because he owned the property and
did not request a variance .
Councilman Galinson explained that the Board of Zoning Appeals
decided that a variance was not necessary.
Mr . Fredrick Dodds , 2705 East 54th Street , urged approval of the
variance so that he could sell the lot as a buildable one .
It was the opinion of the City Attorney that a variance was not
necessary .
There was discussion concerning the refunding of fees to the
applicant .
There being no one else present interested in this matter ,
Mayor . Thiel declared the hearing closed .

g , (b ) REPORT OF CITY N.LANAGER CONCERNING REQUEST FOR
DUMPING - SUBURBAN READY MIX COMPANY
Councilman Galinson moved to approve the dumping with the
following conditions :
1 . That a gate be maintained to prevent " outside " or
unauthorized dumping in this area other than the
"wash concrete " product .
2 . No clumping be permitted before 8 : 00 a . m . or
after 6 : 00 p . m *
3 . If such dumping becomes a nuisance that it shall
immediately be terminated after 24 - hour notice to
the company .
4 . That such dumping be permitted for one year from
the above date to determine what effects , if any ,
occur from such dumping providing no nuisance
occurs prior to this time .
5 . Should a nuisance be declared and the dumping cease ,
that the Suburban Ready Mix Company or the property
owner be responsible to make whatever clean - up of
the area is required to eliminate the nuisance , etc .
6 . Trucks be routed from the east in and out on Cedar
Lake Road .
Councilman Graves seconded and the motion carried with seven yeas .

There being no discussion , the Mayor ordered the minutes be received
for filing .
9 . UNFINISHED APPOINTMENTS
( a ) COMMISSION APPOINTMENTS ( DEFERRED FROM NOVEMBER 3 ,
1969 ) .
Councilman Galinson explained that he was absent when the appoint -
ment procedure was discussed and agreed that the present system
could be improved and that he was open to suggestions . He
emphasized that it was his feeling that some of the finest comi
ms -
Sion members have been appointed in the past two years .
Mrs . Rose - Mary Griak was present suggesting improvements in
the appointment procedure and that it was her feeling that vacancies
occurring should be published . She said it was not her intention to
suggest that recent members appointed were not good but that a
broader range of people with a diversity of backgrounds and
opinions should be considered ,
It was the general feeling of Council that they are open to suggestions
for improvements in procedure and that they are doing their best to
make intelligent appointments , using their best possible judgment
and integrity .
Councilman Galinson moved to appoint Mrs . Hy ( Dolly ) Brandwein
to the Human Rights Commission with term expiring June 1 , 1972 •
Councilman Howard seconded the motion . After some discussion
concerning interviewing of candidates and details of procedure ,
Councilman Reynolds moved to defer to 8 : 00 pm . , November 24 ,
the appointment of three members to Human Rights Commission ,

Galinson seconded the motion which carried 6 - 114 Mayor Thiel
voting nay .
Councilman Reynolds moved appointment of Mr . James Samples
to the Human Rights Commission with term expiring June 1 , 1971 .
Councilman Howard seconded and the motion carried unanimously .
Councilman Graves moved to appoint Mr . Ron Backes to the
Building Codes Advisory Commission , with term to expire
December 31 , 1972 . Councilman Heltzer seconded and the motion
carried unanimously .
Councilman Galinson moved to appoint Mr . John Neter to the
Citizens Advisory Commission with term expiring December 31 ,
1971 . Councilman Howard seconded and the motion carried
unanimously .
10 . NEW BUSINESS
( a ) TABULATION OF BIDS - CIVIC CALENDARS 1970
It was moved by Councilman Graves , seconded by Councilman
Reynolds , to designate Associated Lithographers as the lowest
responsible bidder and accept bid in the amount of $ 5 , 479 . 20 .
Motion carried 5 - 2 , Councilman Galinson and Mayor Thiel voting
nay .
(b ) ORNAMENTAL COLUMNS
Councilman Heltzer said that a single family house on Texas
Avenue had had ornamental columns installed which supported an
awning over the front steps . He said that because this was not
covered in the code specifically that it was not allowed to remain .
Councilman Heltzer moved that staff be directed to prepare a

10 . ( c ) STREET LIGHTING PROGRAM
Councilman Heltzer moved that the six - year street lighting
program and the means to finance it be placed on the agenda
for the meeting of November 24 , Councilman Graves seconded
and the motion carried unanimously .
(d ) HIGEWAY 7 THOROUGHFARE PLAN
Councilman Reynolds moved that the Highway No . 7 Thoroughfare
Plan be considered at the meeting of November 24 . Councilman
Graves seconded and the motion carried unanimously .
(e ) PARKING PROBLEM PRIORITIES
Councilman Heltzer suggested that priorities for study by the
parking consultants be set at the meeting of November 24 . Suggested
were the Lake Street and Dakota Avenue area , Minnetonka Boulevard
and Highway 7 , and south of the service road on Wayzata Boulevard .

before the Council to discuss alleged vandalism in the area caused
