I . CALL TO ORDER
A regular meeting of the City Council was called to order by Mayor
Leonard Thiel at 8 : 06 p . m .
2 . INVOCATION
Invocation was given by Rev . Quinten Alfors of the Evangelical Free

3 . ROLL CALL
The following Councilmen were present at roll call :
Richard Graves
Frank Howard
Richard Koch
Curtis Pearson
Robert Reynolds
Leonard Thiel
Also present were the City Manager , City Attorney , Planning Director ,
Director of Public Works , and Secretary.
Councilman Heltzer arrived at 8 : 08 p . m .
4 . MINUTES
On motion of Councilman Koch, seconded by Councilman Graves , the
minutes of the regular meeting held January 30 , 1967 were approved
by a seven yea vote .
5 . PUBLIC HEARINGS
(a ) PROPOSED REZONING BETWEEN WEST 16TH STREET AND
CEDAR LAKE ROAD IMMEDIATELY WEST OF HIGHWAY NO,
100 FROM R - 2 AND I - 2 DISTRICTS TO B - 2 DISTRICT , RE -
QUESTED BY ONE HUNDRED AND TWELVE CORPORATION

6. PETITIONS , REQUESTS AND COMMUNICATIONS
(a ) APPLICATION FOR LICENSE TO SELL NON - INTOXICATING
MALT LIQUOR OFF SALE BY MEADOWBROOK COUNTRY BOY
DAIRY STORE , 6920 MEADOWBROOK BOULEVARD .
Tom and Inez Payette , applicants for the license , were present.
It was moved by Councilman Heltzer , seconded by Councilman
Koch, to deny issuance of the license . Motion lost by a roll call
vote of five nays and two yeas , Councilmen Heltzer and Koch voting
yea. A motion was made by Councilman Reynolds , seconded by
Councilman Howard , to approve issuance of a license to sell non -
intoxicating malt liquor off sale by Meadowbrook Country Boy
Dairy Store . Motion passed by a vote of five yeas and two nays ,
Councilmen Heltzer and Koch voting nay.
7 . RESOLUTIONS AND ORDINANCES
(a ) RESOLUTION AUTHORIZING PLACEMENT OF TRAFFIC CON.
TROL SIGNS REGULATING PARKING ON MUNICIPAL PARKING
LOTS .

It was moved by Councilman Pearson , seconded by Councilman
Heltzer , to waive reading and adopt resolution authorizing place -
ment of traffic control signs regulating parking on municipal park-
ing lots . Before a vote was taken Councilman Howard stated the
Chamber of Commerce requested deferral of 4he matter for two
weeks . It was moved by Councilman Howard , seconded by
Councilman Koch , to defer the matter to February 20 , 1967 .
Motion passed by a seven yea vote .
8 . REPORTS OF OFFICERS , BOARDS AND COMMITTEES
(a ) PRELIMINARY REPORT OF DIRECTOR OF PUBLIC WORKS
AND ASSESSMENT REPORT WITH RESPECT TO IMPROVEMENT
NO. 64 - 22A, GRADING OF OXFORD STREET FROM 1 , 265 FEET

It was moved by Councilman Koch, seconded by Councilman
Graves , to waive reading and adopt Resolution No . 3215 entitled
" Resolution Receiving Reports and Calling Hearing on Improve -
ment No . 64 - 22A. " Motion passed by a seven yea vote . Hear -
'`` ing will be held March 6 , 1967 .
(b ) REPORT OF EXCELSIOR BOULEVARD STUDY BY MIDWEST
PLANNING & RESEARCH , INC .
A joint meeting of Council and Planning Commission will be
held at 8 : 00 p . m . . March 9 , 1967 to discuss the Excelsior
Boulevard study .
9 . (a ) APPOINTMENTS TO BOARDS AND COMMISSIONS ( DEFERRED
FROM JANUARY 30 , 1967 ) .
It was moved by Councilman Reynolds , seconded by Councilman
Pearson , to consent and approve the reappointments as listed.
Before a vote was taken a motion was made by Councilman
Heltzer , seconded by Councilman Koch , to vote on the reappoint -
ments individually. Mayor Thiel announced the voting would be
taken individually .;
It was moved by Councilman Reynolds , seconded by Councilman
Graves , to approve the reappointment of John Palmer to the
Planning Commission for the term ending December 31 , 1969 .
Motion passed by a vote of six yeas and one nay , Councilman
Koch voting nay.

It was moved by Councilman Howard , seconded by Councilman
Reynolds , to approve the reappointment of Robert Shank to the
Planning Commission for the term ending December 31 , 1969 .
Motion passed by a vote of five yeas and two nays , Councilmen
Heltzer and Koch voting nay .
A motion was made by Councilman Howard , seconded by Council .

the Planning Commission for the term ending December 31 , 1969 .
Motion passed by a vote of five yeas and two nays , Councilmen

Council representative to the Planning Commission for the term
ending December 31 , 1967 . Motion passed by a vote of six yeas ,
Councilman Howard abstaining .

Reynolds , to approve the reappointment of Curtis Pearson as
Council representative to the Planning Commission for the term
ending December 31 , 1967 . Motion passed by a vote of six yeas ,
Councilman Pearson abstaining .
A motion was made by Councilman Reynolds , seconded by Council *
man Pearson , to approve the reappointment of Rosemary Griak to
the Parks and Recreation Advisory Commission for the term end -
ing December 31 , 1968 . Motion passed by a seven yea vote .

A motion was made by Councilman Howard , seconded by Council -
man Pearson , to approve the reappointment of Ron Berthe to the
Parks and Recreation Advisory Commission for the term ending
December 31 , 1968 . Motion passed by a seven yea vote .
It was moved by Councilman Pearson, seconded by Councilman
Howard , to approve the reappointment of Roy Berset to the Parks
and Recreation Advisory Commission for the term ending December
31 , 1968 . Motion lost by a roll call vote of four nays and three

After further discussion it was moved by Councilman Reynolds .

A motion was made by Councilman Reynolds , seconded by Council +
man Pearson , to approve the reappointment of Roy Berset to the
Parks and Recreation Advisory Commission for the term ending
December 31 , 1968 . Motion passed by a seven yea vote .
It was moved by Councilman Pearson , seconded by Councilman
Howard , to approve the reappointment of James Heitzer as Council
representative to the Parks and Recreation Advisory Commission
for the term ending December 31 , 1967 . Motion passed by a six
yea vote , Councilman Heltzer abstaining .
It was moved by Councilman Reynolds , seconded by Councilman
Graves , to approve the reappointment of Robert Erickson to the
Building Construction Codes Advisory Commission for the term
ending December 31 , 1971 . Motion passed by a seven yea vote .
It was moved by Councilman Reynolds , seconded by Councilman
Howard , to approve the reappointment of Frank Esterly to the
Fire Civil Service Commission for the term ending September Z0,0
1969 . Motion passed by a vote of six yeas and one nay , Council *
man Koch voting nay.

9 . (a ) It was moved by Councilman Reynolds , seconded by Councilman
Pearson , to approve the reappointment of Robert Smith to the
Fire Civil Service Commission for the term ending September
20 , 1968 . Before a vote was taken Councilman Koch moved to
defer the reappointment of Robert Smith for two weeks . Mayor
Thiel announced he had information from the City Attorney that
the Fire Civil Comkjl c,mission is appointed by Council under State
Statute . Mayor Thiel declared the above motions for Fire Civil Service
Commission appointments cancelled on advice of the City Attorney
and requested the matter be deferred until February 20 , 1967 . He
re"quested the Council members to submit names for the appoint -
ments .
Councilman Koch stated he operated on the rationale that to have
as many new ideas and viewpoints as possible it is desirable to
appoint new members to the boards from time to time . Some of
the present members have served as long as twelve
years and
missed a large percentage of the meetings . He re -
U quested his reasons for opposition to the reappointments be entered

10 . NEW BUSINESS
( a ) PRELIMINARY PLANS FOR PROPOSED LIBRARY BUILDING ,
Mas Matsumoto and Wayne Nordgren, architects for Smiley and
Associates , were present to outline the preliminary plans .
It was moved by Councilman Pearson , seconded by Councilman
Heltzer , to approve the preliminary plans for the proposed
library building and order preparation of final plans and speci -
fications . Motion passed by a seven yea vote .

(b ) PROPOSED AGREEMENT WITH THE MINNESOTA STATE
HIGHWAY DEPARTMENT FOR STORM SEWER IMPROVEMENT
NO. 65 - 4 ( BROWNIE LAKE ) .

It was moved by Councilman Koch , seconded by Councilman
Pearson , to waive reading and adopt Resolution No . 3216
entitled " Resolution Authorizing Agreement with Minnesota
Department of Highways Relative to Storm Sewer Improvement

INTERSECTION OF HIGHWAY 100 AND MINNETONKA BOULEVARD.
A motion was made by Councilman Pearson , seconded by Council -
man Koch , to approve preliminary plans and authorize the City
Manager to prepare an agreement with the provision that staff
investigate the possibility of a right turn only movement on the
'south side of Minnetonka,, Boulevard at Toledo. Avenue . Motion
passed by a seven yea vote .
( e) WEST 39TH STREET IMPROVEMENTS .
It was moved by Councilman Pearson , seconded by Councilman
Reynolds , that staff present a brief report on the status of the
West 39th Street improvements by February 20 , 1967 . Motion
passed by a seven yea vote .
(f ) COUNCIL MEETING FEBRUARY 13 , 1967 "
A motion was made by Councilman Heltzer , seconded by Council "
man Koch, that no Council meeting be held February 13 , 1967 .
