CALL TO ORDER A regular meeting of Yihe City Council was called to order by • Mayor Leonard Thiel at 8 : 04 p . m . 2 . INVOCATION Invocation was given by Rev . Douglas Norris of Aldersgate Methodist Church . 3 . MINUTES ; ! ' � - On motion of Councilman Howard , seconded by Councilman Graves , the minutes of the regular meeting held March 11 , 1968 were approved by a six yea vote . 5 . PUBLIC HEARINGS ( a ) IMPROVEMENT NO . 66 - 44 , PROPOSED PAVING AND CURB AND GUTTER CONSTRUCTION ON ALABAMA AVENUE FROM WEST 16TH STREET TO CEDAR LAKE ROAD . AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MARCH 7 AND 14 , 1968 . Sidney Katz , 1644 Alabama Avenue , Mrs . R . R . Pierson , 1624 Alabama Avenue , Richard Graziano , 1645 Alabama Avenue , and Miles Brennan , 6008 West 16th Street , were present in opposition to the project until a determination of the zoning in the area is madeo Mayor Thiel declared the hearing closed . A motion was made by Councilman Koch , seconded by Councilman Graves , to table the matter . It was explained that paving is needed to provide more adequately services for the area , Mayor Thiel declared the hearing clos ed. Pierson , 1624 Alabama Avenue , were present to request the matter be held until a determination of the zoning in the area is made . The director of Public Works described the project . Mayor Thiel declared the hearing closed . ! It was moved by Councilman Koch , seconeed by Councilman Graves , to defer the matter to the Council meeting April 29 , 1968 . Motion lost by a roll call vote of four nays and two yeas , Councilmen Graves , and Koch voting yea and. Councilmen 1- eltzer , Howard , Reynolds and Thiel voting nay . It was moved by Councilman Reynolds , seconded by Councilman Howard , to waive reacting and adopt resolution order . ing the improvement and ordering preparation of plans . Motion lost by a roll call vote of four yeas and two nays , Councilmen Heltzer , Howard , Reynolds and Thiel voting yea and Councilmen Graves and Koch voting nay . (Six votes are needed to order the improvement . ) A motion was matte by Councilman Heltzer , seconded by Councilman Graves , to reconsider . Motion passed by a six yea vote . It was moved by Councilman Koch , seconded by councilman Graves , to defer the matter to April 29 , 1968 . Motion passed by a vote of four yeas and one nay , Mayor Thiel voting nay . Councilmen Reynolds and Galinson were absent . ( e ) IMPROVEMENT NO , 68 - 02 , PROPOSED STORM SEWER IN AREA. OF HIGHWAY 100 AND EXCELSIOR BOULEVARD TO BASS LAKE AND RALEIGH AVENUE FROM V611ST 37TH STREET TO WEST 38TH STREET , AS DESCRIBED IN NOTICE OF HEARING PUB - LISHED FEBRUARY 22 AND 29 , 1968 . The Director of Public Works explained the project . There being no one present interested in the improvement , Mayor Thiel declared the hearing closed . Councilman Heltzer presented two petitions signed by residents in the area against the request . The Planning Director described the request . Eigenman , Obei s Salon of Beauty , 7210 Minnetonka Boulevard , Leo Fine , 7200 Minnetonka Boulevard , Mrs . Harry Anderson , 2915 Maryland Avenue , Mrs . Leona Littlefield , 7300 Minnetonka Boulevard , and Anton Korbel , 2920 Maryland Avenue , were present in favor of the request . Irving Aaron , 2937 Maryland Avenue , appeared in opposition , stating the fence was broken , there was debris and noise and the landscaping was not proper . It was moved by Councilman Heltzer , seconded by Councilman Howard , that the matter be deferred to April 1 , 1968 . Motion passed by a six yea vote . The hearing was closed by Mayor Thiel before the motion was made . 6 . PETITIONS , REOU:'liSTS AND COMMUNI C,ATICNS ( a ) COMMUNICATION FROM A . SAGARSKY , THE PURPLZ CIGA. REQUESTINC LICENSE PERMIT F OR DANCES ON CERTAIN DATES . Philip Starkey , 3350 Brunswick , Bruce Jensen , 3814 Brunswick Avenue , and Herbert Marks , 3817 Brunswick Avenue , were present in opposition to granting the permit , giving noise , litter and nuisance value as the reasons . James Levy , attorney for Mr . Sagarsky , was present on his behalf , Mr . Sagarsky spoke requesting time to satis - f y the complaints . It was moved by Councilman Reynolds , seconded by Councilman Koch , to approve issuance of licenses to operate dances on a trial basis through April 13 , 1968 . After further dis - cussion Councilman Aeynolds withdrew the motion . A. motion was matte by Councilman Reynolds , seconded by Councilman Koch , to defer action to April 1 , 1968 . Motion passed by a roll call vote of four yeas and two nays , Councilmen Graves and Heltzer voting nay and Councilmen :`owardj Koch , Reynolds and Thiel voting yea . ( b ) COMMUNICATION PROM ST . ( b ) Council meeting , be submitted to the Attorney Ceneral for an opinion as to whether it is proper within the confines of the St . Louis Park City Charter . harry hosker , 1620 Pennsylvania Avenue , asked for an explanation of the duties of the Director and the educational aspects , ' Discussion followed . Councilman Koch made a motion , seconded. by Councilman Aeynolds that the ordinance presented by the Human Rel tions Council tog .ather with the City Attorney ' s opinion and a copy of the City Charter be submitted immediately to the Attorney General to study and inform the Council if it coincides with the City Charter and is within the structure of state law and to identify any sections that might not conform . Additional discussion followed . Council . man heltzer moved the question , seconded by Councilman Koch . Motion passed by a vote of five yeas and one nay , Mayor Thiel voting nay . Vote on the original motion passed by five yeas and one nay , Mayor Thiel voting nay . Mrs . Vernon Olsen , 1632 Princeton Avenue , spoke in favor of estab - lishing a Human rights Commission both as a private citizen and as a member of the State League of Women Voters . Council Minutes - March 18 , 1968 12 ( a ) On motion of Councilman Reynolds , seconced by Councilman heltzer , the lists of verified claims prepared by the Director of Finance and presented to the Council dated March 18 , 1968 in the total amounts of :p2 , 8030 80 for payroll , and $ 53 , 669 . 80 for vendors were approved , and the City Manager , City Clerk and City Treasurer were authorized to issue checks covering same by a five yea vote , as amended by changing the amount authorized to Loretta Ranson from $ 75 . 14 to $ 73 . 0 �_'- o Councilman Graves was not present .
