LOUIS PARK, MINNESOTA July 22 , 1968 1 , CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Thiel at 8 : 10 P . M . 20 INVOCATION Invocation was given by Councilman Howard . 3 , ROLL CALL The following Councilmen were present at roll call : Murray Galinson Richard Graves James Heltze r Frank Howard Richard Koch f Robert Reynolds Leonard Thiel Also present were the Acting City Manager , City Attorney , Assistant City Manager , Planning Director , Director of Public Works , City Assessor and Secretary . 4o MINUTES On motion of Councilman Reynolds , seconded by Councilman Koch , the minutes of the regular meeting held July 15 , 1968 , were approved by a seven yea vote . 5 • PUBLIC HEARINGS None Irt , 60 PETITIONS , REQUESTS AND COMMUNICATIONS ( a ) NOTIFICATION OF INTENT TO HOLD BINGO GAME - BY FRANK LUNDBERG AMERICAN LEGION POST NO. 282 . RESOLUTION NO. 3557 It was moved by Councilman Koch , seconded by Councilman Galinson , to waive reading and adopt resolution entitled , " Objecting to Conducting of Bingo Game . " Motion Resolution Oboe g carried 6 - 1 , Councilman Heltzer voting nay * 188 ' Council Minutes , July 22 , 1968 7 . RESOLUTIONS AND ORDINANCES (a ) RESOLUTION APPROVING FINAL PLANS FOR IMPROVEMENT OF TRUNK HIGHWAY 100 WITHIN THE LIMITS OF ST . LOUIS PARK Mr . Robert Kurpious , District Engineer , State Highway Department, was present to explain the details of the project . Mr . Sam Fisher , Hennepin County Highway Department , was also present explaining the county ' s role in the improvement . Councilman Koch moved to approve the plans with the provision that there be installed a permanent signal at Toledo and Minnetonka and a temporary signal at Utica , and that the free right turn for traffic going from Lake Street onto Minnetonka Boulevard be removed , Councilman Graves seconded , After being assured by the County and the State that the conduit is in the plans and that the signals would be installed if they proved to be necessary , Councilman Koch withdrew his motion. RESOLUTION NO, 3558 It was moved by Councilman Koch, seconded by Councilman Reynolds , to waive reading and adopt Resolution No . 3558 i entitled , "Approval Final Plans and Specifications for Improve - ment of Trunk Highway 100 Within the Limits of St . Louis Park. " Motion carried 4 - 31 Councilmen Graves , Heltzer and Howard voting nay. Councilman Galinson asked Mr . Kurpious if there is going to be lighting on the barrier being constructed on Highway 100 in front of Benilde High School and Stephens Buick , Mr . Kurpious said that there were no plans for lighting it at this time but that it will be striped . (b ) RESOLUTION APPROVING INSTALLATIO QSSINCJ OVER GAMBLE DRIVE , NOF GRADE CR On motion by Councilman Graves , seconded by Councilman Galinsol this matter was deferred to July 29 , 1968 Motion carried ? - 0 . 8 • REPORTS OF OFFICERS , BOARDS AND COMMITTEES (a ) PRELIMINARY REPORT OFT AND ASSESSOR HE DIRECTOR OF PUBLIC WORK DAKOTA S ' SIDE OF HE NO , 68 - 23 , SIDEWALK , WEST TA AVENUE NT WEST 26TH STREET TO 189 council Minutes , July 22 , 1968 8 , ( a ) WEST 27th STREET , RESOLUTION NO, 3559 It was moved by Councilman Graves , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 3559 entitled , " Resolution Receiving Reports and Calling Hearing on Improvement No . 68 - 23 . " Motion carried with seven yeas . 9 , UNFINISHED BUSINESS (a ) BOARD OF EQUALIZATION The Board of Equalization met immediately prior to this Council meeting . Councilman Howard moved that Mr . Lampils assessment remain as on the books . Councilman Reynolds seconded the motion which carried with seven yeas . On motion by Councilman Howard, seconded by Councilman Galinson , the meeting of the Board of Equalization was adjourned . (b ) COMMUNICATION FROM MRS . IRVING AARON REGARDING VARIANCE GRANTED TO BOULEVARD DEL INC . ( DEFERRED FROM JULY 15 , 1968 ) . Mr . Irving Aaron , 2937 Maryland , was present to request the denial of a variance- granted to Boulevard Del Inc . on the grounds that it is his opinion that it was granted illegally , Councilman Howard moved that any light that is shining directly into Mr . Aaron ' s home and any lighting in violation of the special permit be removed . Councilman Reynolds seconded and the motion carried with seven yeas . (C ) REPORT OF THE PARKS AND RECREATION COMMISSION RECOMMENDING AQUILA PARK AS THE SITE FOR THE LY W5 , COMMUNITY CENTER COMPLEX ( DEFERRED FROM 19 68 ) . ` Mr . Councilman Heltzer seconded . nded the motion to read that on this first Councilman Koch ame meeting in September that we also decidethat night when the , referendum is going to be held and what it should comprise . Councilman Heltzer agreed to the amendment of the motion and it carried with seven yeas . Mayor Thiel requested that the council subcommittee go back to work on this and consider possible land acquisition . Councilman Galinson requested staff to determine , under the present existing federal programs , if there are any funds available for this community center or for the acquisition of land . (d ) APPOINTMENTS TO BOARDS AND COMMISSIONS ( DEFERRED FROM JULY 1 AND JULY 15 , 1968 ) . It was moved by Councilman Gallinson ., seconded by Councilman Graves , to consent and approve the following appointments : Peter Bromme , Board of Zoning Appeals , for a term to expire December 31 , 1972 . Edwarr'. F. Baker , Planning Commission , for a term to expire December 31 , 1970 . Motion carried with seven yeas . It was moved by Councilman Galinson , seconded by Councilman Heltzer , to defer the appointments to the Citizens Advisory Committee to August 5 , 1968 . Motion carried 7 - 0 . (e ) REPORT OF CITY ENGINEER AND CITY ASSESSOR CONCERNING ALLEY , IMPROVEMENT NO. 66 - 06 , OREGON , PENNSYLVANIA AND LAKE STREET ( DEFERRED FROM JUNE 24 AND JULY 15 , 1968 ) , RESOLUTION NO. 3560 It was moved by Councilman Heltzer , seconded b Councilman Graves , to waive reading and adopt Resolution y entitled , " Resolution Receivin No . 3560 No . 66 - 06 . (f j Councilman Galinson moved to indicate Councils s approval to pay $ 206 as the City ' s portion of the cost of preparing an agreement for the nine communities involved under the joint powers act . Councilman Reynolds seconded and the motion carried with seven yeas . ( g ) 34TH STREET BARRICADE Councilman Heltzer presented the following solution that was arrived at by the neighborhood groups involved : " Solution to Traffic & Safety Problems Between Texas and the Minnehaha Gables Area ; Minnetonka Boulevard and the 34th Street - Aquila Avenue Areas " Basic Principles Which Must Be Adhered to in Coming to Any Final Resolution of These Problems : 1 . The safety of the children and adults living in these neighborhoods is a primary consideration . 2 . Residential streets must be reserved for the use of residential traffic . 3 . Through traffic must be channeled onto arterial streets . - ' ' @The= ` Minnehaha oGbles Area must have t vro different means of l _access and egress . All agencies , using emergency vehi-cies ; end likely to service- these neighborhoods , will be informed by - th16 City in regard to the availability of passage through these barricades which will be open to them . (g ) matter on its agenda at its next opportunith ' Street west to meet 6 . The City of St . Louis Park will extend 36 County Road 18 , no later than this Fall . 7 . Once the juncture of County Road 18 and 36th Street has been completed , all barricades will be removed from Boone Avenue and Aquila Lane . 8 . Traffic counts will be taken following the juncture of County Road 18 and 36th Street and the removal of the Boone Avenue - Aquila Lane barricade . 9 . Following these traffic count studies and their analysis , Flag Avenue will be connected to 36th Street . This will be done in the summer of 1969 . 10 . Traffic counts will be taken and analyzed following the connection of Flag Avenue and 36th Street . 11 . Representatives of the affected neighborhoods will meet with the Mayor ' s Safety Committee to suggest locations for through - stop signs in order to control residential traffic in their neighborhoods . This will be done at any time , during the above - mentioned process , at the initiative and discretion of the residents of the concerned neighborhoods . " It should be clear that while all parties concerned seem to be in agreement in regard to the four basic principles , the basic , sequential steps mentioned represent compromises made by representatives of three neighborhoods from solutions each of them believe best from their own point of view . It Mr . Fred Burstein , 3237 Cavell Lane , spoke on behalf of the three neighborhood groups , indicating the above agreement to be a temporary solution . Mr . Bill Aberman , 8900 Minnehara Circle , and Dr . Theodore Litman , 3324 Flag Avenue , spoke against the erection of the barricade and urged the Council to work out a more effective and permanent solution to the traffic problem . Mrs . Louise Rotman , 9009 Minnehaha Circle South , said that Minnehaha Gables will still be left with only one exit . Councilman Heltzer moved to adopt the proposed solution . Councilman Galinson seconded and the motion carried 6 - 1 , Councilman Reynolds voting nay . Councilman Reynolds moved to send question of possible stop signs to the PlanningCommission Highway and Street Committee . Councilman Galinson seconded and the motion carried with seven yeas . 193 Council Minutes , July 2 2 , 1968 9 ( g ) Councilman Koch moved that Staff prepare a report on the extension of 36th Street to County Road 18 , and that the Staff be reminded that in the summer of 1969 a report on the extension of Flag Avenue to 36th Street will be expected . Councilman Howard seconded and i the motion carried with seven yeas . RESOLUTION NO, 3561 It was moved by Councilman Galinson , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3561 entitled , " Resolution of the City Council of St . Louis Park Urging the County Board to Extend County Road 18 to 36th Street Immediately. " Motion carried with seven yeas . (h ) OAK HILL PATH Barbara Baratz , 3134 Pennsylvania Avenue , was present to indicate her displeasure concerning the manner in which the path at Oak Hill Park had been cleared . Mrs . Ray Henkels , 3153 Pennsylvania Avenue , expressed her gratitude for what had been done to clear the path and asked that the roots in the path also be taken out . Councilman Reynolds moved to leave the park in its present state until the end of the year . Councilman Koch seconded and the motion carried with seven yeas . 10 . NEW BUSINESS i ( a ) TABULATION OF BIDS FOR STORM SEWER IN MINNEAPOLIS FROM FRANCE AVENUE TO LAKE CALHOUN , IMPROVEMENT NO. 62 - 85 ( JOINT AGREEMENT - CITY OF MINNEAPOLIS , EDINA AND STo LOUIS PARK ) . It was moved by Councilman Graves , seconded by Councilman Galinson , to defer action on this matter to July 25 , 1968 . Motion carried with seven yeas . This action was taken as a result of a considerable increase in costs over the original estimate . Mr . Harry Mayeron , Orr - Schelen - Mayer & Associates , Inc . was present to explain nt e for bringing reasons for this , such as the possible need g g good fill , need for haste because of a paving project in Minneapolis and possible need for piling . Mr . Warren Hyde , City Manager of Edina , was present to give his views . 194 council Minutes , July 22 , 1968 10 . MISCELLANEOUS None 12 .
