CALL TO ORDER A re alar meeting of the City Council was called to order by Mayor g Leonard Thiel at 8 : 04 p . m . 2 . INVOCATION invocation given by Rev . Stewart Dale of the First Lutheran Church. o was 3 . ROLL CALL The following Councilmen were present at roll call : Richard Graves James Heltzer Frank Howard Richard Koch Robert Reynolds Leonard Thiel Also present were the City Manager , City Attorney, Planning Director , Director of Public Works , Assessor , and Secretary . Councilman Pearson arrived at 8 : 10 p . m . 4 . MINUTES On motion of Councilman Heltzer , seconded by Councilman Koch , the minutes of the regular meeting held January 23 , 1967 were approved by a six yea vote . Councilman Pearson was not present. 5. PUBLIC HEARINGS (a ) IMPROVEMENT NO. 66 - 10 , PROPOSED HOT MIX PAVING AND CONCRETE CURB AND GUTTER ON STREETS LOCATED BETWEEN TEXAS AVENUE AND AQUILA AVENUE FROM WEST 33RD STREET TO WEST 36TH STREET , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED DECEMBER 15 , 1966 AND DECEMBER 22 , 1966 . The Director of Public Works showed slides and described the types of streets to be constructed. The City Manager read the Council policy concerning street paving . John A. Bodeman , 3301 Utah Avenue, represented property owners in the area opposed to the project and presented a petition to Council . 21 Council Minutes - January 30 , 1967 1 5. (a ) Mr . Bodeman listed heavy assessment , excess traffic and destroy - ing good streets already in existence as reasons for opposition. Councilman Pearson arrived at the meeting . Edward Strand , 8536 Yukon Avenue , C . J . Ahlstrand , 3320 Yukon Avenue James Bratten , 3540 Yukon Avenue , Cliff Andreason, 8825 West 341 Street , Mrs . Urban Meyers , 8624 West 35th Street, and Emil Picha , 8112 West 35th Street spoke in opposition to the improve - ment . Reduction in maintenance costs , permanent streets being more economical over a long period and curb and gutter improving property values were cited as major justification for constructing permanent streets . Mayor Thiel declared the hearing closed . RESOLUTION NO, 3205 It was moved by Councilman Heltzer , seconded by Councilman Koch , to waive reading and adopt Resolution No . 3205 entitled " Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No . 66 - 10 , " as amended by deleting the 3300 block on Utah Avenue , Virginia Avenue , Wyoming Avenue , Xylon Avenue , and all but the south 200 feet north of West 34th Street on Yukon Avenue . Motion passed by a seven yea vote . (b ) IMPROVEMENT NO, 65 - 01 , PROPOSED ASPHALTIC CONCRETE PAVING AND CURB AND GUTTER CONSTRUCTION ON WEST 36TH STREET FROM TEXAS AVENUE TO AQUILA AVENUE , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED DECEMBER 22 , 1966 AND DECEMBER 29 , 1967 . The Director of Public Works described thero osed p p project, including a proposed service road on the north side of the street and an entrance to Knollwood Plaza at Wyoming Avenue on the south side of West 36th Street, James Bratten , 3540 Yukon Avenue, asked about the use of State aid funds for the project. Robert Johnson, 3544 Zinran, asked about the assessment for his property. C . J . Ahlstrand , 3320 Yukon Avenue, was concerned about traffic in the area . John A. Bodeman , 3301 Utah Avenue, was opposed to assessing the prop . erty owners in the area for this project. i i James A. RESOLUTION NO. 3206 A motion was made by Councilman Pearson , seconded by Council - : man Reynolds , to waive reading and adopt Resolution No . 3206 entitled " Resolution Ordering Preparation of Plans Improvement No . 65 - 01 . " Motion passed by a seven yea vote . It was moved by Councilman Pearson , seconded by Councilman Reynolds , to defer action on Improvement No . 65 - 01 to February 20 , 1967 . Motion passed by a seven yea vote . Mr . Hallach stated the board would meeting February 8 , 1967 and the right of way for the south side of West 36th Street would be presented at that time . . r. 6. PETITIONS , REQUESTS AND COMMUNICATIONS (a ) APPLICATION FOR LICENSE TO SELL NON - INTOXICATING MALT LIQUOR OFF SALE BY MEADOWBROOK COUNTRY BOY DAIRY STORE , 6920 MEADOWBROOK BOULEVARD . A motion was made by Councilman Pearson , seconded by Councilman Reynolds , to approve issuance of the license . Motion lost by a vote of five nays and two yeas , Councilmen Pearson and Reynolds voting yea . 7 . RESOLUTIONS AND ORDINANCES (a ) RESOLUTION AUTHORIZING PLACEMENT OF PARKING SIGNS IN AREA OF EXCELSIOR BOULEVARD AND OTTAWA AVENUE , RESOLUTION NO. 3207 It was moved by Councilman Reynolds , seconded by Councilman Koch , to waive reading and adopt Resolution No . 3207 entitled " Resolution Authorizing Placement of Parking Signs in Area of Excelsior Boulevard and Ottawa Avenue . RESOLUTION NO, 3208 It was moved by Councilman Pearson , seconded by Councilman Koch , to waive reading and adopt Resolution No . 3208 entitled " Resolution Accepting and Renewing Contract with Suburban Hennepin County Relief Board . It was moved by Councilman Heltzer , seconded by Councilman Koch, that the City Attorney no longer prepare legislative reports for the Council . It was moved by Councilman Howard , seconded by Councilman Koch , to approve the proposed agreement with B & E Patrol , and authorize the Mayor and City Manager to execute on behalf of the City . Motion passed by a roll call vote of four yeas and threenays , Councilmen Graves , Meltzer and Reynolds voting nay. (b ) REPORT OF PLANNING COMMISSION ( CASE NO, 66 - 27 - MISC . ) UPON CHANGES RECOMMENDED BY CHAMBER OF COMMERCE ON STUDY OF B - 1 AND B - 2 DISTRICTS ( .DEFERRED FROM JANUARY 23 , 1967 ) . Herbert Davis , attorney for Bernard Horovitz , spoke in favor of an amendment to the Zoning Ordinance to allow the sale of liquor in restrauants at tables where food is served . Gene Strommen , Chamber of Commerce , also spoke in favor of the amendment . Leland Gottstein , 4123 Sunset Boulevard , president of the Fern Hill Improvement Association , A . h . Lieberman , 4210 Sunset Boulevard , and I'Viarjean Cooper , Secretary of the Park Hill Improvement Association , spoke in opposition to the amendment . It was moved by Councilman Reynolds , seconded by Councilman Heltzer , that a new subdivision for on sale liquor in restaurants at tables where food is sold , be added to Section 6 : 111 . 2 of the City Attorney ' s report . Motion lost by a roll call vote of five nays and two yeas , Councilmen Pearson and Reynolds voting yea . It was moved by Councilman Howard , seconded by Councilman heltzer , to approve Planning Commission recommendations on B - 1 and B - 2 study and request preparation of an ordinance . Motion passed by a vote of six yeas and one nay , Councilman Reynolds voting nay . 26 Council Minutes - January 30 , 1967 10 . NEW BUSINESS ( a ) TABULATION OF BIDS FOR THREE DUMP TRUCKS AND THREE PICKUP TRUCKS . It was moved by Councilman Howard , seconded by Councilman Reynolds , to designate Jay Kline Chevrolet Company as the low - est responsible bidder and to accept bid in the amount of $ 13 , 041 . 01 for three dump trucks and $ 3 , 598 . 29 for three 3 / 4 ton pickup trucks . Motion passed by a six yea vote . Councilman Pearson was not present . (b ) INTERSECTION OF HIGHWAY NO , 100 AND EXCELSIOR BOULEVARD . i Mayor Thiel informed the Council that State Highway Commissioner , John R . Jamieson, told him the intersection of Highway 100 and Excelsior Boulevard has been scheduled for the third quarter of this year between July and September . Mayor Thiel also presented Council members with an outline for Guidelines for St . Louis Park . F ( c ) POLICE. SERGEANT ' S EXAMINATION . John McDonald , Business Agent for Local No . 57 , was present to request that a date be set for a Sergeant ' s examination due to a vacancy which occurred in 1966 . The City Manager stated that the third board member had been appointed this evening and a date would be set soon . 28 I Council Minutes - January 30 , 1967 11 . (d ) YIELD SIGN AT FRANKLIN AVENUE AND WESTyV OOD HILLS DRIVE . Councilman Pearson stated that the yield sign at the intersection of Franklin Avenue and Westwood Hills was causing motorists difficultyand requested that a change be made . The Director of Public Works will make a survey of this corner . RESOLUTION NO . 3214 r It was moved by Councilman Pearson , seconded by Councilman Koch , to waive reading and adopt Resolution No . 3214 entitled " Resolution Authorizing Removal of Yield Sign at Intersection of Franklin Avenue and Westwood hills Drive .
