CALL TO ORDER A regular meeting of the City Council was called to order by President Pro Tem Howard at 8 :09 p. m . 2 . INVOCATION P In vocation was given by Rev. President Pro Tem Howard opened the hearing . Kenneth Anderson , 3737 Oregon Avenue , was present to request a deferment . On motion of Councilman Galinson , seconded by Councilman Graves , the hearing was continued to August 26 , 1968 . Motion carried with four yeas . ( Councilman Heltzer was not present ) . 6. Graber of Twin City Lines was present to answer questions concerning the additional busses * - Mr . Bob Martin , Acting City Manager , explained the routing of the busses . RESOLUTION NO. 3565 It was moved by Councilman Graves , seconded by Councilman Koch , to waive reading and adopt Resolution No . 3565 entitled , " Resolution Granting Approval for the Adding of Four Busses Operating on Route 21 and Extending Route 21 from Lake and Hennepin in Minneapolis , Along Minnetonka Boulevard to Highway 100 , to Cedar Lake Road Underpass , to Vernon Avenue , to Gamble Drive , and Return. RESOLUTIONS AND ORDINANCES ( a ) RESOLUTION ACCEPTING PARTIAL COMPLETION OF WORK AND AUTHORIZING CASH BOND FOR REMAINDER , MONTEREY ADDITION RESOLUTION NO. 3566 It was moved by Councilman Graves , seconded by Councilman Koch, � 3566 entitled , " Resolution to waiveon No reading and adopt Resolutia Authorizing Cash Bond Accepting Partial Completion of Work an for Remainder Monterey Addition* ifMotion carried with five yeas , (b ) RESOLUTION AUTHORIZING PLACEMENT OF TRAFFIC CONTROL SIGNS REGULATING PARKING RESOLUTION NO. 3567 It was moved by Councilman Galinson , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3567 entitled , " Resolution Authorizing Placement of Traffic Control Signs Regulating Parking . " Motion carried with five yeas . (c ) RESOLUTION AUTHORIZING PLACEMENT OF YIELD RIGHT OF WAY SIGNS FOR TRAFFIC CONTROL AT INTERSECTION OF WEBSTER XENWOOD AND YOSEMITE AVENUES UTICA , VERNON , , -' ' BEFORE ENTERING 27TH STREET , Mr . Walter Klinefelter , 2701 Xenwood Avenue , was present favoring a four-way stop sign at 27th Street and Xenwood Avenue . RESOLUTION NO, 3 ,568 It was moved by Councilman Graves , seconded by Councilman Galinson to waive reading and adopt Resolution No . 3568 entitled , " Resolution Authorizing Placement of Yteld Right of Way Signs for Traffic Control at Intersection of Utica , Vernon , Webster , Xenwood , and Yosemite Avenues Before Entering 27th Street . " Councilman Koch moved to amend the resolution to install two - way stop signs on Vernon , Webster and Xenwood Avenues controlling north and south bound traffic . Councilman Graves seconded . Councilman Koch further amended the resolution to install a four - way stop at 27th and Xenwood . The vote on the resolution as amended carried with four yeas . ( Councilman Heltzer was not present ) . Councilman Galinson moved that the Mayor ' s Safety Committee set up a criteria for stop signs . Councilman Graves seconded and the motion carried with four yeas . " ORDINANCE NO, 1040 It was moved by Councilman Galinson , seconded by Councilman Koch , to waive reading and adopt Ordinance No . 1040 entitled , "An Ordinance Amending Ordinance No . 974 Passed July 5 , 19661 Entitled ' An Ordinance Authorizing Sale by the City of Houses at 4545 and 4531 West 38th Street and the City Owned Property Between Quebec and Rhode Island on Minnetonka Boulevard ' . (c ) REPORT OF THE PLANNING COMMISSION ( CASE NO. 68 - 20 - Z . ) RECOMMENDING UNFAVORABLY UPON THE REQUEST OF ROBERT L . JOHNSON TO REZONE PROPERTY AT 2718 VIRGINIA AVENUE FROM R - 1 TO R - 4 AND RECOMMENDING THAT THE LAND BE PURCHASED BY THE CITY FOR PARK PURPOSES . 206 Council Minutes , August 52 1968 8 . c Mr . Christ NiHopkins , was present esen , 551b County Road 18 , ( ) representing R . L. Johnson and indicating that multiple zoning was , in the applicant ' s opinion , the best use of the land . Councilman Galinson expressed opposition to rezoning this property . Councilman Koch requested a valuation from the City Manager of the property at the time of the public hearing . It was moved by Councilman Graves , seconded by Councilman Galinson , to set date for public hearing on August 19 , 1968 . Motion carried with four yeas . ( Councilman Heltzer was not present ), (d ) REPORT OF THE PLANNING COMMISSION RECOMMENDING FAVORABLY UPON THE REQUEST OF ROBERT L . JOHNSON (CASE NO. 68 - 21 - Z . ) TO REZONE PROPERTY AT 8008 WEST 28TH STREET FROM R � 3 TO R - 4 . It was moved by Councilman Galinson , seconded by Councilman Graves , to set date for public hearing on August 19 , 1968 . Motion carried with four yeas . ( Councilman Heltzer was not present ). (e ) REPORT OF THE PLANNING COMMISSION ( CASE NO . 68 - 24 - MISC . ) RECOMMENDING UNFAVORABLY ON THE REQUEST OF M . G . ASTLEFORD AND THE PARK BUS COMPANY TO AMEND THE B - 3 LIMITED INDUSTRIAL DISTRICT BY ADDING " BUS GARAGE " AS A PERMITTED USE . It was moved by Councilman Heltzer , seconded by Councilman Graves , to table this item . Motion carried with five yeas . (f ) REPORT OF THE PLANNING COMMISSION ( CASE NO. 68 - 33 - S . P * ) RECOMMENDING UNFAVORABLY UPON THE REQUEST OF JOHN F . BUREAU FOR A SPECIAL PERMIT TO PERMIT A DRIVE " IN RESTAURANT IN A B - 2 , GENERAL BUSINESS DISTRICT , AT 4335 EXCELSIOR BOULEVARD, Mr . Timothy P . Quinn , Attorney , 145 University Avenue , St . Paul , was present representing the applicant . Mr . Ted Yock , 1420 N . Pascal , St . Paul , was also present to explain technicalities of the operation of the roast beef operation . There was discussion between Mr . Quinn and the City Attorney as to definitions of special permit , variance and rezoning . R After some discussion as to nuisance of traffic and odors , Councilman Koch moved to deny . Councilman Graves seconded and the motion lost ,3 - 1 , Councilman Galinson voting nay , ( Requires 4 votes to pass ) . (h ) REPORT FROM THE BOARD OF ZONING APPEALS ( CASE NO. 68 - 35 - VAR . ) RECOMMENDING FAVORABLY WITH CONDITION UPON THE REQUEST OF WEST SUBURBAN BUILDERS , INC . FOR VARIANCE FROM THE PROVISIONS OF SECTION 6 : 064 . 5 OF THE ZONING ORDINANCE TO PERMIT A REAR YARD DEPTH OF 20 FEET INSTEAD OF THE REQUIRED 35 FEET AT 2224 SOUTH HILL LANE . It was moved by Councilman Koch , seconded by Councilman Graves , to set date for public hearing on August 19 , 1968 . Motion carried with four yeas . ( Councilman Heltzer was not present ) . 9 • UNFINISHED BUSINESS (a ) APPOINTMENTS TO BOARDS AND COMMISSIONS ( DEFERRED FROM JULY 1 , 15 AND 221 1968 ) 9 It was moved by Councilman Graves , seconded by Councilman Koch , to defer this item to August 12 , 1968 • Motion carried with five yeas . (b ) RECOMMENDATIONS OF NSAYOR ' S SAFETY COMMITTEE CONCERN - ING TRAFFIC CONTROL AT 16TH AND 18TH STREETS AND COLORADO AVENUE , Mr . Melvin Dass , 1656 Colorado Avenue , was present to express his agreement with the Mayors Safety Committee recommendations . Councilman Galinson moved that the items as recommended by the Committee be referred as follows : 208 : t Council Minutes , August 51 1968 9 . (b ) 1 . Trim brush and trees in the areas so that the stop signs are clearly visible to all motorists - referred to the Department of Public Works , 2 . Resolution to prohibit parking on the east side of Colorado and between 18th Street and Cedar Lake Road - referred to Department of Public Works . 3 . Recommendation for consideration of a playground for this area - referred to Parks and Recreation Commission , 4 . Feasibility report on the area in regard to widening Colorado Avenue and placing guard rails along the east side of the road , as a barrier between the roadway and railroad track - referred to Department of Public Works . 10. Councilman Koch seconded and the motion carried with four yeas . (Councilman Heltzer was not present ) . (c ) PROPOSED STUDY OFSANITARY SEWER SYSTEM ON THE SOUTH SIDE OF ST . LOUIS PARK - PROJECT 68 - 25 - M. & C . No . 68 - 25 ' ( DEFERRED FROM JULY 29 , 1968 ) . The City Engineer described the proposed study and explained the need for the project because of capacity being used and possibly soon to be exceeded . He also explained that Hopkins has engaged Orr - Schelen- Mayeron to study their needs for relief. After discussion about the cost of the study and questions concerning its urgency , Councilman Galinson moved to defer to August 12 , 1968 and to have the consulting engineer present at that meeting . Council man Graves seconded and the motion carried with fivey eas . (d ) REPORT OF CITY MANAGER CONCERNING ADJUSTMENT PURCHASE OF PROPERTY FROM J . VGLEAS ON RRED FROM JULY 15 AND 29 , 1968 ) . . NZW BUSINESS 1 I (a ) PROPOSED SALE OF BONDS ( M & C No . 68 - 26 ) Councilman Heltzer moved and Councilman Koch seconded , to authorize and direct Staff to prepare the necessary resolutions in connection with the sale of 1968 bonds and to employ the firm of Piper , Jaffray & Hopwood to act as consultants in connection with this bond issue at a fee not to exceed $ 6 , 000 in accordance with their offer , as included in M. & C . No . 68 - 26 , and * the Mayor and Acting City Manager were authorized to sign such agreement. Motion carried with five yeas . (b ) RESOLUTION GRANTING TEMPORARY USE OF CITY PROPERTY , REQUEST OF JAYCEES FOR USE OF OAK HILL PARK FOR KIDDIE CARNIVAL RESOLUTION NO. 3570 It was moved by Councilman Graves , seconded by Councilman Gallnson to waive reading and adopt Resolution No . 3 .570 entitled , " Granting Temporary Use of City Property .
