LOUIS PARK , MINNESOTA January 23 , 1967 L CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Leonard Thiel at 8 : 18 P. m. 2 . INVOCATION Invocation was given by Councilman Howard. 3 . ROLL CALL The following Councilmen were present at roll call : Richard Graves James Heltzer Frank Howard Richard Koch Robert Reynolds Leonard Thiel Also present were the City Manager , City Attorney. Director of Public Works , Planning Director , and Acting Seoretary. 4. MINUTES On motion of Councilman Reynolds , seconded by Councilman Koch , the minutes of the regular meeting held January 3 , 1967 and the special meeting held January 3 , 1967 were approved by a six yea vote . i 5. PUBLIC HEARINGS None I 6. PETITIONS , REQUESTS AND COMMUNICATIONS i ( a ) COMMUNICATION FROM THE ROLLER GARDEN , 5622 WEST LAKE STREET REQUESTING PERMISSION TO REMAIN OPEN UNTIL MIDNIGHT. i It was moved by Councilman Howard, seconded by Councilman Reynolds , to grant the request. The motion carried with a six yea vote. I ORDINANCE NO . 993 i It was moved by Councilman Howard , seconded by Councilman Heltzer , to waiv a second reading and adopt Ordinance No. 993 entitled , " Ordinance Designating Public Way as Monterey Drive. " Motion passed by a six yea vote . 8. ORDINANCE TO ALLOW RECLAMATION CF NS E AVENUE AT UNDER R - 1 ZONING ON WEST SIDE CF EGO 28TH STREET BY REMOVING PEAT AND DEPOSITING FILL. Mr . Paul Ravich , attorney , appeared with Mr . Westling to ask for action by the Council . • Councilman Howard asked if Mr . Westling would agree with the recommendations of the Planning Comrriission regarding drainage. Mr . Westling refused to pay costs for drainage . Mr . Andre indicated that the type of fill for sub -base , particularly under the area to be used for street purposes , was not specified in the drainage plan. Motion to deny the special permits was made by Councilman Heltzer and seconded by Councilman Howard. Motion passed by a six yea vote. (c ) REPORT OF PLANNING COMMISSION ( CASE NO. 66 - 27 - MISC. ) UPON CHANGES RECOMMENDED BY CHAMBER OF COMMERCE ON STUDY OF B - 1 AND B - 2 DISTRICTS . It was moved by Councilman Graves , seconded by Councilman Reynolds , to defer to January 30 , 1967 . Notion passed by a six yea vote. ( d ) REPORT OF PLANNING COMMISSION ( CASE NO. 66 - 42 - Z . ) RECOMMENDING FAVCRABLY UPON THE REQUEST OF C . T . HOLBER G AND HENRY A. ANDERSON TO REZONE LOTS 18 , 19 , 20 , 21 , BLOCK 4 , SUBURBAN HOMES CC ' S AND INCLUDING THE EAST ONE - HALF OF VACATED ZAR THAN AVENUE ADJOINING , FROM R - 2 DISTRICT TO B - 2 DISTRICT . Mr . Russell Lindquist was present to represent One Hundred and Twelve Corporation, It was moved by Councilman Howard , seconded by Councilman Koch , to set date for public hearing February 6 , 1967 . Motion passed by a five yea vote , Mr . Reynolds not present for the voting . (f ) MINUTES OF PLANNING COMMISSION MEETING HELD JANUARY 4, 1967 . The minutes were ordered by the Mayor to be received for filing. ( g ) REPORT OF CITY MANAGER ( M. & C . No . 67 - 1 ) CONCERNING COMMER CIAL GAR BAGE AND R EFUSE COLLECTION CHAR GE. It was moved by Councilman Reynolds , seconded by Councilman Koch, to approve the Uniform Schedule of Fees for Commercial Garbage and Refuse Collection . Motion passed by a six yea vote . (h ) CITY ATTORNEY REPORT NO , 1 COVERING STATE LEGISLATION INTRODUCED . The report was ordered by the Mayor to be received for filing . ( i ) REPCR T OF CITY MANAGER ( Ni . & C . No. 67 - 2 ) CONCERNING ANIMAL CONTROL CONTRACT , Stanley King , D . V . M . , Animal Humane Society and tier . Bill C . O . Cooley , owner of Tonka Kennels , were present. On motion by Councilman Reynolds , seconded by Councilman Heltzer , this matter was deferred to January 30 , 1967 . Iv� otion passed by a six yea vote . (j ) REPORT OF CITY ATTORNEY REGARDING TRIAL ATTORNEYS FOR TRAFFIC AND OTHER MISDEMEANCR CASES, Councilman Koch moved to defer to February 6 , 1967 . UNFINISHED BUSINESS Councilman Reynolds moved that we send a letter of thanks he Council inke , 2916 Boone Avenue , for the screen he donated for use in Chambers . Councilman Howard seconded and the motion carried with a six yea vote. 10 , NEW BUSINESS Motion was made by Councilman Heltzer that a letter of commendation be sent to the Street Department regarding the efficiency of the snow removal operations . The motion was seconded by Councilman Howard and carried with a six yea vote . 11 . MISCELLANEOUS (a ) DAMAGE CLAIMS 1 . Kurt G. O . Pinke , Z) 16 Boone Avenue r It was moved by Councilman Reynolds , seconded by Councilman Howard to file claim with the City Clerl. for proper action by the City Manager and City Attorney. The motion carried 5 - 01 Councilman 1-seltzer absent at the time of the voting . 12 . CLAIMS , APPRCPRIATICNS AND CONTRACT PAYMENTS (a ) VERIFIED CLAIMS On motion of Councilman Ploward , seconded by Councilman Graves , the lists of verified claims prepared by the Director of Finance and presented to the Council dated January 16 and January 23 , 1967 in the total amounts of $4 , 520 . 30 for payroll , and $479 , 790 . 05 for vendors were approved , and the City Nianager , City Clerk, and City Treasurer were authorized to issue checks covering same by a five yea vote .
