Brudevold of the Aldersgate Methodist Church. Invocation was g y 3 . ROLL CALL The following Councilmen were present at roll call : Murray Galinson Richard Graves James Heltzer Frank Howard Richard Koch Robert Reynolds Leonard Thiel Also present were the City Manager , City F, ttorney , Director of Public Works and Secretary . 4 . MINUTES On motion of Councilman Galinson , seconded by Councilman Graves , the minutes of the regular meetings held December 30 , 1968 and January 6 , 1969 , and the special meetings held December 26 and December 27 , 1968 , were approved by a seven yea vote . 5 . PUBLIC HEARINGS None 6. PETITIONS , REQUESTS AND COMMUNICATIONS ( a ) APPLICATION FOR OFF SALE NON - INTOXIGA TING MALT LIQUOR LICENSES : The Park Kwik Shop , 5555 West Lake Street Shink Drug , 4801 Minnetonka Boulevard Donald A . Swanson dba Don' s Park Market , 6312 Minnetonka Blvd . Al ' s Liquor Store , 3912 Excelsior Boulevard It was moved by Councilman Graves , seconded by Councilman Howard , to approve issuance of the above listed licenses . The motion lost 4 - 31 Councilmen Galinson , Heltzer , Howard and Koch voting nay . 11 i Council Minutes , January 13 , 1969 6 . ( a ) After discussion concerning police calls , Councilman Heltzer moved approval on all but Al ' s Liquor Store . Councilman Howard seconded and the motion carried with seven yeas . Councilman Reynolds moved to appoint a committee to investigate complaints , set up uniform standards of identification and any other matters they see fit . The motion carried 5 - 2 , Councilmen Heltzer and 1-ioward voting nay . The mayor appointed Councilmen Galinson , Graves and Howard to the committee and named Councilman Galinson as chairman . Because of the appointment of the committee to investigate these matters , Councilman heltzer moved to approve issuance of the license to Al ' s Liquor Store . Councilman Graves seconded and the motion carried unanimously . ? . RESOLUTIONS AND ORDINANCES (a ) SECOND READING OF AN ORDINANCE AUTHORIZING THE TRANSFERS OF FUNDS AND PROVIDING APPROPRIATIONS FOR SALARY ADJUSTMENTS FOR YEAR ENDING DECEMBER 31 , 1969 ORDINANCE NO, 1060 It was moved by Councilman Reynolds , seconded by Councilman Koch , to waive second reading and adopt Ordinance No . 1060 entitled , "An OrdinanceAuthorizing the Transfers of Funds and Providing Appropriations for Salary Adjustments for Year Ending December 31 , 1969 . rr Motion carried unanimously . (b ) RESOLUTION DESIGNATING LEGAL NEWSPAPER FOR THE CALENDAR YEAR 1969 RESOLUTION NO, 3656 It was moved by Councilman Reynolds , seconded by Councilman Koch , to waive reading and adopt Resolution No . 3656 entitled , " Resolution Designating Legal Newspaper for the Calendar Year 1969 . " Motion carried unanimously . 8 . REPORTS OF OFFIC1RS , BOARDS AND COMMITTEES ( a ) REPORT CONCERNING IRON REMOVAL CONTRACT Councilman Reynolds moved to authorize preparation of plans and specifications for Plant No . 1 and Plant No , 6 , Councilman Graves seconded and the motion carried unanimously . 12 Council Minutes , January 13 , 1969 8 . ( c ) REPORT CONCERNING DOG LICENSE FEES AND PROPOSED ORDINANCE ENTITLED , ifA AN ORDINANCE M NDING SECTION 2 : 615 OF THE ST . LOUIS PARK ORDINANCE CODE RELATING TO THE LICENSING OF DOGS " It was moved by Councilman Reynolds , seconded by Councilman Koch, to waive first reading of ordinance and set date for second reading January 20 , 1969 . After discussion Councilman Koch withdrew his second and Councilman Reynolds his motion . After further discussion i concerning penalty for unlicensed dogs , Councilman Howard moved to waive first reading and set date for second reading for January 20 , 1969 , leaving fees as they are and having staff bring in a report on setting fines for unleashed , unlicensed dogs . Councilman Galinson seconded and the motion carried 5 - 2 , Councilman Graves and Mayor Thiel voting nay . r ( (d ) REPORT OF CITY ATTORNEY REGARDING• DISPENSERS ON PUBLIC RIGHT - OF - WAY . ? Councilman Howard moved to defer for one month . Councilman Heltzer seconded and the motion carried unanimously , r (e ) MINUTES OF HUMAN RIGHTS DECEMBER 18 , COMMISSION MEETING HELD ' 1968 . It was suggested that there be ex - officio member of the Humes an aPPomtnnent of a Councilman as an ordinance be amended . CouncRean Rights Commis Sion and that the o member be non - Graves moved that the ex• offjci Councilman VOting . His motion lost for lack of a second . (f ) MINUTES OF CITIZENS ADVISORY COMMITTEE MEETING HELD DECEMBER 12 , 1968 Upon hearing no objection , Mayor Thiel ordered the minutes to be received for filing. 9 . UNFINISHED BUSINESS ( a ) STORM SEWER EASEMENT - ELIOT VIEV; FOURTH ADDITION ( DEFERRED FROM DECEMBER 16 , 1968 ) Councilman Galinson moved to authorize City Manager to make payment of $ 1 , 500 , accept deed and authorize City Clerk to file same for record . Councilman Graves seconded and the motion carried 6 - 1 , Councilman Howard voting nay . (b ) LIQUOR HEARING Councilman Howard moved to postpone the liquor hearing for George ' s In the Park to February 13 , 1969 at 4 : 00 p . m . Council - man Graves seconded the motion , Mr . William McRostie , attorney representing George ' s In the Park , explained that there was more time needed for preparation of the case . Vote on the motion carried 5 - 2, Councilmen Heltzer and Reynolds voting nay. 10 . NEW BUSINESS (a ) COMMISSION APPOINTMENTS Mayor Thiel appointed Frank Boule to the Police Civil Service Commission, Councilman Koch moved to reappoint Mrs . Abel Cooper , Mr . Kenneth Anderson , Mr . Keith Meland and Mrs . Arthur Ingersoll to the Planning Commission , Miss Irene Nydam to the Board of Zoning Appeals ; Mrs . Rosemary Griak , Mr . Eugene Wright and Mr. Ron Berthe to the Parks and Recreation Advisory Commission ; and Mr . Dale Evans to the Building Construction Codes Advisory ' Commission . Councilman Reynolds seconded and the motion carried unanimously . It was moved by Councilman Galinson , seconded by Councilman Graves , to appoint Councilmen Heltzer and Reynolds to the Planning Commission with Councilmen Galinson and Howard as alternates . Motion carried with seven yeas . Councilman Graves moved to appoint Councilman Galinson to the Board of Zoning Appeals . MID - BLOCK STREET LIGHTING i Councilman Howard moved to install a street light in the diddle of the block on Brook Avenue between 43rd and 44th Streets within a reasonable period of time Councilman Heltzer seconded and the motion carried unanimously . (d ) SIDEMIALKS Councilman Galinson moved that the matter of plowing sidewalks for school children and criteria as to traffic volumes creating need for sidewalks for safety be referred to the Mayorts Safety Committee the first week in February, Councilman Howard seconded and the motion carried unanimously , ( e ) SPECIAL C OUNSE L - CITY OF ST , LOUIS PARK RESOLUTION NO, 3 657 It was moved by Councilman Reynolds , seconded by Councilman Howard ; to viaive reading and adopt Resolution No . 3657 entitled , " A Resolution Designating Special Counsel To The City of St . (f ) RESOLUTION NO, 3 658 It was moved by Councilman Reynolds , seconded by Councilman Graves , to waive reading and adopt resolution No . 3658 entitled , " A Resolution Designating Representative to 1969 Adjustment Panel . " Motion carried 4 - 3 , Councilmen Galinson , Heltzer and Koch voting nay . , 11 , MISCELLANEOUS (a ) DAMAGE CLAIMS 1 . Mrs . Mabel E . Danielson , 98 Hawthorne Road , Hopkins Z . Feinberg Distributing Company , 1114 Zane Avenue N. , Mpls . Councilman Howard moved to file above claims with the City Clerk for proper action by the City Manager and City Attorney. Councilman Reynolds seconded and the motion carried unanimously . (b ) PUBLIC TRANSPORTATION RATES Councilman Heltzer moved that Council direct staff to inform the Public Service Commission of their opposition to the proposed transportation rate increase . Councilman Graves seconded and the motion carried unanimously . ( c ) BASSETT CREEK COMMITTEE MEETING Councilman Reynolds moved that Councilman Galinson advise the Bassett Creek Committee that the City wishes definite action on the watershed district agreement as soon as possible . Councilman Graves seconded and the motion carried unanimously ( d ) TRANSPORT LEASING CORPORATION VS STATE OF MINNESOTA ASSESSORS Councilman Reynolds moved that Assistant County Attorney David Mikkelson be authorized to represent St . Louis Park in cooperation with the City Attorney . Councilman Craves seconded and the motion carried unanimously . ( e ) PIERCE VS CITY OF ST . LOUIS PARK Councilman Graves moved to appoint Mr . Y� enry Feikema to represent Officer Morgan in the case . Councilman Heltzer seconded and the motion carried unanimously . 16 Council Minutes , January 13 , 1969 12 , CLAIMS , APPROPRIATIONS AND CONTRACT PA YMENTS ( a ) VERIFIED CLAIMS Councilman Reynolds moved to remove Twin City Disposal from the list of payments ( $ 9 , 650 . 36 ) , Councilman Howard seconded and the motion carried unanimously . On motion of Councilman Howard seconded b Councilman Koch ' Y � the lists of verified claims prepared by the Director of Finance and presented to the Council dated January 13 , 1969 in the total amounts of $ 8 , 720 . 83 for payroll , and $ 235 , 984 . 14 for vendors were approved , and the City Manager , City Clerk , and City Treasurer were authorized to issue checks covering same by a seven yea vote . 13 . ADJOURNMENT On motion of Councilman Galinson , seconded by Councilman Heltzer , the meeting was adjourned at 10 : 35 p . m . by a seven yea vote .
