CALL TO OR DE R was called to order by Mayor Thiel A regular meeting of the City Council at 8 : 06 p . m . 2 , INVOCATION for Olson , staff member of Westwood Lutheran Invocation was given by Vic Church . 3 , ROLL CALL Councilmen were present at roll call * The following Richard Graves James Heltzer Frank Howard Richard Koch Curtis Pearson Robert Reynolds Leonard Thiel Also present were the City Manager , City Attorney , Planning Director , Director of Public Works and Secretary . 4 . MINUTES On motion of Councilman Reynolds , seconded by Councilman Koch , the minutes of the regular meeting held May 22 , 1967 were approved by a seven yea vote . 5 . PUBLIC HEARINGS ( a ) PROPOSED VARIANCE FROM PROVISIONS OF SECTION 6 : 064 . 5 OF THE ZONING ORDINANCE TO PERMIT A REAR YARD OF TWO FEET INSTEAD OF THE REQUIRED THIRTY - FIVE FEET AT 1856 MELROSE AVENUE , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MAY 18 , 1967 (CASE NO . 67 - 7 - VAR * ) REQUESTED BY ROGER DUFNER . The City Attorney suggested the words " for the purpose of garage construction " should be added to the first paragraph of the resole ' tion . Louis Park Zoning Ordinance . " as amended by adding the words " for the purpose of garage construction " to the purpose in the first paragraph . Discussion centered on building lease , control and physical facilities , traffic , amount of fee and time limit on the permit . It was moved by Councilman Reynolds , seconded by Councilman Koch , to approve issuance of license to operate a dance on Tuesday , Thursday , Friday and Saturday nights commencing June 16 , 1967 for thirty days , subject to review and renewal at that time . Motion passed by a roll call vote of four yeas and three nays , Councilmen Heltzer , Howard and Thiel voting nay . It was pg . 119 of the Texas Avenue - Minnetonka Bouleseconded by Councilman Koch , to moved by Councilman Heltzer , waive reading and adopt resolution approving plans and specifica - tions and authorizing advertisement for bids , Improvement Nos . 64 - 09 and 65 - 33 as amended by extending the median strip on texas Avenue from the north line of Minnetonka Boulevard to 145 fee north , in accordance with the original plan before Council . Before a vote was taken Mr . Brill stated the shopping center was opposed to this plan . Council discussed ingress and egress for both the shopping center and service station at the intersection . A motion was made by Councilman Pearson , seconded by Council - man Howard , to amend the above motion be deleting the portion relating to the amendment and substituting the plan of the engineer . Motion passed by a roll call vote of four yeas and three nays . Councilmen Graves , Heltzer and Koch voted nay . RESOLUTION NO . 3292 The original motion by Councilmen Heltzer and Koch , as amended , to waive reading and adopt Resolution No . 3292 entitled " Resolution Approving Plans and Specifications and Authorizing Advertisement for Bids Improvement Nos . 64 - 09 and 65 - 3311 ( City Engineer ' s plan as modified ) was passed by a vote of four yeas and three nays , Councilmen Koch , Heltzer and Graves voting nay . It was moved by Councilman Reynolds , seconded by Councilman Heltzer , to authorize participation in the preliminary design for Ford Road Park with the Village of Minnetonka and authorize pay - ment in the amount of $ 250 . 00 from the appropriations for Capital Outlay in the park budget . A moti ,; n was made by Councilma • n Koch , seconded by Councilman Heltzyr , to approve the proposed agree - ment and authorize the Mayor and City Manager to execute . Before a vote was t:�'cen it was moved by Councilman Reynolds , seconded by Councilman Koch , to table the matter . Motion lost by a roll call urate of three yeas and. three nays , Councilman Howard abstain - ing . Council discussed a motion made at a previous meeting concerning this project and asked the secretary to read the minutes of May 15 , 1967 regarding Improvement No . 67 - 30 . Councilman Graves sug - gested and Councilmen Koch and Heltzer consented to change the wording of the motion to approve hiring a consulting engineer con - tingent on staff receiving a signed petition waiving hearing by owners of the respective properties involved and signed ease - ments for the improvement obtained from the proper parties . Councilman Howard asked the City Attorney if this motion would be legal . The City Attorney stated that the motion authorized the execution of a contract when certain things occur and it would be legal . Motion passed by a vote of four yeas and three nays , Councilmen Pearson , Howard and Reynolds voting nay . ( e ) COUNCIL MEETING JUNE 12 , 1967s It was moved by Councilman Pearson , seconded by Councilman Koch , that no Council meeting be held June 12 , 1967 . Motion passed by a seven yea vote , 11 , MISCELLANEOUS ( a ) ANNUAL SIDEWALK REPAIR PROGRAM . A motion was made by Councilman Heltzer , seconded by Councilman Koch , that staff make a report recommending an organized plan for annual sidewalk repair . Motion passed by a seven yea vote . (b ) CEDAR LAKE ROAD BRIDGEo It Was moved by Councilman Pearson , seconded by Councilman Reynolds , that staff submit a written report no later than June Z6 , 1967 with respect to the present status of the bridge at Cedar Lake Road and proposed schedule .
