LOUIS PARK , MINNESOTA 68 August i z , 19 1 , CALL TO ORDER City Counci regular meeting of the l was called to order by Mayor A g Thiel at 8 : 02 P . m . 2 . INVOCATION f Invocation was given by Mr . Peter Cotton , Assistant to the City Manager . 3 . ROLL CALL The following Councilmen were present at roll call : 1 I Murray Galinson Richard Graves James Heltzer Richard Koch Robert Reynolds i Leonard Thiel J Councilman Howard arrived at 9 : 25 Pam . and Councilman Galinson left the meeting at 10 : 17 Pam * 1 Also present were the Acting City Manager , Assistant City Manager , f City Attorney , Planning Director , Assistant City Engineer , City Assessor and Secretary. I 4 . MINUTES On motion of Councilman Koch , seconded by Councilman Reynolds ► the minutes of the regular meeting held August 5 , 1968 , were approYed by a six yea vote . 5 . PUBLIC HEARINGS + None 6 . PETITIONS , REQUESTS AND COMMUNICATIONS , (a ) REQUEST OF SAM SEGAL REGARDING PARKING REQUIOWTS FOR APARTMENT BUILDING AT 3200 VIRGINIA AVENUE t (SPECIAL PERMIT GRANTED _ CASE NO . 68 - 10 - S . 1' • ) • I Mr ., Sam Segal , 2512 Inglewood Avenue present resent requestin8 I 213 council Minutes , August 12 , 1968 that Council allow him to have less parkin by the special permit granted to him g spaces than required design . He indicated that the square footage to change the building would not be changed , otage of the building Councilman Koch moved to table the item until later in evening to give the Planningthe Director an opportunity to see the revised plans . Councilman Reynolds seconded and the motion carried with six yeas . ( Councilman Howard was notresent . P � Councilman Howard arrived at the meeting . Councilman Graves moved to take the item from the table . Councilman Reynolds seconded and the motion carried with seven yeas . After conferring with Mr . Segal , the Planning Director concluded that he and the Building Inspector would need time to study the proposed changes . Councilman Koch moved to defer the matter to August 19 with reports from the Planning Director and Building Inspector . The motion was seconded by Councilman Reynolds and carried with seven yeas . 7 . RESOLUTIONS AND ORDINANCES (a ) FIRST READING OF ORDINANCE AUTHORIZING SALE OF MUNICIPAL LIBRARY TO HENNEPIN COUNTY. It was moved by Councilman Reynolds , seconded by Councilman Koch , to defer to August 19 . Motion carried with seven yeas . 8 • REPORTS OF OFFICERS , BOARDS AND COMMITTEES (a ) PRELIMINARY REPORT OF THE DIRECTOR OF PUBLIC WORKS AND ASSESSMENT REPORT WITH RESPECT TO THE FOLLOWING IMPROVEMENTS : 1 , Imp . No . 68 - 29 , concrete curb and gutter , part of south side of West 41st Street from Natchez Avenue to Quentin Avenue , 2 . Imp . No . 68 - 409 sidewalk , part of the south side of West 41st Street from Natchez Avenue to Quentin Avenue . 6 , between Georgia 30 Imp . RESOLUTION mm NO. 3574 ` It was moved by Councilman Heltzer , seconded by Councilman Reynolds , to waive reading and adopt Resolution No . 3574 entitled , " Resolution Receiving Reports and Calling Hearing on Improvement Nos . 68 - 29 , 68 - 40 , 68 - 32 , 68 - 37 and 68 - 39 . " Motion carried with seven yeas . Councilman Reynolds moved that a report be brought in by September 9 on the feasibility of permanent paving of 41st Street from Natchez to Quentin and concrete curb and gutter and sidewalk on the north side of 41st Street from Natchez to Quentin. Councilman Graves seconded and the motion carried with seven yeas , (b ) REPORT OF PUBLIC SAFETY COMMITTEE REGARDING POLICE PERSONNEL Councilman Reynolds explained the needs for police personnel and answered questions concerning the committee ' s report. Councilman Reynolds moved that there be four men added to the police force in 1968 and an additional four men in 1969 . Councilman Graves seconded . Councilman Heltzer moved to amend the motion to say that there be five men added in 1968 and five additional men in 1969 . Council - man Graves seconded . Councilman Reynolds changed his original motion to a minimum of four men added in 1968 and a minimum of an additional four men in 1969 . The vote taken on the amendment to the motion of five men in 1968 and five men in 1969 carried 4 - 32 Councilmen Galinsont Reynolds and Thiel voting nay . Vote on the original motion as amended carried 6 - 1 , Mayor Thiel voting nay . Council requested a report from the City Manager concerning budgetary effects of the recommendations of the committee . 215 Council Minutes , August 12 , 1968 9 . UNFINISHED BUSINESS ( a ) REQUEST OF J Ol-iN F . BUREAU FOR PERMIT ADRIVE - IN RESTAURANT A SPECIAL PERMIT TO � IN A B - 2 , GENERAL BUSINESS DISTRICT AT 4335 EXCELSIOR BOULEVARD * FROM AUGUST 5 , 1968 ) , ( DEFERRED Mr . Timothy Quinn , 145 University Avenue , St . Paul ; Mr , Ted Yoch , 1420 N . Pascal , St . Paul and Mr . Peter Zimmerman 3843 Glenhurst Avenue , were present representing the applicant . They explained the nature of the operation and answered questions concerning it . After discussion as to what constitutes a drive - in , Councilman Graves moved to deny the special permit . Councilman Heltzer seconded and the motion carried 4 - 2 , Councilmen Reynolds and Galinson voting nay . ( Councilman Howard was not present ). Councilman Galinson moved that an immediate study be made to determine whether eating establishments on Excelsior Boulevard are operating without special permits or operating illegally, with a report returned within one month . Councilman Heltzer seconded . It was the City Attorney' s feeling that a drive - in should be more clearly defined . Council should study the definition of drive - in rather than pursue the fact of whether it is legal or illegal under the present interpretation. Councilman Galinson withdrew his motion and moved instead that this matter be placed on the agenda two weeks hence with a report from staff as to what staff feels the term means . Motion was seconded by Councilman Koch and carried 5 - 1 , Councilman Reynolds voting nay. ( Councilman Howard was not present . ) (b ) APPOINTMENTS TO BOARDS AND COMMISSIONS ( DEFERRED FROM JULY 1 , 15 AND 22 AND AUGUST 5 , 1968 ) . It was moved by Councilman Reynolds , seconded by Councilman Graves , to consent and approve the following appointments to the Citizens Advisory Committee : Charles Barry William P. Kelly Paul Burk J . Dudley Moylan Nancy J . Gamson Marvin Rothstein Joel H . Glotter Jerry F. Rotman Victor Goldsteen Howard F. Sidnam , Jr . Paul D. Gubrud Hanley Thompson J . M . David Barker , Chairman of Board of Zoning Appeals , was present reminding Council of the two vacancies on the Board and urging the replacement of Ed Baker with a person with similar qualifications . (c ) PROPOSED STUDY OF SANITARY SEWER SYSTEM ON THE SOUTH SIDE OF ST . LOUIS PARK - PROJECT 68 - 25 ( DEFERRED FROM JULY 29 AND A. UGU'3T 5 , 1968 ) . Councilman Howard moved to approve and to authorize the Mayor and City Manager to execute the necessary agreement . Council _ man Graves seconded but no vote was taken on the motion . Mr . Harry Mayeron of Orr - Schelen - Mayeron was present to explain the need for the study and answer questions concerning it . After discussion of the need for the study and its urgency , Councilman Howard moved to defer the matter for 90 days . Councilman Graves seconded and the motion carried with six yeas . ( Councilman Galinson was not present . ) (d ) EXTENSION OF COUNTY ROAD 18 Councilman Galinson made the following motion : WHEREAS , the extension of County Road 18 from County Road 5 to 36th Street will help to alleviate a very serious traffic and safety problem which now exists in the City of St . Louis Park , and WHEREAS ) the HennepinCounty Board of Commissioners after due investigation and consideration has seen fit to authorize the construction of 1 / 2 of the permanent pavement section of County Road 18 from County Road 5 to 36th Street with temporary exten - siy Road 5 i ons to the ramp ends at Count p this safety and traffic hazard n order to alleviate Council of St NOT r WHEREFORE , The city • Louis Park does hereby urge and request the Hennepin County Board of tCo rnmissioners to cause the construe ' ion of said portion of County Road 18 to b than November 1 , 19680 a completed no later Councilman Graves seconded and th yeas , emotion carried with seven ( e ) MA.
