INVOCATION Invocation was given by Councilman Howard . 39 ROLL CALL The following Councilmen were present at roll calf : Murray Galinson Richard Graves James Heltze r Frank Howard Achard Koch Leonard Thiel Also present were the City Manager. , City Attorney , Planning Director , Director of Public Works and Secretary .. 4 . MINUTES On motion of Councilman Galinson , seconded by Councilman Craves , the minutes of the regular meeting held January 15 , 1968 were approved by a six yea vote as amended in 7a by changing the third sentence to read : " It was moved by Councilman Koch , seconded by Councilman Reynolds , that Mr . . Galinson be appointed as Council representative to the Bassett Creek coordination committee with a staff member to . be de signate a. by the City. Manager to assist . . 5 . PUBLIC HEARINGS ( a ) PROPOSED REZONING OF PROPERTY IN AREA BOUNDED APPROXIMATELY BY HIGHWAY 12 ON THE NORTH , MINNEAPOLIS NORTHFIELD & SOUTHERN RAILWAY ON THE EAST , WEST 16TH STREET ON THE SOUTH AND DAKOTA AVENUE ON THE WEST FROM I - 1 DISTRICT TO I - 3 , B - 2 AND B - 3 DISTRICTS , INITIATED BY COUNCIL ( CASE NO . - 67 - 35 - MISC ) AS DESCRIBED IN NOTICE OF HEARING PUBLISHED JANUARY 11 , AND JANUARY 18 , 1968 . 21 Council Minutes - January 22 , 1968 5 . ( a ) The Planning . Director gave the background of ifie zoning in the area . Joseph Langer , 4973 West 40th Street , Vice President of Barrett Moving and Storage Company , was interested in what effect the upgrading of �Tighway 12 might have on this area . Stan Thomas , 5700 West 36th Street , was not in favor of rezoning the area . The Planning Director pointed out that Planning Commission recommended this change in zoning after a study of the area . Mrs . Josephine Gatten , 1332 Colorado Avenue , was opposed to the rezoning , Mayor Thiel declared the hearing closed . It was moved by Council . man Graves , seconded by Councilman Galinson , to waive first read _ ing of proposed ordinance and set date for second reading February 5 , 1968 . Motion passed by a vote of five yeas and one nay , Council . man Howard voting nay . 6 . PETITIONS , REQUESTS AND COMMUNICATIONS ( a ) REQUEST OF C . A . KINSE, R. FOR ADJUSTMENT OF ASSESSMENT FOR STREET SURFACING , IMPR, OVEM NT NO. 61 - 9 . RESOLUTION NO . 3447 It was moved by Councilman Koch , seconded by Councilman Howard , to waive reading and adopt Resolution No . 3447 entitled " Resolution Cancelling Special Assessments in Part Improvement No . 61 - 9 . " Motion passed by a six yea vote . 7. RESOLUTIONS AND ORDINANCES ( a ) RESOLUTION AUTHORIZING PLACEMENT OF TRAFFIC CONTROL SIGNS REGULATING PARKING (AREA OF ZARTHAN AVENUE AND WEST 16TH STREET ) , RESOLUTION NO , 3448 It was moved by Councilman Koch , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3448 entitled " Resolution Authorizing Placement of Traffic Control Signs Regu - lating Parking . " Before a vote was taken Councilman Koch made a motion to amend the resolution to include no parking on the north side of West 16th Street from Alabama Avenue to 200 feet west . After further discussion the motion was withdrawn and a request made that staff study this area further . The above motion passed by asix yea vote . (b ) FIRST READING OF PROPOSED ORDINANCE DESIGNATING PUBLIC WAY AS BELT LINE BOULEVARD . 22 Council Minutes - January 22 , 1968 7 . (b ) It was moved by Councilman Howard , seconded by Councilman Koch , to waive first reading of proposed ordinance and set date for second reading February 5 , 1968 . Motion passed by a vote of five yeas , Councilman Graves vias not present . (c ) FIRST READING OF PROPOSED ORDINANCE AMENDING THE ST . LOUIS PARK ORDINANCE CODE REGULATING ELECTRICAL WORK * The City Attorney explained that technical changes had been made to comply with the statutes passed at the last legislative session . A. motion was made by Councilman Koch , seconded by Councilman Graves to waive first reading of proposed ordinance and set date for second reading February 5 , 1968 . Motion passed by a five yea vote . Councilman Howard was not present . ( d ) SECOND READING OF PROPOSED oa ]DINANCE REDETERMIN - ING THE BOUNDARIES OF THE FOUR WARDS OF THE CITY OF ST . LOUIS PARK , ORDINANCE NO , 1018 It was moved by Councilman Koch , seconded by Councilman Graves , to waive second reading and adopt Ordinance No . 1018 entitled " An Ordinance Redetermining the Boundaries of the Four. Wards of the City of St . Louis Park . " Motion passed by a five yea vote . Councilman Howard was not present . ( e ) SECOND READING OF PROPOSED ORDINANCE AMENDING THE ST . LOUIS PARK ORDINANCE CODE IN SECTIONS 19, 124 , • 1 : 125 AND 1 : 126 ENTITLED " PLANNING COMMISSION , " RELATING TO MEMBERS AND THEIR APPOINTMENT TO THE PLANNING COMMISSION . Councilman Heltzer presented proposed amendments to the Planning Commission ordinance as approved at first reading . It va s moved by Councilman Heltzer , seconded by Councilman Graves , to amend the proposed Planning Commission ordinance as approved at first reading by creating thirteen members in - stead of eleven in Section 1 : 124 , Subd . 1 , by deleting the word " eleven " and inserting in its place the word " thirteen ." Council - man Heltzer stated that by increasing membership of Planning Commission sub -. committees could be formed such as streets and highways to study development as it pertains to the Compre - hensive Plan . Motion passed by a roll call vote of four yeas and two nays , Councilmen Galinson , Graves , Heltzer and Koch voting yea and Councilmen Howard and Thiel voting nay , e 23 Council Minutes - January 22 , 1968 7 * (e ) A motion was made by Councilman Heltzer , seconded by Council . man Graves , that Section 1 : 124 , Subd . 1 be further amended by deleting the word " eight " as it now appears and inserting in its place the word " ten " and Section 1 : 124 , Subd , 2 be amended to read as follows :' Ten regular members of the Commission shall be appointed for terms of three years each by the City Council . Their terms shall run until the 31st day of December of the year in which their terms expire , and until s successor is appointed and qualified . The term of office of the present six regular mem . bers of the Commission shall remain unchanged , 3 terms expiring ' December 31 , 1969 and 3 expiring December 31 , 1970 . The ini - tial appointment of four additional regular members shall be for one year ending December 31 , 1968 and until their successors are appointed and qualify . Subsequent appointments shall be for three year terms . In the event of a vacancy , the Council shall appoint a person to complete the unexpired term . A. member of the Commission may be removed with or without cause by the City Council . " Motion passed by a roll call vote of four yeas and two nays , Councilmen Galinson , Graves , Heltzer and Koch voting yea and Councilmen Howard and Thiel voting nay . O:c�DINANCE , NO . 1019 It was moved by Councilman Koch , seconded by Councilman Galinson , to waive second reading and adopt Ordinance No . 1019 entitled " An Ordinance Amending the St . Louis Park Ordinance Code in Sections 1 : 124 ; 1 : 125 and 1 : 126 , Entitled ' Planning Commission , ' ' Membership and Terms , ' ' Organ - ization , Organ - ization , ' Relating to Members and Their Appointment to the Planning Commission, " as amended . Before a vote was taken it was moved by Councilman Howard , seconded by Councilman Galinson , to take away the voting power of Council members on the Planning Commissions Motion lost by a roll call vote of four nays and two yeas , Councilmen Galinson , Graves , Heltzer and Koch voting nay and Councilmen Howard and Thiel voting yea . Vote on the previous motion by Councilmen Koch and Galinson to adopt Ordinance No . 1019 passed by a roll call vote of four yeas and two nays , Councilmen Galinson , Graves , Heltzer and Koch voting yea and Councilmen Howard and Thiel voting nay . A motion was made by Councilman Graves , seconded by Council - man Heltzer , to establish the following procedure for recommenda - tions to Council : Those Councilmen holding positions on the Council next up for election shall form a nominating committee of three to recommend persons to serve on advisory boards and commissions * ( The committee would include Councilmen Heltzer , Howard and Koch . } Motion passed by a roll call vote of six yeas . 24 Council Minutes - January � 2 , -L968 7 , (f ) SECOND READING OF PROPOSED ORDINANCE AMENDING THE: ST . LOUIS PARK ORDINANCE COD3Z IN SECTIONS 1 : 130 , 1 : 131 AND 1 : 132 RELATING TO PARK AND RECREATION ADVISORY COMMISSION , Councilman Heltzer presented proposed • amendments to the Park and Recreation ordinance. Councilman Koch read from the minutes of the meeting held January 10 , 1968 by the Park and Recreation Advisory Commission recommending that the membership of the board remain at eight . Rosemary Griak , member of the Park and Recreation Advisory Commission , was present to state the views of the board . A motion was made by Councilman Heltzer , seconded by Council - man Koch , that the amendments submitted by Councilman Heltzer decreasing the Park and Recreation Advisory Commission to nine members be approved . Motion lost by a vote of four nays and two yeas , Councilmen Galinson , Graves , Howard and Thiel voting nay and Councilmen Heltzer and Koch voting yea . It was moved by councilman Galinson , seconded by Councilman Graves , that the Park and Recreation Advisory Commission con - sist of eight members . Motion lost by a vote of four nays and two yeas , Councilmen Heltzer , rioward , Koch and Thiel voting nay and Counci] men Graves and Galinson voting yea . ORDINANCE NO . 1020 It was moved by Councilman Koch , seconded by Councilman Graves , to waive second reading and- adopt Ordinance No . 1020 as amended at first reading entitled " An Ordinance Amending the St . Louis Park Ordinance Lode in Sections 1 : 130 , 1 : 131 and 1 : 132 Entitled ' Park and Recreation Advisory Com - mission Membership and Terms , ' ' Expenses of Members , ' and ' Powers and Duties , ' Relating to Members and Their Appointment to the Park• and Recreation Advisory Commission . " Motion passed by a roll call vote of four yeas and two nays , Councilmen Galinson , Graves , Heltzer and Koch voting yea and Councilmen Howard and Thiel voting nay . ORDINANCE NO . 1021 It was moved by Councilman Koch , seconded by Councilman Graves , to waive second reading and adopt Ordinance No . 1021 25 Council Minutes - January 22 , 1968 7 . ( g ) entitled " An Ordinance Amending Ordinance No . 743 , Adopted March 28 , 1960 Entitled t Ordinance Establishing Construction Code Advisory Commission and Defining Its Duties , ' Relating to Renumbering of Sections and to Members and Their Appoint - ment , " as amended at first reading . Before a vote was taken it was moved by Councilman Howard , seconded by Councilman Heltzer , that there be one ex officio Council member instead of two ex officio members on the Construction Code Advisory Com - mission . Before a vote was taken it was moved by Councilman Koch , seconded by Councilman Howard , to amend the ordinance to increase the membership on the Construction Code Advisory Commission from five to six members . Motion passed by a roll call vote of four yeas and two nays , Councilmen Galinson , Heltzer , Howard and Koch voting yea and Councilme n Graves and Thiel voting nay .
