CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Thiel at 8 : 06 p . m . 2 . INVOCATION Invocation was given by Rev . V1 illard Albertson of the Prince of Peace Lutheran Church. 3 . ROLL CALL The following Councilmen were present at roll call : Murray Galinson Richard Graves James Heltzer Frank Howard Richard Koch Robert Reynolds Leonard 'Thiel Also present were the City Manager , City Attorney , Planning Director , Director of Public Works , and Secretary . Mayor Thiel left the meeting at 10 : 30 p . m . 4 . MINUTES On motion of Councilman Graves , seconded by Councilman Howard , the minutes of the special meeting held January 8 , 1969 and the regular meeting held January 13 , 1969 , were approved by a seven yea vote . 5 . PUBLIC HEARINGS (a ) PROPOSED PRELIMINARY PLAT OF Wr.STW OOD ESTATES ' FOURTH ADDITION ( WESTW OOD HILLS DRIVE AND FRANKLIN AVENUE ) - REQUESTED BY ROBERT J . MCNULTY COMPANY ( CONTINUED FROM SEPTEMBER 30 , NOVEMBER 4 , NOVEMBER 18 , DECEMBER 16 , 1968 , AND JANUARY 6 , 1969 ) . Councilman Galinson moved to defer this plat to February 3 , 1969 . Councilman Heltzer seconded and the motion carried unanimously .. 18 Council Minutes , January 20 , 1969 6 . PETITIONS , REQUESTS AND COMMUNICATIONS (a ) APPLICATIONS FOR RENEWAL OF NON - INTOXICATING MALT LIQUOR LICENSES - OFF SALE : Park Delicatessen , Inc . , 4212 West Lake Street Giller Liquors , Inc . , 4110 Minnetonka Boulevard Boulevard Delicatessen , Inc . , 7204 Minnetonka Boulevard , Councilman Koch moved to approve issuance of the above licenses . Councilman Galinson seconded and the motion carried with four yeas . ( Mayor Thiel and Councilmen Heltzer and Graves were not present ) . 7 . RESOLUTIONS AND ORDINANCES ( a ) RESOLUTION EXTENDING SYMPATHY TO THE FAMILY OF CHARLES E . SELLNER RESOLUTION NO, 3659 It was moved by Councilman Reynolds , seconded by Councilman Galinson , to waive reading and adopt Resolution No , 3659 entitled , " Resolution Extending Sympathy to the Family of Charles E . Sellner . " Motion carried with four yeas , ( Mayor Thiel and Councilmen Heltzer and Graves were not present ) . (b ) FIRST READING OF AN ORDINANCE AMENDING ORDINANCE NO, 1035 ESTABLISHING THE HUMAN RIGHTS COMMISSION It was moved by Councilman Reynolds , seconded by Councilman Galinson , to waive first reading and set second reading for February 3 , 1969 . Motion carried with four yease and Councilmen Heltzer and Graves were not present ) , Thiel (c ) SECOND READING OF PROPOSED ORDINANCE ESTAB CITIZENS ADVISORY COMMISSION AND DEFINING LISHING ITS DUTIES ORDINANCE NO. 1061 It was moved by Councilman Galinson , seconded b Reynolds , to waive second reading and adopt Ord y Councilman entitled , "An Ordinance Establishingp mance No . 1061 and Defining its Duties r � Citizens Advisory Commission Motion carried with four yeas . ( Mayor Thiel and Councilmen Heltzer and Graves were not present ) . (d ) SECOND REAriING OF PROPOSED ORDINANCE AMENDING SECTION 19 r Council Minutes , January 20 , 1969 7 . (d ) 2 : 615 OF THE ST . LOUIS PARK ORDINANCE CODE RELATING TO THE LICENSING OF DOGS ORDINANCE NO. 1062 It was moved by Councilman Galinson , seconded by Councilman Graves , to waive second reading and adopt Ordinance No . 1062 entitled , " An Ordinance Amending Section 2 : 615 of the St . Louis Park Ordinance Code Relating to the Licensing of Dogs . " Motion carried with six yeas . ( Mayor Thiel was not present ) . Councilman Galinson moved that an ordinance be prepared giving the dog catcher powers to issue complaints . Councilman Koch seconded but after discussion Councilman Galinson withdrew his motion . Councilman Graves moved that the dog catcher be given power to issue tickets . Councilman Galinson seconded and the motion carried 4 - 2 , Councilmen Reynolds and Howard voting nay . ( Mayor Thiel was not present . ) Councilman Graves moved to allow local veterinarians to issue dog licenses . Motion was seconded by Councilman Galinson and carried with six yeas . ( Mayor Thiel was not present . ) 8 . REPORTS OF OFFICERS , BOARDS AND COMMITTEES (a ) REPORT OF CITY ATTORNEY - GUN CONTROL ORDINANCE Mayor Thiel explained to people gathered in the council chambers that this matter was not a public hearing , but that people would be permitted to express their views . Councilman Galinson said that the purpose of having this matter on the agenda was for discussion purposes only and indicated the need for an ordinance at the local level if none are enacted at the state or federal levels of government. Mr . John H . Martin , 2813 Delaware S . E . , Minneapolis , Minn, . attorney for Effective Crime Control group , presented a commentary on the ordinance to the Council . He explained that he represented a group having 200 , 000 members in the state and that they would be in favor of responsible gun legislation but would not support the proposed ordinance . He felt that an ordinance should penalize the criminal use of firearms , not the sportsman . Mr . Don Galloway , 4320 Brookside , was present representing the Creekside Chapter of the Izaak Walton League . Glen Holubar , ordinance states that gun owners must be gainfully employed . He is a retired man who enj oys the sport of hunting . Mr . Robert Kriz , 102 - 12th Avenue N. , Hopkins , represented the Minnetonka Game and Fish Club . He indicated that they loapp seed any legislation that requires registration of fire arms, problem is crime control , not gun control . He said they would support legislation against criminal use of guns and that it should be applied from she state level . Mr . Bob Lang , 3527 Dakota Avenue , representing the Board of Policy of Liberty Lobby . He was opposed to the proposed ordinance and suggest severe penalties for people committing crimes by use of fire arms . Dr . William Riley , 2601 Powell Avenue , Sioux Line Club , was opposed to the proposed document in its entirety at this time . Councilman Howard moved that theordinance be deferred and that the representative to the League of Municipalities , or one of the members of the Council be placed on that committee to continue work with that group . Councilman Reynolds seconded the motion. After some discussion , Councilman Howard amended the motion to go on record to urge our legislators to do something to propose a reasonable law at the state level . Councilman Heltzer stated that he would prefer to reject than defer the proposed ordinance . After further discussion Councilman Howard withdrew his motion to defer and moved that Council support the legislation after Council has deliberated with interested groups . Councilman Reynolds seconded but this motion was also withdrawn . Councilman Howard then moVed that the proposed ordinance not be passed . Councilman Graves seconded and the motion carried 6 moo is Councilman Galinson voting nay . Councilman Howard moved that Councilman Galinson be appointed to the Hennepin League committee to come back with a report on a model law assuming that it will be passed on to the State Le gis lature . Councilman Galinson seconded , but after discussion Councilman Howard withdrew his motion. Councilman Galinson moved that a committee be formed to work with interested groups for a gun control ordinance for St . Louis park the report to be 21 Council Minutes , January 20 , 1969 8 . ( a ) returned no later than February 3 , and to be forwarded to the State Legislature . Motion failed for lack of a second . Councilman Koch indicated that -he felt some stand should be taken and that the entire decision should not be left with the state . Councilman Heltzer moved that the Mayor appoint a committee to study various state bills regarding gun control and report to the Council . Councilman Graves seconded and the motion lost 4 - 3 , Councilmen Galinson , Howard , Koch and Reynolds voting nay. (b ) MINUTES OF PARKS AND RECREATION ADVISORY COMMISSION MEETING HELD JANUARY 8 , 1969 Upon hearing no objection , President Pro Tem Howard ordered the minutes to be received for filing , (c ) REPORT CONCERNING PARKING RESTRICTIONS ON MONTEREY RESOLUTION NO, 3660 It was moved by Councilman Reynolds , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3660 entitled , " Resolution Authorizing Placement of Traffic Control Signs Regulating Parking on Monterey Drive from Excelsior Boulevard to Vilest 38th Street , and Amending Resolution No . 3201 in the Portion Thereof Referring to Said Monterey Drive . " Motion carried with six yeas . ( Mayor Thiel was not present ) . (d ) REPORT OF PLANNING DIRECTOR CONCERNING WEST 41ST STREET CUL DE SAC PROPOSAL The Planning Director explained the proposed cul de sac at the west end of 41st Street at Highway 100 , The Director of Public Works indicated that action had been requested because of a pre - trial this week on the land condemnation . Mr . Forrest Clapper , Chairman of Park Baptist Church , owners of the affected property , said that they had just heard about it this last week . He felt some parking would be lost and wanted time for further study . Councilman Reynolds suggested a letter be drafted immediately to submit to the court indicating that Council, has not had time to look into or discuss this proposal ; nor has the church , and ask for delay in the proceedings . Councilman Reynolds moved that this matter be referred to the Planning Commission for their February 5 meeting . Motion carried with six yeas . NEW BUSINESS ( a ) LICENSE FOR NON - INTOXICATING MALT LIQUOR - THE PIZZA HUT Councilman Reynolds moved that in view of the fact that Council has a committee to study licensing requirements , that this matter be deferred until a r . ; port is available . Councilman Graves seconded and the motion carried with six yeas . Mr . Wayne Vander Vort , 720 Northstar Center , attorney representing The Pizza Hut stated that the 1968 license was approved by a 5 - 2 vote and that nothing illegal had been done since The Pizza Hut was not yet in business . The City Manager indicated that the 1969 application had been received on January 20 and would routinely go to Council February 3 . It was decided to place the 1969 application on the agenda for the February 3 meeting . (b ) COMMUNITY CENTER - ARCHITECT Councilman Reynolds moved that Council consult with the architect , Graffunder , Berreau & Assoc . , on January 27 , 1969 at 8 : 30 p . m . Councilman Heltzer seconded and the motion carried 5 - 1 , Councilman Graves voting nay . ( Mayor Thiel was not present ). (c ) THE PIZZA HOUSE It was moved by Councilman Reynolds , seconded by Councilman Graves , to place the matter of the Pizza House non - intoxicating malt liquor license on the agenda for February 3 , 1969 . Motion carried 5 - 1 , Councilman Heltzer voting nay . ( Mayor Thiel was not present ) . (d ) COMMISSIONER OF AGRICULTURE The City Manager informed Council that some cities are drafting resolutions opposing the appointment of Russell Schwandt as Commissioner of Agriculture . Councilman Graves moved that a resolution be drawn opposing the appointment of Russell Schwandt as Commissioner of Agriculture . Councilman Heltzer seconded and the motion carried 5 - 1, Council - man Galinson voting nay . ( Mayor Thiel was not present ) . 24 Council Minutes , January 20 , 1969 11 . MISCELLANEOUS ( a ) DAMAGE CLAIMS 1 . E . E . Berglund , 9216 West 22nd Street 2 . Charles Williams , 5724 Goodrich ( Mrs . Wiik , 5733 Elliot Ave . ) It was moved by Councilman Graves , seconded by Councilman Reynolds , to file above claims with the City Clerk for proper action by the City Manager and City Attorney . (b ) SANITARY SEWER STUDY Councilman Reynolds explained that he and Councilman Galinson had attended the last Planning Commission meeting and a very important facto . relating to planning , building permits , etc , was discussed there . Some large projects are proposed on sewer lines already running on 9576 capacity. He suggested holding building permits and moved that Staff be instructed to report on the capacity limits of our sanitary sewer lines . Councilman Graves seconded . ( The City Manager explained that Orr - Schelen - Mayeron is studying this now and should have a report in the near future ) . Motion carried with six yeas . ( Mayor Thiel was not present ) . (c ) C OMMUNIT f CENTER INDOOR ICE ARENA Bob Mueller , 9244 West 23rd Street , presented a petition urging Council to quickly and favorably recommend to the citizens to build as part of the Community Center facility an indoor all year ice arena . Councilman Galinson suggested that the petition be filed and a copy be sent to the Parks and Recreation Director for referral to the Parks and Recreation Commission . ( d ) COMMISSION AND SUB -* COMMITTEE APPOINTMENTS Councilman Galinson moved to appoint Dr , Eugene Scherling to complete the term of A . J . Wright on the Planning Commission, Councilman Graves seconded and the motion carried with six yeas . Councilman Galinson moved to appoint Mr , Ken Born for one year to the Fire Civil Service Commission , Councilman Koch seconded and the motion carried 5 1 , Councilman Heltzer voting nay . Councilman Koch moved to appoint the following to the Minority Housing Sub - Committee of the Citizens Advisory Committee : Paul Burk , William P . Kelly , Rev , Willard Albertson , Rosalie 25 Council Minutes , January 20 , 1969 11 . (d ) Goldstein , Jeffrey Karatz , James Kirihara , Irene Nydam , Lloyd Ratkovitch , and Victor Syng . Councilman Graves seconded and the motion carried with six yeas . Councilman Graves moved to appoint Councilman Koch as ex - officio member of the Human Relations Commission. Councilman Reynolds seconded and the motion carried with six yeas . Council - man Koch moved to appoint Councilman Howard as his alternate . Councilman Graves seconded and the motion carried with six yeas . Names were drawn to determine terms for Citizens Advisory Committee members . They are as follows : 3 years William Kelly , J . M . Harper,, Don Turkington , M . Rothstein , and Jerry Rotman . 2 years H . F . Sidman , Jr . , P. D . Gubrud , Charles Barry , J . D . Moylan , and Victor Goldstein. 1 year Bruce Humphrey , Paul Burk , J . H. Glotter , Hanley Thompson , and Nancy Gamson . Councilman Koch moved to approve the drawings for terms indicated . Councilman Galinson seconded and the motion carried with s ix yeas . ( Mayor Thiel was not present ) . 12 . CLAIMS , APPROPRIATIONS , AND CONTRACT PAYMENTS ( a ) VERIFIED CLAIMS On motion of Councilman Koch , seconded by Councilman Graves , the lists of verified claims prepared by the Director of Finance and presented to the Council dated January 20 , 1969 in the total amounts of $ 7 , 402 . 42 for payroll , and $ 248 , 391 . 32 for vendors were approved , and the City Manager , City Clerk , and City Treasurer were authorized to issue checks covering same by a I six yea vote . ( Mayor Thiel was not present ) .
