CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Leonard Thiel at 8 : 07 p . m . i i 2 . INVOCATION Invocation was given by Rev . Allen Whitman of St . George ' s Episcopal Church . 3 . ROLL CALL The following Councilmen were present at roll call : Richard Graves James Heltzer Frank Howard Richard Koch Leonard Thiel Also present were the City Manager , City Attorney , Planning Director , Director of Public Works , Assessor , Director of Parks and Recreation and Secretary . Councilman Reynolds arrived at 8 : 14 p . m . and Councilman Pearson arrived at 9 : 10 p . m . Councilman Reynolds left the meeting at 11 : 55 p . m . 4 . MINUTES On motion of Councilman Howard , seconded by Councilman Heltzer , the minutes of the regular meeting held April 3 , 1967 were approved by a five yea vote . Councilmen Pearson and Reynolds were not present . 5 . PUB LIC HEARINGS ( a ) IMPROVEMENT NO. 66 - 06 , PROPOSED ALLEY GRADING BETWEEN PENNSYLVANIA AVENUE , OREGON AVENUE , WEST LAKE STREET AND HIGHWAY NO. 7 , AS DESCRIBED IN NOTICE OF HEARING PUB • LISHED MARCH 9 AND 16 , 1967 ( HEARING CONTINUED FROM 1 APRIL 3 , 1967 ) e Kenneth Anderson , 3737 Oregon Avenue ,was interested in the cost of the project and asked about running the alley through the entire block . Emily Burt , 3737 Pennsylvania Avenue, was opposed to the project . It was moved by Councilman Heltzer , seconded by Council - man Koch to drop this proposal , staff make a more extensive study and notify all abutting property owners when the proposal is complete . 71 1 Council Minutes - April 17 , 1967 (a ) Motion passed by a six yea vote . Councilman Pearson was not � present . (b ) IMPROVEMENT NO. 66 - 24 , PROPOSED GRADING IN AREA OF WEST 26TH STREET , XENWOOD AVENUE , WEST 27TH STREET AND ZARTHAN AVENUE , AS DESCRIBED IN NOTICE OF HEAR - ING PUBLISHED APRIL 6 AND APRIL 13 , 1967 . The Director of Public Works described the project as proposed . Robert Greenberg , attorney for Henry Lapides , owner of property on east side of Zarthan Avenue , was present . Don Robitz , 5901 West 25 -1 Street was in favor of the project but concerned about the traffic in the area . Mayor Thiel declared the hearing closed . RESOLUTION NO , 3259 It was moved by Councilman Howard , seconded by Councilman Koch , to waive reading and adopt Resolution No . 3259 entitled " Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No . 66 - 24 . " Motion passed by a six yea vote . Councilman Pearson was not present . (c ) IMPROVEMENT NO. 66 - 78 , PROPOSED WATER MAIN ON WEST 28TH STREET FROM COUNTY ROAD NO. 18 TO 1 , 700 FEET EAST , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED APRIL 6 AND APRIL 13 , 1967 . The Director of Public Works explained the proposed project . W . M. Burmaster , 9000 West 28th Street, and John Neitzel , 9204 West 28th Street , signed the original petition but wished to withdraw their names because of the cost . Larry Christensen , 9330 West 28th Street , was also concerned with the cost . It was moved by Councilman Reynolds , seconded by Councilman Graves , to continue the hearing to May 1 , 1967 . Motion passed by a six yea vote . Councilman Pearson was not present . (d ) IMPROVEMENT NO. 67 - 019 PROPOSED WATER MAIN IN SOUTH SERVICE DRIVE OF HIGHWAY NO. 12 FROM HAMPSHIRE AVENUE TO COLORADO AVENUE , AS DESCRIBED IN NOTICE OF HEAR - ING PUBLISHED MARCH 23 AND 30 , 1967 . Mayor Thiel declare the hearing closed . RESOLUTION NO. 3260 A motion was made by Councilman Howard , seconded by Councilman Koch , to waive reading and adopt Resolution No . 3260 entitled 72 Council Minutes - April 17 , 1967 5 . ( d ) " Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No . 67 - 01 . " Motion passed by a six yea vote . Co*ncil - man Pearson was not present . ( e ) IMPROVEMENT NO, 66 - 51 , PROPOSED CONCRETE ALLEY PAVING BETWEEN GEORGIA AVENUE , HAMPSHIRE AVENUE , WEST 26TH STREET AND WEST 27TH STREET , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MARCH 23 AND 30 , 1967 . Ron Schulte , 2636 Georgia Avenue , spoke in favor of the project . Mayor Thiel declared the hearing closed . RESOLUTION NO, 3261 It was moved by Councilman Heltzer , seconded by Councilman Graves , to waive reading and adopt Resolution No . 3261 entitled " Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No . 66 - 51 . " Motion passed by a six yea vote . Councilman Pearson was not present . ( f ) IMPROVEMENT NO. 67 - 06 , PROPOSED CONCRETE ALLEY PAVING BETWEEN JOPPA AVENUE , INGLEWOOD AVENUE , CEDAR LAKE AVENUE AND CEDAR STREET , AS DESCRIBED IN NOTICE OF HEAR - ING PUBLISHED MARCH 23 AND 309 1967 . Mayor Thiel declared the hearing closed . Councilman Koch stated that he had a personal interest in property abutting this improvement by reason of ownership that his home is on property abutting the improve - ment and that he was voting on the proposition in order that it might be possible for the Council vote to meet the statutory requirements for extraordinary majority affirmative vote needed to pass . RESOLUTION NO, 3262 It was moved by Councilman Koch , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 3262 entitled " Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No . 67 - 06 . " Motion passed by a six yea vote . Councilman Pearson was not present. ( g ) IMPROVEMENT NO. 67 - 13 , PROPOSED CONCRETE ALLEY PAVING BETWEEN LOUISIANA AVENUE , KENTUCKY AVENUE , WEST 28TH STREET AND WEST 29TH STREET , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MARCH 23 AND 309 1967 . Councilman Pearson arrived at 9 : 10 p . me Ted Solle , 3046 Dakota Avenue , presented a petition signed by residents of the area against the improve - ment , L. H , Gretzer , 3037 Edgewood Avenue , was originally in favor of the project but is now concerned about the cost , Everett Eade s , owner of property at 6417 Minnetonka Boulevard , and Floyd Kivett , 6413 Minnetonka Boulevard were in favor of the improvement . David Leatherman , 6423 Minnetonka Boulevard , Donovan Nelson , 3042 Dakota Avenue , and William Golden , 3056 Dakota Avenue , were in opposition to the project , and suggested the alley would not benefit some residents on Dakota Avenue due to grade , It was moved by Councilman Graves , seconded by Councilman Heltzer , to continue the hearing to May 1 , 1967 for further report from staff. A motion was made by Councilman Pearson , seconded by Councilman Koch , that the City Council go cn record in favor of the proposed Hennepin County Legislation relating to organization of the Hennepin County Library Board and in favor of that portion relating to repeal of Laws of Minnesota 1965 , Chapter 898 , and in opposition to raising the operating mill limit and author - ity to issue bonds for the purpose of building additional libraries . Motion passed by a six yea vote , Councilman Howard abstaining . (c ) PROPOSED CHANGES IN RECREATION PROGRAM WAGES ( M . & C . NO. 67 - 9 ) t 79 Gouncil Minutes - April 17 , 1967 (C ) Bruce Ward , 2904 Virginia Avenue , was interested in park appropriations . 9' Mrs . Andrew Johnson , 2915 Virginia Avenue , stressed the need for proper playground supervision. The Director of Parks and Recreation was present . i Discussion centered on recruiting and salaries in the Recreation Depart - ment . Councilman Reynolds left the meeting at 11 : 55 p . m . It was moved by Councilman Koch , seconded by Councilman Graves , to waive first reading of proposed ordinance transferring the amount of $ 8 , 661 . 20 from the Capital Outlay appropriation in the Park Fund to use for salaries of temporary summer employees . Motion passed by a vote of four yeas and two nays , Councilmen Pearson and Thiel voting nay. A motion by Councilman Howard , seconded by Councilman Pearson , to re - consider the above motion passed by a six yea vote . The vote on the original motion was declared lost by a tie vote of three yeas and three nays . 10 . NEW BUSINESS (a ) COUNCIL MEETING APRIL 24 , 1967 .
