MINUTES
On motion of Councilman Thiel, seconded by Councilman Howard, the
minutes of the regular meeting held September 7, 1965 and special
meetings held September 8, 13, and 15, 1965 were approved by a five
yea vote. Councilmen Ehrenberg and Reynolds were not present.

There being no one present interested in the matter, Mayor �Nolfe
declared the hearing closed. A motion was made by Councilman

RESOLUTION NO. 2690
It was moved by Councilman Ehrenberg, aeconded by Councilman
Pearson, to waive reading and adopt Resolution No. 2894 entitled
"Resolution Granting Variance of Fencing from the Requirements
of Section 6:045. 2, Subd. 2 of the St. Louis Park Zoning Ordinance. "
Motion passed by a six yea vote. Councilman Reynolds was not
present.

COMPLETED WITI-iIN TI-�E CITY, AS DESCRIBED IN NOTICE
OF HEARING PUBLISHED AUGUST 19, 1965 (IMPROVEMENT
NOS. 62-?9, 62-80, ANL 64-5, SANITARY SEWER, WATER
MAIN, AND CREEK DREDGING).
Mayor �Volfe requested Councilman Ehrenberg to take the chair
due to the fact that his property was included in the assessment
project No. 64-5.
Gera�d Stutzer, 8906.Minnehaha Circle, represented the resi-
dents assessed for Improvement No. 64-5, dredging Minnehaha
Creek,and presented a petition to the Council agreeing to share
the cost equally.
Councilman Pearson asked the assessor with respect to Water Main
Improvement No. 62-80 and Sanitary Sewer Iinprovement No. 62-?9
why some property was taken out of the assessment roll. The
assessor st2ie�. such properties did not abut upon the mains, and
therefore were left out. Councilman Pear'son ask�d if th�se
omitted lots were �eveloped at a lat�r time would thzy then pay
thzir fair share of th� cost: The assessor stated that if they
want to connect later they will have to get special permit and
pay these costs, and the building department would inform hirn
when a special permit to hook up was requested. The property
concerned is sanitary sewer Improvement No. 62-?9, Lots 18,
19, 20, 21, 2Z, Block 5, Lewiston Dark Ac�dition; water main
Improvement No. 62-80, Lots 19, 20, 21, 22, Block 5; Lots 6

A motion was made by Councilman Pearson, seconded by Council-
man �-loward, to waive reading and adopt Resolution No. 289 2
entitled "Resolution Adopting Assessment" as amended (Improve-
ments No. 62-?9, 62-80, and 64-5). Motion passed by a four yea
vote. Mayor Wolfe ancl Councilman Heltzer were out of the room
and Councilman Reynolds was not present.

room and Councilman Reynolds was not present. Hearing will
be held October 18, 1965.

John Bird, 8500 illi est 35th Street was present. The Director
of Public V�lorks explained that this wall was originally built in
1954 in connection with grading on West 35th Street, Improve-
ment No. 54-164. A motion was made by Councilman Howard,
seconded by Councilman Thiel, requesting staff to report on
assessment project No. 54-164 concerning surplus monies that
might be applied to project No. 65-35. Motion passed by a
seven yea vote.
�ESOLUTION NO. 2895
It was moved by Councilman Heltzer, seconded by Councilman
Thiel, to waive reaaing and adopt Resolution No. 2895 entitled
"Resolution Receiving Report and Plan�, Approving Plans,Order-
ing Improvement and Authorizing A.dvertisement for Bids, Improve-
ment No. 65-3�. " Motion passed by a seven yea vote. Councilman
Thiel left the meeting at 9:10 p. m.
(g) REPORT OF LAND ACQUISITION.
1. Deed of easement from Irvin E. Posey and Evelyn W. Posey
dated July 15, 1965 for drainage and storm sewer to assist in
title problem of land owner whose predecessor in title built
ovzr city sewer, for the north five feet of the west fifty-four
feet of Lot 27, Block 16, and the north seven feet of Lot 27,
Block 16, except the west fifty-four feet, all in Park Manor
Addition.
It was moved by Councilman Pearson, seconded by Councilman
Reynolds, to accept deed of easement and authorize the City Clerk
to file same for record. Motion passed by a six yea vote. Council-
man Thiel was not present. �

RESOLUTION NO. 2899
It was moved by Councilman Pearson, seconded by Councilman
Heltzer, to waive reading and adopt Resolution No. 2899 entitled
"Resolution Authorizing Temporary Placement of Traffic Control
Signs Regutating Parking. " The "No Parking Any Time" signs
will be replaced for a period of two weeks beginning September
20, 1965 with "No Parking 4:OOp, m, to 6:00 p, m. " signs,
Motion passed by a six yea vote. Councilman Thiel was not
present.
(b) COMMUNTCATION FROM VILLAGE OF DEEPHAVEN CONCERN-
ING HIGHWA� NO. 7.
Mayor Wolfe read a letter from the Village of Deephaven con-
cerning the urgent need for the improvement of Highway No. 7
by the State Highway Department. A motion was made by
Councilman Pearson, seconded b�y Councilman Reynolds to
approve Resolution No. 41- 65 adopted by the Village of Deephaven

a six yea vote. Councilman Thiel was not present.

(a) VERIFIED CLAIMS.
- On motion of Councilman Heltzer, seconded by Councilman
Pearson, the lists of verified claims prepared by the Director
of Finance and presented to the Council dated September 20, 1965
as amended by adding the claim of Cleve Austin in the amount of
$3, 000. 00, were approved in the total amounts of $?, 298. 00 for
payroll and $46, 306. 34 for vendors, and the City Manager, City
Clerk, and City Treasurer were authorized to issue checks cover-
ing same by a six yea vote. Councilman Thiel was not present.

Reynolds, the above payments on contract work presented by the
City Engineer were approved, and the City Manager, City Clerk,
and City Treasurer were authorized to issue checks for their
respective amounts by a six yea vote. Councilman Thiel was
not present.
