LOUIS PARK , MINNESOTA May 15 , 1967 CALL TO ORDER 1 , A regular meeting of the City Council was called to order by Mayor Thiel at 8 • O2 p. me 20 INVOCATION invocation was given by Councilman Howard. 3, ROLL CALL The following Councilmen were present at roll call : James Heltzer Frank Howard Richard Koch Curtis Pearson Robert Reynolds Leonard Thiel Also present were the City Manager , City Attorney , Planning Director # Director of Public Works , and Secretary . Councilman Graves arrived at 8 : 04 p . m . 4. MINUTES On motion of Councilman Howard , seconded by Councilman Koch , the minutes of the regular meeting held May 1 , 1967 were approved by a six yea vote . ORDINANCE NO. 996 A motion was made by Councilman Pearson , seconded by Councilman Reynolds , to waive second reading and adopt Ordinance No . 996 entitled " An Ordinance Vacating a Portion of Monterey Avenue . " Motion passed by a seven yea vote . (d ) SECOND READING OF PROPOSED ORDINANCE AMENDING THE ST . LOUIS PARK ZONING ORDINANCE CHANGING BOUNDARIES OF ZON - ING DISTRICTS (EAST SIDE OF COLORADO AVENUE BETWEEN WEST 14TH STREET AND WEST 16TH STREET , FROM R - 4 DISTRICT TO I - 1 DISTRICT ( REQUESTED BY ANTON YNGVE ( CASE NO. 67 - 3 - Z ) • John Yngve and Al Yngve were present on behalf of the applicant. It was moved by Councilman Howard , seconded by Councilman Reynolds , to waive reading and adopt proposed ordinance amending the St . Louis Park Zoning Ordinance . Motion lost by a roll call vote of four nay s and three yeas . Councilmen Graves , Howard , Reynolds voted yea and Councilmen Heltzer , Koch , Pearson and Thiel voted nay . Before a vote was taken Council discussed whether the applicant could sign a waiver of hearing without being the owner and whether the Council could act on it without a public hearing and answer from the City Attorney was "no * It The question was asked if Council could act without a petition and the City Attorney stated that there was not a petition before the Council at the present time and Council could act without a petition but the action would require six affirm - ative votes . Councilman Howard voted nay and Council - men Graves , Heltzer , Koch , Pearson , Reynolds and Thiel voted yea , ( c ) REFUSE IN VACANT LOTS ( REQUESTED BY COUNCILMAN HELTZER ) . Councilman Heltzer raised the question of the City' s responsi - bility in cleaning up a private lot where refuse has been dumped . He would like a policy to apply throughout the City . It was sug - gested the City Manager bring a report to Council in approximately one month . I 10 . NEW BUSINESS ( a ) PETITION FOR VACATION OF PORTION OF PRINCETON AVENUE AND ALLEY IN BLOCK 3 , WESTMORELAND PARK ADDITION BY FREIDHEIM INVESTMENTS ( BELT LINE INDUS - TRIAL PARK ) , Robert Ehrenberg presented a petition to Council on behalf of Belt Line Industrial Park requesting the above vacation . RESOLUTION NO . 3288 It Was moved by Councilman Howard seconded by Counciln*an Heltzer , to waive reading and adopt Resolution No . 3288 entitled 97 council Minutes - May 150 1967 � ' " Resolution for Hearing on Petition to Vacate Street and Alley. Mrs . Richard Maddox presented an application for license by the St . Louis Park Parkettes to . . d a public dance on the tennis courts at City Hall June 6 , 1967 . It was moved by Councilman Pearson seconded by Councilman Heltzer , to approve issuance of the license . Motion passed by a seven yea vote . (b ) RECLASSIFICATION OF PUMP STATION MECHANIC . John McDonald was present on behalf of Union 224 requesting reclassification of Pump Station Mechanic from PW 11 to PW 12 . The item will be place on the agenda for Council meeting May 22 , 1967 . is (c ) PETITION IN CONNECTION WITH PONDING AREA BETWEEN PENNSYLVANIA AVENUE , TEXAS AVENUE , FRANKLIN AVENUE AND 16TH STREET , Marvin Rothstein , 1821 Pennsylvania Avenue , and Leo Kleinbaum , 1825 Pennsylvania Avenue ,were present to discuss plans for the ponding area in the above named area , and request that a well be included to maintain the water level . The City Engineer stated f the system should be adequate for the needs of the area . No action was taken . (d ) METHODIST HOSPITAL ENTRANCE . Councilman Heltzer asked about the possibility of reopening the Louisiana Avenue project . Councilman Reynolds requested the matter placed on the Council agenda for June 5 , 1967 .
