4 . MINUTES I
i
On motion of Councilman Koch , seconded by Councilman Graves , the minutes
of the regular meeting held September 18 , 1967 and minutes of budget meet -
ings held September 9 , 13 , 16 , 20 , 23 and 27 , 1967 were approved by a
seven yea vote as amended by changing the minutes of September 27 , 1967 ,
page 197 , on the vote for the motion for refuse collection charges to six yea
and one nay , Councilman Pearson voting nay .

5 . PUBLIC HEARINGS
( a ) PROPOSED SPECIAL ASSESSMENT FOR IMPROVEMENTS WITHIN THE
CITY , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED SEPTEMBER
121 1967 .
Ted Shirley , 2800 Huntington , was concerned with preserving the trees
due to damage to roots during construction . Philip Stern , 4421 West
25th Street , felt the replacement of curb was unnecessary abutting his i
property . Mrs . Rose Segal , 2604 Lynn Avenue , explained she had paid
for curb and gutter and driveway previously and did not want to pay again .

5 . ( a ) Grant W . Anderson , 2633 Huntington , presented a petition objecting to
the proposed assessment and stated damage due to construction had not
been repaired . He was assured it would be repaired . Mrs . F . A. Janes ,
2668 Glenhurst , was concerned with the cost of the project . Mayor Thiel
declared the hearing closed .
RESOLUTION NO , 3381
It was moved by Councilman Reynolds , seconded by Councilman Howard ,
to waive reading and adopt Resolution No . 3381 entitled " Resolution
Adopting Assessment . " Motion passed by a vote of six yeas , Councilman j
Graves not being present to vote . 1

( b ) PROPOSED PRELIMINARY PLAT OF REGISTERED LAND SURVEY
( CEDAR LAKE ROAD AND GREAT NORTHERN RAILROAD TRACKS
WEST OF FRANCE AVENUE ) REQUESTED BY E . L . KAVLI .
Lloyd Syverson , attorney for A . C . Kavli , stated his client had no objec -
tion to the proposed Registered Land Survey . William Corrick was present
representing E . L. Kavli . Mayor Thiel declared the hearing closed . A
motion was made by Councilman Pearson , seconded by Councilman Reynolds ,
to approve the preliminary plat of Registered Land Survey as requested by
E . L . Kavli . Motion passed by a seven yea vote .
RESOLUTION NO . 3382
Councilman Pearson made a motion , seconded by Councilman Reynolds ,
to waive reading and adopt Resolution No . 3382 entitled " Resolution Giv -

ment of Highways Relative to Relocation of Water and Sanitary Sewer
Facilities at Highway No . 100 and Excelsior Boulevard . " Motion paased

It was moved by Councilman Pearson , seconded by Councilman Reyncids ,
to direct the City Manager to acquire Outlot 1 , Second Country Club
Addition of Westwood Hills and that portion of Outlot 2 , deemed neceAps -
ary. Before a vote was taken it was moved by Councilman Pearson ,
seconded by Councilman Graves to table the matter . At this point the
motion was made to reconsider and defer item 7H.

10 . (c ) RESOLUTION FOR SUBMISSION OF THE QUESTION OF SPECIAL
LICENSES FOR SUNDAY SALES OF INTOXICATING LIQUOR ,
RESOLUTION NO, 3392 +

A motion was made by Councilman Heltzer , seconded by Councilman

Reynolds , to waive reading and adopt Resolution No . 3392 entitled
" Resolution for Submission of the Question of Special Licenses for
Sunday Sales of Intoxicating Liquor . " Motion passed by a seven yea
vote .
( d ) COUNCIL MEETING OCTOBER 92 1967 .
It was moved by Councilman Howard , seconded by Councilman Koch ,
that no Council meeting be held October 9 , 1967 . Motion passed by
a seven yea vote ,
11 , MISCELLANEOUS
( a ) DAMAGE CLAIMS ,
1 . Ellen Yager , 2819 Glenhurst Avenue ,
It was moved by Councilman Pearson , seconded by Councilman Graves ,
to file claim with the City Clerk for proper action by the City Manager
and City Attorney. Motion passed by a seven yea vote .
( b ) SNOW REMOVAL ON SIDEWALKS ,

Councilman Koch read excerpts from the Ordinance Code regarding
snow removal and stated he felt snow removal should be enforced .
Council discussed the problem of removing snow from sidewalks
within walking distance of schools , It was moved by Councilman
Koch , seconded by Councilman Heltzer , that the City Manager re -
port to Council no later than oi� e month from this date , examining
alternatives of a joint program with the School District in which the
City would plow arterial sidewalks within walking distance of schools , a .� d
the arrangement of policemen or a member of staff noting negligent
home owners and business owners and recommending a procedure for
remedying unplowed sidewalks . Motion passed by a seven yea vote .
A motion was made by Councilman Koch , seconded by Councilman
Heltzer , that the City Manager report within a month regarding the
advisability of a snow plowing ordinance for parked cars on one side
of the street on designated days . Motion passed by a seven yea vote ,
