CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Thiel at 8 : 03 p . m . 2 . INVOCATION Invocation was given by Reverend Ralph Erickson of the Prince of Peace Lutheran Church . 3 . ROLL CALL The following Councilmen were present at roll call : Murray Galinson Richard Graves James Heltze r Frank Howard Richard Koch Robert Reynolds Leonard Thiel Also present were the City Manager , City Attorney , Planning Director , Director of Public Works , Parks and Recreation Director , and Secretary . 4 . MINUTES On motion of Councilman Koch , seconded by Councilman Graves , the minutes of the regular meeting held December 9 , 1968 , were approved by a seven yea vote . 5 . PUBLIC HEARINGS (a ) PROPOSED PRELIMINARY PLAT OF WESTWOOD ESTATES FOURTH ADDITION ( WESTW OOD HILLS DRIVE AND FRANKLIN AVENUE ) - REQUESTED BY ROBERT J . MCNULT Y COMPANY CONTINUED FROM SEPTEMBER 30 , NOVEMBER 4 , AND NOVEMBER 18 , 1968 ) o ) On motion by Councilman Galinson , seconded b s this plat hearing was continued to Januar Y Councilman Grave , unanimously . Motion carried ( b ) APPLICATION FOR NON - INT OXICA TIN LIQUOR LICENSE AT THE PIZZA HOUSE , INC * ) AS DESCRIBED IN N PUBLISHED NOVEMBER 28 1 OTICE OF HEARING 968 - ON SALE LICENSE rZEQUESTED• 327 I Council Minutes , December 16 1968 5 , (b ) Mayor Thiel opened the hearing . Mr . Herb Davis , attorney representing House , Inc . , was present ex the owners of the Pizza that if the license is explains the request and indicating in front of the buildin rand d the applicant would remove blacktop similar to others in that areeplace it with plantings and crushed ock be refaced , Adequacy of parking wa * lie as said that the building would that thea g as discussed and Mr . Davis said pplicant had 60 parking spaces assessed in t Parking Lot , he Municipal Mayor Thiel declared the hearing closed . It was moved by Councilman Reynolds , seconded by Council man Galinson , to approve the on - sale non - intoxicating liquor license . Motion carried 4 - • 3 , Councilmen Graves , Heltzer and Howard voting nay . b• PETITIONS , REQUESTS AND COMMUNICATIONS (a ) COMMUNICATIONS FROM A . We LAMPS AND DON MCGLYNN Mr . Rolfe Worden , 900 Farmers and Mechanics Bank Building , was present representing the Lampes , lie reviewed the background of the barricade at 36th Street and Aquila Avenue . Mr . Lampe , 3924 Dakota Avenue , spoke of the hardships caused by the barricade as it relates to safety , convenience and economics . His solution to the traffic problem in the area was to remove the barricade from its present location and place barricades closing off Aquila and Zinran either north of 35th Street of south of 34th Street . Mr . Fred Jacoberger was present representing Mr . Don McGlynn . He concurred with the ideas set forth by the Lampes . Councilman Heltzer suggested that staff study the Lampe proposal and report to Council as to what effect that solution would have on traffic . Councilman Galinson moved that the suggested report be brought to Council on January 6 , 1969 , Councilman Craves seconded and the motion carried unanimously . It was agreed by Council that one hour be given to this matter , to be dUvided among spokesmen representing the concerned parties with the idea that Council will either take the suggestion of Mr . Lampe or leave the barricade where it is . 328 Council Minutes , December 16 , 1968 7 . RESOLUTIONS AND ORDINANCES ( a ) RESOLUTION ESTABLISHING CITY POLIC Y FOR LAND ACQUISITION RESOLUTION NO. 3 643 It was moved by Councilman ; raves , seconded by Councilman Heltzer , to waive and reading and adopt Resolution No . 3643 entitled , " Resolution Establishing City Policy for HUD Land Acquisition . " Motion carried unanimously . (b ) RESOLUTION AUTIiORIZING THE CITY MANAGER TO FILE AN APPLICATION FOR A GRANT TO ACQUIRE AND DEVELOP OPEN - SPACE LAND RESOLUTION NO., 3 644 It was moved by Councilman Heltzer , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3644 entitled , " Resolution Authorizing the City Manager to File an Application for a Federal Grant to Acquire and Develop Open - space Land - - Wolfe Park . " Motion carried unanimously . ( c ) FIRST READING OF PROPOSED ORDINANCE AMENDING SECTION 4 : 607 AND REPEALING SUBDIVISION 2 OF SECTION 4 : 803 OF THE CITY OF ST . LOUIS PARK ORDINANCE CODE RELATING TO VISUAL OBSTRUCTIONS AT INTERSECTIONS . It was moved by Councilman Galinson , seconded by Councilman Graves , to waive first reading and set second reading for January 6 , 1969 . Motion carried unanimously . ( d ) SECOND READING OF ORDINANCE AMENDING SECTION 2 : 615 OF THE ST . LOUIS PARK ORDINANCE CODE RELATING TO THE LICENSING OF DOGS . ORDINANCE NO. 1048 t It was moved by Councilman Galinson , seconded by Councilman Graves , to waive second reading and adopt Ordinance No . 1048 entitled , "An Ordinance Amending Section 2 : 615 of the St. Louis Park Ordinance Code Relating to the Licensing of Dogs . " Motion carried unanimously . " Motion carried unanimously. 8 . REPORTS OF OFFICERS , BOARDS AND COMMITTEES ( a ) REPORT OF CITY MANAGER RE SNOWMOBILES Mr . Wilfred Gall , 3042 Boone Avenue , and Mr . Philip Johnson , 7414 Edgebrook Drive , were present in favor of establishing trails for snowmobiles as their right to a recreation facility . There was discussion as to the jurisdiction of Minnehaha Creek . RESOLUTION Noo 3646 Councilman Heltzer , seconded by Councilman Graves , It was moved by 330 Council Minutes , December 16 , 1968 8 . ( a ) to waive reading and adopt Resolution No . 3646 entitled , " Resolution Designating Certain Areas in the City of St . Louis Park for the Operation of Snowmobiles As Provided In Ordinance No . 1046 . " Motion carried unanimously . (b ) MINUTES OF CITIZENS ADVISORY COMMITTEE MEETINGS HELD OCTOBER 3 , NOVEMBER 14 AND DECEMBER ? , 1968 . Upon hearing no objections , the minutes were ordered by the Mayor to be received for filing . ( c ) REPORT OF MAYOR CONCERNING AIR POLLUTION , HUMAN RIGHTS , ELECTIRIC RATE AUTHORITY , AND COLLECTIVE PURCHASING Mayor Thiel reported that he had spoken to the Hennepin County League Board of Directors at their last meeting and had brought up the above matters , He said that reports should be coming before the legislature gets into action . (d ) REPORT OF CITY MANAGER CONCERNING EMPLOYEE APPOINTMENTS It was moved by Councilman Graves , seconded by Councilman Galinson , to approve the appointments of R . W . Miller and W . A . Shook , PS 2 A . Police Patrolmen , effective January 1 , 1969 . Motion carried unanimously . 9 . UNFINISHED BUSINESS (a ) APPOINTMENTS TO COMMISSIONS - FIRE CIVIL SERVICE AND HUMAN RIGHTS , Councilman Heltzer moved to appoint Charlie Chatman to the Human Rights Commission and Steven Lange to the Fire Civil Service Commission Councilman Galinson seconded and the t motion carried unanimously , ( b ) PROPOSED PRELIMINAR v PLAT OF FOURTH COUNTR Y CLUB ADDITION OF WESTW OOD HILLS ( UTAH AVENUE , UTAH DRIVE AND 18TH STREET ) REQUESTED BY ROBERT J . MCNULTY GO. ( HEARING CLOSED , ACTION CONTINUED FROM AUGUST 19 , SEPTEMBER 9 , SEPTEMBER 16 ; OCTOBER 7 , OCTOBER 21 , NOVEMBER 4 AND NOVEMBER 18 , 1968 ) . Councilman Graves moved to approve settlement in Ci Louis Park vs Blacktop Service Company , a tY of St . ` Minnesota Corporation , and M . G . Astleford suit and authorizing City Attorney to sign stipulation as proposed . Councilman Heltzer seconded and he motion carried unanimously . (d ) AWARD OF CONTRACT FOR CLEANING , REPAIRING , AND PAINTING OF # 3 ELEVATED TOWER It was moved by Councilman Graves , seconded by Councilman Koch , to reject all bids . Motion carried unanimously . ( e ) RESOLUTION AUTHORIZING CONVEYANCE OF LAND ( TO VICTOR S . AND MYRTLE L . FORMO ) . Councilman Graves moved to take this matter from the table . Councilman Heltzer seconded and the motion carried 6 - 1 , Councilman Reynolds voting nay . I Councilman Howard moved to def er this matter to January 13 , 1969 . Councilman Koch seconded and the motion lost 5 - 2 , Councilmen Galinson , Graves , Heltzer , Koch and Thiel voting nay . L RESOLUTION NO. 3645 It was moved by Councilman Koch , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3645 entitled , " Resolution Authorizing Conveyance of Land . " Motion carried 5 - 2 , Councilmen Howard and Reynolds voting nay . NEW BUSINESS ( a ) SCHEDULE OF MEETINGS WITH STATE LEGISLATORS On motion by Councilman Graves , seconded by Councilman Heltzer , the meeting to discuss legislative activities was set for December 30 , � - 1968 at 8 : 00 p . m . Motion carried 6 - 1 , Councilman Galinson voting nay . (b ) SCHEDULE OF MEETING WITH ARCHITECT RE COMMUNITY CENTER BUILDING It was moved by Councilman Galinson , seconded by Councilman Reynolds , to set date for meeting with architect for December 23 , 1968 at 7 : 00 p . m . Motion carried unanimously . (c ) STORM SEWER EASEMENT - ELIOT VIEW FOURTH ADDITION Mr , Victor Formo , 6739 Eliot View Road , was present indicating to Council that a previous verbal agreement to pay him $ 1 , 500 for for the storm sewer easement had been made . Councilman Reynolds moved to defer this matter to January 6 , 1969 . Councilman Galinson seconded but after some discussion Councilman Reynolds withdrew his motion . Councilman Graves moved to authorize City Manager to make payment of $ 1 , 500 , accept deed and authorize City Clerk to file same for record . Councilman Heltzer seconded and after further discussion concerning the past agreement and procedures for obtaining ease - ments , Councilman Graves withdrew his motion . Since more information was desired by Council on this matter , Councilman Galinson moved to defer to January 13 , 1969 for a report from the staff. Councilman Heltzer seconded and the motion carried unanimously . ( d ) EASEMENT ON PROPERTY AT SOUTHWEST CORNER OF TEXAS AND HIGHWAY 12 , Mr . Steve Wilson , attorney , 300 Roanoke Building , was present representing the property owners . Since more information was desired by Council , Councilman Howard moved to defer to December 23 , 1968 for a report from the City Attorney , Councilman Galinson seconded and the motion carried unanimously . 333 council Minutes , December 16 , 1968 11MISCELLANEOUS ( a ) DAMAGE CLAIMS a . Irving Pinsky , 4600 Cedarwood Road Councilman Galinson moved to file above claims with the City Clerk for proper action by the City Manager and City Attorney . Councilman Graves seconded and the motion carried with seven yeas . 12 . CLAIMS , APPROPRIATIONS AND CONTRACT PAYMENTS ( a ) VERIFIED CLAIMS None (b ) CONTRACT PAYMENTS 1 , Partial Payment for construction cooperative agreement - Hennepin County - City of Minneapolis - Great Northern Railway Co . - Contract 813 - Amount , $ 20 , 000 . It was moved by Councilman Graves , seconded by Councilman Galinson , to approve and authorize payment .
