CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Leonard Thiel at 8 : 12 p . m . 2 . INVOCATION Invocation was given by 'Councilman Frank Howard . 3 . ROLL CALL The following Councilmen were present at roll call : Murray Calinson Richard Graves Frank Howard Richard Koch Leonard Thiel Also present were the Assistant City Manager , Acting City Manager , Planning Director , Director of Public Works and Secretary . Councilman Heltzer arrived at 8 : 33 p . m . 4 . MINUTES On motion of Councilman Howard , seconded by Councilman Koch , the minutes of the regular meeting held September 9 , 1968 , were approved by a five yea vote , with the following amendment : Page 242 , Item 9 ( b ) be changed to read : " Councilman Galinson moved to defer to October 7 , 1968 , and if no other comments were submitted by other members of Council that the City Attorney be instructed to prepare an ordinance based on Councilman Galinson ' s proposed ordinance . . . " 5 . PUBLIC HEARINGS None 6 . PETITIONS , REQUESTS AND COMMUNICATIONS (a ) NOTIFICATION OF INTENT TO HOLD A BINGO GAME - BY GEMS LUS CHESED S YNAGOGUE . Councilman Graves seconded and the motion carried with five yeas . ( Councilman Heltzer was not present ) . It was agreed that Mr . Folland would have about two months to prepare this report . Mr . Rodney E . Bernu , 3804 Crystal Lake Boulevard North , was present representing the applicant and agreed to this delay. (c ) A' P' PLICATION FOR NEW LICENSE TO SELL NON - INTOXICATING LIQUOR ON - SALE BY PIZZA HUTS , INC . It was moved by Councilman Koch , seconded by Councilman Howard , to set date for public hearing October 7 , 1968 . Motion carried with five yeas . ( Councilman Heltzer was not present . ) 7 . RESOLUTIONS AND ORDINANCES ( a ) RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESS ME!., NT . RESOLUTION NO. 3597 It was moved by Councilman Koch , seconded by Councilman Howard , to waive reading and adopt Resolution No . 3597 entitled , " Resolution Eeclaring Cost to be Assessed and Ordering Preparation of Proposed Assessment . " Motion carried with six yeas . RESOLUTION N0. 3599 It was moved by Councilman Howard , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3599 entitled , ' " Resolution Calling Hearing on Improvement Nos . 62 - 85 and 65 - 68 . Motion carried with six yeas . 8 . REPORTS OF OFFICERS , BOARDS AND COMMITTEES ( a ) MINUTES OF TIL'E PARKS AND RECREATION COMMISSION MEETING HELD SEPTEMBER 11 , 1968 . � y3f�6 Councilman Koch brought to the attention of the Council that there ' I is no provision in the budget for planting on Twin Lakes Park and 27th and Dakota . Upon hearing no objection , Mayor Thiel ordered the minutes to be received for filing . (b ) REPORT OF THE PLANNING COMMISSION ( CASE. NO. 67 - 45 - Z . ) RECOMMENDING UNFAVORABLY UPON THE REQUEST OF JOHN AND DOROTHY WINTER TO CI ANGE THE ZONING NORTH OF MINNETONKA BOULEVARD ON THE CAST AND WEST SIDES OF THE VACATED MONTEREY AVENUE FROM R - 1 TO R - 4 . Mrs . Fern Halvorson of Eberhardt Realty Co . , 5307 Vernon -Avenue ► was present representing the applicant . She requested that the matter be tabled . Councilman Koch moved to table and Councilman Galinson seconded * After some discussion Councilman Koch withdrew his motion , but at the request of the applicant , again moved to table . Councilman Galinson seconded and the motion was defeated 3 - 2 , Councilmen Howard and Graves voting nay . Councilman Howard moved to deny . Councilman Heltzer moved to reconsider . Councilman Howard seconded and the motion carried 5 - 1 , Councilman Koch voting nay . RESOLUTION NOc 3600 It was moved by Councilman Howard , seconded by Councilman Calinson , to waive reading and adopt ilesolution No . 3600 entitled , " Resolution Amending Resolution No . 2688 Granting Permit Under Section 6 : 082 1 of the St, Louis Park Zoning Ordinance for Off - Street Parking " Motion carried 4 - 2 , Councilmen Graves and Koch voting nay. Mr . Irving Aaron , 2920 Maryland Avenue , was present in opposition to the special permit and presented the Council with a list of written complaints against the previously granted special permit . The Mayor assured Mr . Aaron that he would receive a report from staff in writing on each complaint . (d ) REPORT OF PLANNING COMMISSION RECOMMENDING FAVORABLY TO AMEND AN APPROVED SPECIAL PZRMIT UNDER SECTION 6 : 176 . 2 OF THE,* Z ONING ORDINANCE. FOR A COMMERCIAL DEVELOPMENT UNIT IN A B - 2 DISTRICT AT HIGHWAY 100 AND HIGHWAY 12 ( CASE NO" 68 - 42 - S . P . ) - REQUESTED BY ONE HUNDRED TWELVE , INC . Mr , Waite D . Durfee , 510 Baker Building ; was present representing the applicant and explaining their request . The Planning Director explained the request was for an additional building . RESOLUTION NOs 3601 It was moved by Councilman Howard , seconded by Councilman Graves , 252 r Council Minutes , September 16 , 1968 8 . (d ) to waive reading and adopt Resolution No . 3 601 entitled " Resolution Amending Resolution No . 2927 Granting Permit under Section 6 , 176 . 2 of the St . UNFINISHED BUSINESS ( a ) PROPOSED PRE; LIMINAR Y PLAT OF FOURTH COUNTRY CLUB ADDITION OF WS TVi� OOD HILLS ( UTAH AVENUE , UTAh� DRIVE AND 18TI-I STR SET ) REQUESTED BY ROBERT J . MCNULT V CO. ( CONTINUED FROM AUGUST 19 AND SEPTEMBER 9 , 1968 ) . On motion of Councilman Galinson , seconded by Councilman Graves , this matter was deferred to October 7 , 1968 . Motion carried with six yeas . (b ) SITE FOR NEW CO &IMUNIT Y CE: NTE .i-1 COMPLEX ( DEFERRED FROM JULY 15 AND 22 , 1968 A- ND SEPTEMBER 9 , 1968 ) . This matter was discussed at a meeting beginning at 6 : 00 p . m . to which the Parks and Recreation Commission and the public were invited . Messrs . Walton , Berthe , Lifson , Middleton and Wright and Mrs . Griak of the barks and Recreation Commission were in attendance . Also present were the Director of Parks and Recreation ? Chief of Police and the architect , Mr . Graffunde r . Mr . Graffunder reviewed the preliminary plans and summarized the preliminary studies which had been done by the architect ' Mayor Thiel thanked all of those who worked so diligently to make recommendations for the new community center . He gave his opinions as to the advantages and disadvantages of various sites f concluding that he felt Wolfe Park to be the best choice for a site because of its size , accessibility and possibilities for future develop ' meet . He also indicated that he felt this to be a good location for housing for the elderly . After questioning the architectPark nadequacies as to size and prob Council decided that Carpenter be eliminated because of its Council with condition of the ground as ascertained by soil borings . After further discussion with the Staff and the Parks and Recreation Commission members , Councilman Galinson moved that the site designated for the new community center be Aquila Park as recommended by the Parks and Recreation Commission, Councilman Koch seconded and the motion lost because of a tie vote of 3 - 3 , Councilman Graves , Howard and Thiel voting nay . Councilman Koch moved that Wolfe Park be designated as the site g � for the new community center . Councilman Howard seconded and the motion carried 6 - 0 . Councilman Koch moved to call a referendum in first two weeks in March. Councilman Howard seconded and the motion carried 6 - 0 . Councilman Howard moved that the entire complex be designed as recommended by the Mayor ' s Subcommittee and the Parks and Recreation Commission . Councilman Meltzer seconded . It was agreed that they are going to be considering the cost of an outdoor pool as opposed to a covered pool and the cost of an artificial ice rink with cover as opposed to a natural ice rink and cover . Motion carried with six yeas . Councilman Graves moved that Graffunder be named the architect for this project . Councilman Howard seconded but after some discussion Councilman Graves withdrew his motion . 10 • NEW BUSINESS ( a ) PROPOSED CHANGE ORDER NO. 1 TO STORM SEWER CONTRACT p ;� OJECT NO. 65 - 68B TO WITH G . (b ) EXTEND COMPLETION DATE . It was moved by Councilman Graves , seconded by Councilman Howard , to approve and to authorize the City Manager to execute . Motion carried 5 - 1 , Councilman Koch voting nay . 11 . MLSCE LLANE OUS (a ) DAMAGE CLAIMS 1 . Mr . & Mrs . Ruben Zlotnick , 2607 Inglewood Avenue . It was moved by Councilman Graves , seconded by Councilman Meltzer , to file the above claim with the City Clerk for proper action by the City Manager and City Attorney . Motion carried with six yeas . 12 . CLAIMS , A. PPR OPIRIATIONS AND CONTRACT PAYMENTS On motion of Councilman Graves , seconded by Councilman heltzer , the meeting was adjourned at 9 : 42 p . m . by a six yea vote . Leon rd J .
