CALL TO ORDER A regular meeting of the City Council was called to order by President Pro Tem Howard at 8 :05 p . m . 2 . INVOCATION Invocation was given by Rev . Douglas Norris of the Aldersgate Methodist Church . ROLL CALL The following Councilmen were present at roll call : Murray Galinson Richard Graves James Heltze r Frank Howard Richard Koch Councilman Reynolds arrived at 8 : 10 p . m , Also present were the Acting City Manager , Assistant City Manager , City Attorney& Planning Director , Director of Public Works , Supervisor , y Assessor and Secretary, of Zoning and InspectionCitAsses , p , l y 4 . PUBLIC HEARINGS (a ) PROPOSED OVERRULING OF THE INTERPRETATION ZONING ORDINANCE , SECTION 6 : 074 , PERTAINING TO THE ( CASE NO . 68 - 27 - INT . ) - REQUESTED BY TALMUD TORAH O SETBACK AS DESCRIBED IN NOTICE OF HEARING PUBLISHED ULYAND 1968 . JULY 18 , President Pro Tem Howard opened the hearing , Mr . Carl Lifson , Attorney , 1606 Cargill Buildin representing Talmud Torah. gp Was present Mr . Bill Thibault , Planning Director , explained the request the visual aids he had prepared for the Board of Zoning App , using g Appeals . 197 cc Minutes , July 29 , 1968 � (a ) Mr . Lifson explained his interpretation of the Zoning Ordinance with respect to definitions of lot lines , front yards , side yards and rear yards . He gave a comprehensive report on the history of the land , its ownership and development . He also presented a letter from owners adjacent to the property indicating they had no objection to his request . President Pro Tem Howard declared the hearing closed , Councilman Koch moved to overrule the decision of the Zoning Administrator and direct issuance of building permit with respect to side lot line , this being defined as 15 feet from the property line , Councilman Graves seconded and the motion carried with six yeas . (b ) PROPOSED VARIANCE FROM SECTION 6 : 094 . 4 OF THE ZONING ORDINANCE TO PERMIT A MINIMUM LOT AREA OF 1 , 625 SQUARE FEET INSTEAD OF THE REQUIRED 1 , 700 SQUARE FEET PER DWELLING UNIT AT 1349 JERSEY AVENUE , AS PUBLISHED IN IN NOTICE OF HEARING JULY 18 , 1968 ( CASE NO. 68 - 30 - VAR . ) - REQUESTED BY H . C . AND MINA LANG. President Pro Tem Howard opened the hearing . The applicant was not present . Mr . Dennis ' E . Nillson , 1413 Jersey Avenue , questioned the parking requirements for this building and voiced his objection to the parking by residents on adjacent streets , especially during winter . President Pro Tem Howard declared the hearing closed . It was moved by Councilman Galinson , seconded by Councilman st for variance . Motion carried with Reynolds , to deny the reque six yeas . " Motion carried Lake Road onto Gamble Drive in St . Louis with six yeas . f 198 Council Minutes , July 29 , 1968 7 . RESOLUTIONS AND ORDINANCES ( a ) FIRST READING OF AN ORDINANCE AMENDING ORDINANCE NO, 974 ENTITLED , " AN ORDINANCE AUTHORIZING SALE BY THE CITY OF HOUSES AT 4545 AND 4531 WEST 38TH STREET AND THE CITY OWNED PROPERTY BETWEEN QUEBEC AND RHODE ISLAND ON MINNETONKA BOULEVARD. " It was moved by Councilman Graves , seconded by Councilman Koch , to waive first reading and set date for second reading August 5 , 1968. Motion carried with six yeas . Councilman Galinson voted in favor of amending the ordinance but stated he was not acquiescing to the original sale of the property because he had no knowledge of it , 8 . REPORTS OF OFFICERS , BOARDS AND COMMITTEES (a ) QUARTERLY ACTIVITY REPORT - SECOND QUARTER 1968 . Upon hearing no objections , the report was ordered by President Pro Tem Howard to be received for filing . (b ) PROPOSED STUDY OF SANITARY SEWER SYSTEM ON THE SOUTH SIDE OF ST , LOUIS PARK - PROJECT 68 - 25 . On motion by Councilman Galinson , seconded by Councilman Graves , this matter was deferred to August 5 , 19689 Motion carried with six yeas . (c ) MONTHLY FINANCIAL REPORT Upon hearing no objections , the report was ordered b President Pro Tem Howard to be received for filing . y (d ) REPORT OF CITY MANAGER ON LAND ACQUISITION Lot 12 , MINIKAHDA VISTA PARK ( M & C No , 68 - 24 ) . - It was moved by Councilman Graves , seconded b Heltzer , to accept deed and authorize y C °uncilman record , Motion carried with six yeas ,City Clerk to file same for 9 . UNFINISHED BUSINESS ( a ) REPORT OF SUPERVISOR OF DEPARTMENT INSPECTION OF ILLEGAL, OF PROTECTIVE ( REQUESTED BY COUNCIL, UL USES IN THE B - 1 AREA . JULY 15 , 1968 ) Y 1 AND DEFERRED FROM 199 council Minutes , July 29 , 1968 9 (a ) Mr . Elmer Meyers , 2855 Joppa Avenue , suggested a solution for the problem on Minnetonka Boulevard between Dakota and Colorado Avenues on the south side , of the street . He suggested that the curbs be moved back and that what is now the setback area be paved , and that he would be willing to construct aprons for drive - ways for ingress and egress to the business places at that location . Councilman Koch moved that Staff investigate points that Mr . Meyers suggested and report on August 19 , 1968 Councilman Reynolds seconded and the motion carried with six yeas . Councilman Reynolds moved that all of the illegal uses , structures and land , in the B - 1 District as submitted by the Building Inspector in his memorandum dated July 11 shall be corrected by December 31 , 1968 or a definite plan be established by that time , Councilman Heltzer seconded and the motion carried with six yeas , Councilman Heltzer asked for a report on illegal uses in B - 2 be submitted by December 31 , 1968 . (b ) REPORT OF CITY MANAGER ON PURCHASE OF LIBRARY BUILDING BY HENNEPIN COUNTY - M & C . No . 68 - 22 and 68 - 22A - ( DEFERRED FROM JULY 152 1968 ) . Councilman Reynolds moved that Staff be directed to prepare an ordinance for transmittal to - Council setting forth the purchase price and the fund to which 'the money shall be returned . Councilman Calirison seconded and the motion carried 5 - 1 , Councilman Graves voting nay . (c ) REPORT OF CITY ATTORNEY REGARDING GUN ORDINANCE ( DEFERRED FROM JUNE 24 AND JULY 15 , 1968 ) . Councilman Koch moved to defer this matter to August 19 , 1968s with the City Attorney bringing in the newly adopted Minneapolis Gun Ordinance at that time . Councilman Graves seconded and the motion carried with six yeas . (d ) REPORT OF CITY MANAGER ON JOINT USE OF POLICE PERSON - NEL AND EQUIPMENT - M & C . No . 68 - 23 - ( DEFERRED FROM JULY 15 , 19 68 ) . Chief of Police Clyde Sorensen was present to answer questions concerning the details of the agreement . RESOLUTION NO, 3563 It was moved by Councilman Galinson , seconded by Councilman Graves, to waive reading and adopt Resolution No . 3563 entitled , 200 Council Minutes , July 29 , 1968 " Resolution A roving an Agreemed 5 ent for Joint and Cooperative Use 9 . (d ) pp of Police Personnel and Equipment . " Motion carried - Councilman Heltzer voting nay . e REPORT OF CITY MANAGER REGARDING ORDINANCE AMENDING THE ORDINANCE CODE VIOLATIONS BUREAU ( DEFERRED FROM JUNE 24 AND JULY 15 , 1968 ) . Ile On motion by Councilman Koch , seconded by Councilman Galinson , this matter was deferred to August 19 , 1968 • Motion carried with six yeas . (f ) REPORT OF CITY MANAGER CONCERNING ADJUSTMENT IN PURCHASE OF PROPERTY FROM J , V . GLEASON ( M & C No . 68 - 18 ) ( DEFERRED FROM JULY 15 , 1968 ) , It was moved by Councilman Heltzer , seconded by Councilman Graves , to defer this matter to August 5 , 1968 . Motion carried with six yeas , (g ) APPROVAL OF INSTALLATION OF GRADE CROSSING OVER GAMBLE DRIVE ( DEFERRED FROM JULY 22 , 1968 ) . RESOLUTION NO, 3564 It was moved by Councilman Graves , seconded by Councilman Galinson , to waive reading and adopt Resolution No . 3564 entitled , " Resolution Approving Installation of Grade Crossing over Gamble Drive . " Motion carried with six yeas , 10 . NEW BUSINESS ( a ) TABULATION OF BIDS - SALE OF CITY - OMTNED VEHICLES It was moved by Councilman Heltzer , seconded by Councilman Graves , to accept bids as follows 1966 Ford - Eide Motorcycle Sales 1967 Plymouth - Robert Jameson 1965 Valiant - Raymond Hartzberg Motion carried with six yeas . 11 .
