CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Leonard Thiel at 8 : 06 p . m . 2 . INVOCATION lob Invocation was given by Councilman Howard . 3 . ROLL CALL The following Councilmen were present at roll call : Murray Galins on Richard Graves James Heltzer rank Howard Richard Koch Leonard Thiel Also present were the City Manager , City attorney , Director of Public "Works , Health Sanitarian and secretary . Councilman Reynolds arrived at 8 : 09 p . m . 4 . MINUTES On motion of Councilman Koch , seconded by Councilman Graves , the minutes of the regular meeting held March 18 , 19 68 were approved by a seven yea vote . Councilman Reynolds arrived at 8 : 09 p . m . 5 . ESTABLISHING R .QUIREMENTS FOR CONTaOL OR CORRECTION OF AIR POLLUTICN ( DEFERRED F _� OM FEBRUARY 269 1968 ) . Howard J . Scott , representing the National Coal Association , kienon"°act Falls , Wisconsin , react a prepared statement voicing objection to the inclusion of Section z- 0. 315 . 51 , sulfur dioxide requirements ; requester lower emission limits than required by Section 4 : 815 . 45 ; requested changes in the use of opacity in Section 4 : 815 . 43 ; requested a ohmage in definition of air pollution as stated in Section 4 : 815 . 01 . guggeseTom Reiersgord , attorneyfor Republic Creosote Company , > 1 changes in Section 4 : 815 . 59 ; questioned the mechanics and en.forcem 78 Council Minutes - March 25 , 1968 5 , of the licensing requirement in Section 4 : 815 . 11 ; questioned the testing clause in Section 4 : 815 . 45 ; stated time for compliance with the ordin - ance was too short ; felt there was not enough leeway as to frequency or extremes of occurrence in odor standards ; and questioned the lack of a review or appeal board , Mrs . S . A . Swanson , . ' 013 West 31st Street , was present in opposition to the ordinance , stating burning of leaves should be allowed . Mrs . Kenneth Parent , 3841 Lynn Avenue , was in favor of the ordinance . Mrs . Grace Mather , 3334 Brownlow Avenue , requested enforcement of ordin - ances and complained of surface pollution . Al Rogalh , 5725 West Lake Street was concerned with burning regulations and their enforcement . Eugene Strommen , 6010 plighway 7 , !Executive Manager of the Chamber of Commerce , spoke on the need of an educational campaign and presented a written statement urging area - wide instead of local adoption of such an ordinance ; requested the licensing requirement be changed ; the need for reviewal of procedure and time of appeals , and urged a system of appeal by a qualified board of appeals . Robert Bartholow , 7705 Edgebrook Drive , representing the South Oak Hill Community Association , spoke on offensive fumes , dust , and urged adoption of the proposed ordinance . Dr . Paulus , Professor of School of Public ealth , University of Minnesota , spoke in favor of the ordinance and suggested review of the sectiois on opacity and sulfur dioxide . Mr . Bernard Felton , Methodist Hospital , spoke in favor of the ordinance . Robert Thornburg , Secretary of the Minnesota Petroleum_ council , asked for reviewal of certain points the Council had requested . After further discussion it was moved by councilman Koch , seconded by Councilman Howard , that a nine member committee be formed , com - posed of H. McPhee , Dr . Paulus , J . Fieltzer , H . Burry , �� . Folland , C . Andre , one from the Petroleum Council , one from the Chamber of Commerce and one from the South Oak dill Community Association , to meet as soon as possible to review the proposed air pollution ordinance and suggested amendments and report to Council May 13 , 1968 . Motion passed by a seven yea vote . It was moved by Councilman Heltzer , seconded by Councilman Koch , to waive first reading of proposed ordinance and set date for second reading May 13 , 1958 , Motion passed by a seven yea vote . 6 . RESOLUTION A CCEEP T INC REC OMMoe. NDA TION OF THE PARKS AND RECREATION ADVISOR Y COMMISSION BASED UPON THE JOINT STUDY COMMITTEE RECOMMENLATION FOR A SPECIAL 79 Council Minutes - March Z5 , 1968 6 . ELECTION FOR A COMMUNITY CENTER , SEVEN TENNIS COURTS , AND ADDITIONAL PARK FACILITIES . RL, SOLUTION NO . 34L88 It was moved b Councilman Calinson , seconned by Councilman Graves , Y 4I3 38 entitled " Resolution to waive reading and adopt Resolution No . Accepting Recommendation of the Parks and Recreation Advisory Com _ mission Based Upon the Joint Study Committee Recommendation for a ity Center , Seven Tennis Courts , and Special Election for a Commun Additional Park Facilities . " Motion passed by a seven yea vote . 7 , REYIEWAL OF I ajT34 5 ANT NUISANCE ORDINANCE . A motion was made by Councilman Galinson , seconded by Councilman Graves , that a committee be appointed by the Mayor consisting of three Council members , the City Attorney , and the enforcing agency involved , to review the present nuisance ordinance with the possibility of making it more effective , tiiotion passed by a seven yea vote . Mayor Thiel appointed Councilmen Galinson , Koch and '. oward , Councilman Calinson as chairman . 7 . ADJOURNMENT On motion of Councilman Meltzer , seconded by Councilman Koch , the meeting was adjournec at 11 : 45 po me by a seven yea vote . Leo rd J .
