INVOCATION Invocation wasgiven by Councilman Frank Howard , 3e ROLL CALL The following Councv.o:_ en were , resent at roll call : Murray Galinson Richard Grave James Heltze Frani: Ho yard Richard Koch Robert Reynolds Leonard Thiel Also present were the Acting City Manager , Assistant City Manager , City Attorney , City Assessor , Planning Director , Director of Public Works and Secretary , 4. MINUTES On motion of Councilman Galinson , seconded by Councilman Reynolds , the minutes of the regular meeting held September 23 , 1968 were approved by a seven yea vote . 5 . PUBLIC HEARINGS (a ) IMPROVEMENT NO, 68 - 220 CONCRETE ALLEY PAVING , BETWEEN GLENHURST AND HUNTINGTO FROM FX SOUTH LOWEST 2 OF STREET '?' G FIVE FEET SOUTH AREURST , AS DESCRIBED IN LOTS 16 AND 11 , BLOCK 2 ► CED NOTICE 05% HEARING PUBLISHED S � I' TEMBER 12 AND 19 , 1968 . Mayor Thiel opened the hearing . Mr . H . Councilman Koch moved to waive reading and adopt resolution ordering the improvement and ordering preparation of plans , After discus - amending the description to include Lots 12 and 15 ' ed to defer for sion Councilman Koch withdrew the motion andmoved and 15 and make one month for further report of status of Lots a field survey to discover how far it would extend into these lots . Councilman Gal * seconded and the motion carried with seven yeas . (b ) IMPROVEMENT NO. 68 - 31 , CONCRETE. ALLEY PAVING , BETWEEN SUMTER AND TEXAS AVENUE FROM `JEST 35TH STREET TO VILEST 36TH STREET , AS DESCRIBED IN . NOTICE OF HEARING PUBLISHED SEPTEMBER 12 AND 19 , 1968 . Mayor Thiel opened the hearing , There being no one present interested in this improvement , Mayor Thiel declared the hearing closed . RESOLUTION NO. 3 607 NO It was moved by Councilman Heltzer , seconded by Councilman Graves , to waive reading and adopt Resolution No . .. 3607 entitled , " Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No . 68 - 3 .'. . ItMotion carried with seven yeas . (c ) IMPROVEMENT NO. 68 - 36 , CONCRETE ALLEY PAVING , BET ` f; EN RHODE ISLAND AND SUMTER FROM WEST 28TH STREET TO WEST 29TH STREET , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED SEPTEMBER 12 AND 199 1968 . Mayor Thiel opened the hearing Mr . Stan Currie , 2854 Rhode Island , was present in favor of the improvement . (c ) RESOLUTION NO. 3 608 It was moved by Councilman Heltzer , seconded by Councilman Galinson to waive reading and adopt Resolution No . 3608 entitled , Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No , 68 - 36 , " Motion carried with seven yeas . i (d ) PROPOSED PRELIMINARY PLAT OF ISENSEE ' S FIRST SUBDIVISION ( BETWEEN GETTYSB URG AND HILI SBORO, COUNTY ROAD 18 AND MINNEHAHA CREEK ) - REQUESTED BY EARL A . H . ISENSEE , ARTHUR J . SHASKY AND CLARA V . MCDERMOTT , Mr . Earl Isensee , 4617 Golf Terrace , was present . He indicated that he was agreeable to the proposal of the Planning Director to allow the required right - of- way along Minnehaha Creek, It was moved by Councilman Galinson , seconded by Councilman heltzer , to republish and set hearing date for October 21 , 1968 . Motion carried with seven yeas . (e ) PROPOSED PRELIMINARY PLAT OF Iii% ESTW OOD ESTATES FOURTH ADDITION (WESTW OOD HI :i.L5 DRIVE AND FRANKLIN AVENUE ) - REQUESTED BY ROBERT J . MCNULTY COMPANY . Mayor Thiel opened the hearing . Mr . Larry Cramer , 804 Builders Exchange , was present representing the subdivider . Councilman Galinson moved that this matter be referred to Parks ion for their opinion as to the location and and Recreation Commiss necessity of pedestrian walkways and return to Council for action. Councilman Graves seconded and the motion carried with seven yeas . Councilman Koch moved to continue to ca =� d with ber � seven yeast Council - man Galinson seconded and the motion 6. PETITIONS , REQUESTS AND C OMMUNICATI ONS ( a ) COMMUNICATION FROM METHODIST HOSPITAL REQ IESTGNSING �0 AMENDMENT TO ZONING ORDINANCE CONCERNING SECTION 6 : 171 . 2 . Motion carried with seven yeas . 9 . UNFINISHED BUSINESS I (a ) AWARD OF CONTRACT FOR CONCRETE RETAINING WALL, IMPROVEMENT NO. 65 - 01 (SUPPLEMENT NO. 1 ) . RESOLUTION NO* 3 609 It was moved by Councilman Howard , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 3 609 entitled , " Resolution Accepting Bid for Concrete Retaining Wall . " Motion carried with seven yeas . (b ) FINAL PAYMENT ON CONTRACT - BEATSON - KELLY , IMPROVE - MENT NO. 66 - 020 STORM SEWER ( DEFERRED FROM SEPTEMBER 23 ' 19 68 ) . Mr . Harry Mayeron of Orr - Schelen - Mayeron , consulting engineers on this project , was present to explain the over - run on the contracts he said that the over - run went into trench foundation and piling • Councilman Reynolds moved to direct Staff to bring in , by Novernber 4 , /1 1968 , a procedure for notifying Council when such over - runs On contracts are occurring .
