Don Turkington , 3232 Xenwood , indicated that he was originally concerned about the school but now that he had heard more about its operation he would not be in opposition to it . F : After discussion as to whether the use could be considered a home occupation the City Attorney informed the Council concerning the requirements that would qualify it as a home occupation which are : residing in the dwelling , conducting business in one room of the principal structure , evidence of it not viB�ble from the street , uses equipment usually found in the home aiui not. involving sale of products manufactured off the site . Councilman Reynolds moved to file the communication . The motion was seconded by Councilman Galinson . After further discussion Councilman Reynolds withdrew his motion stating that he felt at the time the motion was made it could be justified as a home occupation but since then had come to the conclusion that it is an illegal use . f Councilman Graves moved to file the communication . Councilman Galinson seconded and the motion lost 5 - 2 , Councilmen iieltzer , Howard , Koch , Reynolds and Thiel voting nay . Councilman howard moved to reconsider . This motion was seconded by Councilman Graves and carried with seven yeas . After more deliberation it was moved by : ouncilman Reynolds , seconded by Councilman Graves , to table the matter until later in the meetings Motion carried with seven yeas . Later in the meeting it was moved by Councilman Reynolds , seconded by Councilman toward , to remove the matter from the table . N= ohon carried with seven yeas . RESOLUTION NC. 3584 It was moved by Councilman Graves , seconded by Councilman Reynolds to waive reading and adopt resolution entitled , " Resolution Receiving Reports and Calling hearing on Improvement No . 68 - 46 . Virgil Nietzel of School Bus Company op barricades on school bus his views regarding the effect of streetprinted and in the routingand the fact that schedules were already barricade at 36th Street and hands of the parents . LOUIS PARK Councilman rioward moved that the stipulation be filed and that the Mayor be authorized to retain an attorney to defend the suit . Councilman Heltzer seconded and the motion carried with seven yeas . (c ) RESOLUTION GRANTING PE' RMtIT UNDZe, R SECTION 6 : 049 . 8 OF TFE ST . LOUIS PARK ZONING ORDINANCE FOR RECLAMATION OF LAND BY ThE MINNEAPOLIS GOLF CLUB ( CASE NO. 67 - 18 - S . P . ) Mr . Stanley Barton , 9301 West Franklin , stated that the neighbors would not object to the project as long as conditions of the special permit are enforced . He suggested a performance bond in order to aid in this enforcement . The City Attorney indicated that a performance bond could not be made a condition of the special permit. Mr . John Carroll , 1210 First National Bank , representing the Minneapolis Golf Club , indicated he had receive d a copy of the conditions contained in the special permit . RESOLUTION NO, 3585 It was moved by Councilman Reynolds , seconded by Councilman Graves , to waive reading and adopt Resolution No , 3585 entitled , " Resolution Granting Permit Under Section 6 : 049 . 8 of the St . Louis Park Zoning Ordinance for Reclamation of Land, " motion carried with seven yeas . Council urged that Staff make regular inspections of this operation. 10 . NEV? BUSINESS ( a ) PROPOSED AMENDMENT TO GARBAGE CONTRACT Councilman C'alinSon moved to approve an May or d to authorize the Y and City Manager to execute on behalf of the City . MENT GR IMPROV ^ Councilman G alinson moved that grading and seeding that portion of Ford Park that can be done this fall be authorized . (b ) Councilman Galinson moved to have final plans for Ford Park presented to the Parks and recreation Commission and to the Village of Minnetonka and for the Parks and recreation Commission to discuss these plans and give their recommendations to the Council . Councilman Howard seconded and the motion carried with sevenY eas . ( c ) APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZING ADVER TISEM NT FOR BIDS IMPROVE IV- 7, NT NOS . 68 - 16 , 68 - 171 62 - 65 AND 68 - 46 . RESOLUTION NO, 3586 It was moved by Councilman Graves , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 3586 entitled , " Resolution - Approving Plans and Specifications and Authorizing Advertisement for Bids Improvement Nos . 68 . 16t 68 - 17 , 62 - 65 and 68 - 46 . " Motion carried with seven yeas . (d ) EMPLOYEE APPOINTMENTS It was moved by Councilman Graves , seconded by Councilman Howard , to consent and approve the following employee appointment : Jerrold Martin , Probationary Patrolman , PS2A , effective September 3 , 1968 . i Motion carried with seven yeas . NT Councilman Heltzer moved to direct Staff to look into the desirability of hiring a traffic consultant and , if it appears in their estimation , that it could serve some use , to indicate in addition when they feel it would be the most effective time to employ these consultants and what scope of study they would usefully be involved in , with report to Council on September 9 , 1968 • Councilman Reynolds seconded and the motion carried with seven yeas . E (f ) DOG CONTROL ANL SANITATION PROBLEMS Mrs , Shirley Latz , 8306 Virginia Circle South , was present indicating I that she has for some time had a problem with dogs tipping over ? garbage cans and littering her property and adjoining properties ounci with garbage . She urged Cl to provide better control and more efficient enforcement of the dog leashing ordinance , Mayor Thiel asked that B & E Patrol be requested to make two stops two different evenings , one around midnight and one at five or six in the morning to pick up any stray dogs in that vicinity. 234 "— i Council Minutes , August 26 , 1968 11 .
